Very shortly thereafter the Federal Cornmn-rnications Conrnission issued a rrNotice of Inquiry and Proposed Rule Making Relating to CAT\y'r issued April 29. The proposals of Ehe Federal Cornrmrnic ations Commission, which had not previously determined that it assumed jurisdiction over these operations, were rather widespread. In addition to this, proposals of regulation of these enterprises have been made and hearings had in the Congress of the United States. A1so, several lawsuits are pending relative to copyright violations, etc., for determina- tion of these items. Ihe League of National Cities has issued a special bulletin to its member cities making various recornmendations concerning CATV, among them being,rrPostpone final action on any CATV application until the FCC makes a final determination of its authority to regulate CATV." Our clients recomnend that your city fo11ow such recornrnendation, provided, however, that the application which we forwarded in April Mayor and City CounEil June 10,. L965 P age 2 remains in the status quo as having been filed. When the FCC situation has been resolved andf or Congressional action has been taken, we believe that all parties will be able to proceed more intelligently with proper franchise regulations. There may be other applications which desire innnediate action, and should this be the case, we would appreciate being notified of any intefltion on your part so to do.
