RE: TORT CLAIM NOTICE OF CLAIMANT CIERRA WILLIAMS
Dear Sirs or Madams.
You are hereby notified, pursuant lo ldaho Code $ 6-901, et seg., that Claimant Cierra
Williams hereby makes a claim against the Ada County Highway District and the City of
Meridian, their assigns, employees, agents, servants and/or representatives, and all other
individuals acting in their official capacity on behalf of the Ada County Highway District and the
City of Meridian, arising out of personal injuries Cierra Williams sustained while using a public
sidewalk on October 9, 2015, and the damages she has suffered as a result of the injuries.

Cierra Williams is 18 years old and lives at home with her mother in Boise, ldaho. She is
presenfly completing her senior year in high school with plans to move to california after
graduation to further pursue a college education. Ms. Williams was a competitive gymnast for
many years. she is a tall, athletic young woman. Around 10:00 pm on october 9, 2015, Ms.
Williams was with some friends at a house located on Expedition Drive in Settlers Bridge
Subdivision, Meridian, ldaho. This was not their destination, and the group planned on heading
to another friend's home. While at this location, Ms. Wlliams ran outside to retrieve something
from her car that was parked on the street out front. lt was a cold night, and she was not
wearing shoes, so she quickly jogged from the house out to her car. Ms. williams then tripped
over a manhole cover that was protruding up fir:m the sidewalk. situated on a portion of
pavement in front of the home located at 1873 E Trail Blazer Dr., Meridian, ldaho, the subject
manhole cover is marked "Storm Drain'. lt is located between the sidewalk and the road as can
be seen in the photo attached as Exhibit "1". The manhole cover protrudes approximately two
inches above the pavement and approximately two inches higher than a second manhole cover
located only a few feet away.
Ms. Wlliams had caught her lefl second toe on the manhole cover, nearly severing the
toe completely. Ms. Williams felt as though hei toe was missing and used the flashlight on her
cell phone to look for it. She then realized her loe was still attached, but was dangling under her
left foot, held on by only a thin piece of skin. Once the others realized what had happened, the
mother of a friend quickly rushed Ms. Williams to the emergency room at St. Luke's Meridian
Medical Center. They anived at the hospital at midnight on October 10,2015.
At the hospital, x-rays and examination confirmed an open dislocation of the distal
interphalangeal (DlP) joint of Ms. Williams' left second toe with degloving. The wound was
irrigated by the emergency room physician and sterilely dressed, and Ms. Williams was
admitted for surgery. Orthopedic surgeon Brittorr Wells, MD, was consulted and at about 10:00
a.m. on October 10, 2015, performed wound exploration, irrigation and debridement,
repair/reconstruction and pinning versus amputation of Ms. Williams'toe. Due to Ms. Williams'
young age, Dr. Wells wanted to try and reattach her toe if at all viable. Surgery was without
complication, and Ms. Williams required continuous lV antibiotics before being discharged home
on October 12,2015. Ms. Williams suffered unbearable pain prior to surgery, and in the
following days. She was placed in a hard shoe and discharged with crutches, pain medication
and a heavy course of antibiotics. Post-operative care was critical to observe the viability of the
toe. On November 23, 2015, Dt. Wells removed ihe metal pin from the left second toe, and she
was allowed to transition back to normal shoe wear. Ms. Williams last saw her orthopedist on
February 10,2016

December 29, 2015, and her condition has been improving. Presently, Ms. Williams suffers
from numbness at the tip of her toe and sensitivity to cold. she walks with a limp whenever she
is barefoot because her toe is still quite painful without foot protection and padding Her long
term prognosis is unknown. she will likely be left with permanent aches, nerve pain, and
arthritis. Her toe is discolored, deformed and sensitive. While the replantation of Ms. Williams'
toe may be successful, there is still the possibility the toe will require amputation or additional
surgery in the future. Regardless, Ms. williams has suffered severe and permanent harm.
The failure of some or all of the governmental agencies named herein through their
assigns, employees, agents and/or representatives, to properly maintain its premises was a
proximate cause of the injuries suffered by Cierra Williams. The governmental entities named
herein through their assigns, emptoyees, agents and/or representatives negligently and/or
recklessly approved, designed, constructed, maintained and failed to properly warn or sign
about the protruding manhole cover or otherwise assure a safe pathway upon which the public,
including Ms. Williams, could safely travel. As a nrcximate result of the governmental agencies
named herein breach of said duty, claimant was damaged.
Cierra Williams' damages are yet to be determined but will likely exceed the maximum
allowable recovery against governmental entities in the state of ldaho. She will continue to incur
medical care expenses despite the recovery she has accomplished to date. Those expenses
include fulure medical care, medical devices, medical supplies and perhaps additional surgical
procedures or amputation. Her damages also include past physical, mental and emotional pain
and suffering, as well as future physical and mental suffering for the remainder of her life.

MAKING PROOF OF BENEFICIAL USE
HOSI TO MAKE PROOF
In order for a permit holder to fu1fll1 the conditions of Ehe permlt and obtain a
water license, he must submit proof of application of water to beneficial use on or
before the date set forth in his permlt. Each permit holder w111 be notified 60 daysprior to the date set for such proof. In order for the proof to be valid, it must be
received by the Department on or before that date. Proof is made upon a form whichis available fron the Departnent. It is very important that you complete this forur
completely and accurately, The information that you give on the form will enable
the DePartment to make a field examination which is necessary before the license can
be issued. The informatlon you enter on the proof form should be an indicatlon of
the actual development of your project. This developrnent Eust also correspond tothat described by the permit. If it does not and changes in your project have been
made, you shoul-d apply to anend your permit to include the actual developnent. Ap-pllcation for aEendoent forms are avallable from the Department on request.
WHAT TO DO IN CASE YOU HAVE NOT COMPLETED THE APPLICATIO N OF WATER TO BENEFICIAL USE
If you have not been able to complete the application of hrater to beneficial userrithin the time al1"owed, due to reasons beyond your control, you may apply to the
Department for an extenslon of time. Hordever, ln order for an applicatlon for exten-
slon of tlme to be considered, it must be filed prior to the date on which proof ofbeneficlal use 1s due. Each appllE-atlon for ex tEi6i-on of time is considered on its
orm Eerit.
WHAT TO DO IT YOU FAIL TO MAKE PROOF OF BENEFICIAL USE ON TI}tr
If you have appl-ied the rrater to beneficial use, but lrere unable to submit proof ofappllcation of rrater 'to beneficial use on or before the date set for such proof andyour permit has J-apsed, you nay petition the Department within 60 days fron the datethat a notlce of lapsing r4ras sent to you to relnstate your pernit. rn order for theDepartnent to relnstate a permlt, you must show reasonable cause why such permit
should be relnstated. submission of proof of beneficlal use within 60 days willautomatlcally be considered by the Department as cause for reinstatenent. Theprlorlty of all reinstated pernits will be advanced a time equal to the number ofdays that such showing is subsequent to the date set for proof. After 60 days, there
1s no way in which the Departnent can reinstate a permit.
ISSUANCE OF LICENSE
After the Department has completed an examination of your proof and if it appearsthat you have couplied with the tentrs of the permit, the Department will issue awater license. The llcense becomes prirna facia evidence of a rrater right. Thellcense w111 lnclude the maximum rate of diversion, the total annual volume of waterwhlch nay be diverted, the period of the year during which you may use the rrater,the
oature of use to rrhlch you may apply the water, the prlorlty whlch you have estab-lished, and any other conditions of the water right.
INSTRUCTIONS FOR FILING PROOF OF APPLICATION OF WATER TO BENEFICIAL USE

Give the naDe and post office address of the permit holder. If the person mak-
ing proof is other than that person who originally applied for the permit, that
person must ej.ther be an elected official of the coupany, a general partner of
a partnership, must have been asslgned the permit from the original orrner, or
must have a valid power of attorney from the permit holder on file \rith the De-
partment of Water Adnlnlstratlon.
Glve the ntrmber of the permit upon which you are naking proof.
Glve the date of priority r^rhlch you wlsh to establish, That priorlty normally
ls the date upon rrhich the Department received the application, Thls can be
found on the top llne of the back page of the permit.
Descrlbe the soutce from which you have appropriated the water by giving the
name and locstlon of the polnt of diversion as described by 4oacre subdivisions
of the Federal Land Survey.
Describe the amount of water in cubic feet per second or acre feet and the use
to which you have appl-led the water, and the perlod during the year whlch you
have been using the water.
5b.Glve the total aoount of water you have appropriated. Thls w111 not necessarily
be the amount shown on the permit, but should be determined accurately by meas-
ur€rneot.
5c, Descrlbe how and by whom the measurement of the amount of water approprlated
was made and give the name of the person making the measur€ment. This person
should be someone who has a recognized abil-ity and the necessary tralnin8 to
make such a measurement.
