THIS AGREEMET{T MADE AND ENTERED into by and between the
City of Meridian, a Municipal corporat i on of the State of Idaho,
hereinafter referred to as "City", and llark Jensen, hereinafter
referred to as "Jensen".
}JHEREAS, the City is the owner of the land described in
Exhibit "A", which by this r eferen ce 'i s incorporated herein as
jf set forth in ful), which has water rights in the Nampa and
l'lerid jan Irrigation Djstrict, which water right is known under
the Assessnent No. 1209A-;
[.IHEREAS, Jensen is the own er or Lessee of the property
described in Exhibit 'B', v{hich is attached hereto and by this
r eferen c e i ncorporated here i n as if set forth 'i n ful l;
IIHEREAS, the City of Meridjan does not use the water it
receives from the Nampa & I'leridian Irrigation District and
wh er eas Jensen is des i rous of purchasing the water suppl i ed to
and available to the land owned by the City; that for the right
to the vtater to the land owned by the City, the City pays an
assessment to the Nampa & Mer i d'i an Irrigation District; that the
assessment for the water for 1990 was the sum of $1,216.84; that
the City also pays jn addition to the water assessment, an
assessment for operation and maintenance of the Narnpa & l'4er jdian
Irrigatjon District, and other annua'l taxes and assessments to
the Nampa & Meridian Irrigation District.

HERETO AS FOLLOWS:
l. That for a term of the irrigation season of 1990, the
City of l,leridian hereby transfers and assigns to Jensen 'i ts
right to rece'i ve the water wh ich would be appl icable to the Iand
that it owns as descri bed in Exhibit uA'.
2. That Jensen shall pay to the City the sum of $644.92,
which represents 531 of the total amount due for the water,
which 53I js arrived at by determining the percentage of
irrigation days I eft in this year, which irrigation days are
agreed to be from Apri 1 15th through 0ctober 15th, which
comprise 184 days and of whjch a 87 days have elapsed on July
11, 1990, whjch is agreed to be the effective date of this
agreement.
3. That in addjtion to the above amounts pajd to the City
of Meridian for the use of the water Jensen shalI also pay all
operation and maintenance assessments and other taxes and
assessments of the Nampa & Meridian Irrigation District that are
due for the year 1990; that such sum shall be paid to the City
of Meridian upon presentation to Jensen of bi)lings for the
amounts due.
4. That this Agreernent shall be effective for the

1990, if not sooner terminated by the turning off of the water

t'leridian Irrigation District, which water right is known under
the Assessment No. 1209A-;

IIHEREAS, the City of Meridian does not use the water it
receives from the Nampa & Meridian Irrigation District and
whereas Jensen .i s des i rous of purchas i ng the water suppl ied to
and ava'i lable to the I and owned by the City; that for the right
to the water to the land owned by the City, the C ity pays an
as sessment to the Nampa & Meridian Irrigatjon District; that the
assessment for the water for 19 90 was the sum of $1,216.84; that

1. That for a term of the irrigation season of 1990' the
City of Meridian h er eby transfers and assigns to Jensen its
right to receive the water which xould be appl icab le to the land
that it owns as descr i bed in Exhibit'Au.
2. That Jensen shall pay to the City the sum of 5644.9?,
which represents 53X of the total amount due for the riater,
which 53X is arrived at by determining the percentage of
irrigation days left in this year, which irrigation days are
agreed to be from Apri'l 15th through 0ctober 15th, which
comprise 184 days and of which a 87 days have elapsed on July
11, 1990, which is agreed to be the effect i ve date of this
agreement.
3. That in addition to the above amounts paid to the City
of Meridian for the use of the water Jensen shalI also pay al1
operation and majntenance assessments and other taxes and
assessments of the Nampa & l'1erid jan Irrigation Djstrict that are
due for the year 1990; that such sum shall be paid to the City
of lrlerid jan upon presentation to Jensen of billings for the
amounts due.

THIS AGREEMENT MADE AND ENTERED into by and betbreen the City
of Meridian, a Municipal corporat ion of the State of Idaho,
hereinafter referred to as "City"t and Mark Jensenr hereinafter
referred to as "Jensen".
WHEREAS, the City is the owner of the land described in
Exhibit "4", which by this reference rs ineorporated herein as if
set forth in full, which has water rights in the Nampa and
Irleridian Irrigation District, whrch watel^ right is known under
the Assessrent No. 1eOgA- i
IJHEREAS, Jensen is the or.rner or Lessee of the property
descrrbed in Exhibit "8", r.rhich is attached hereto and by this
reference ineorporated herein as if set forth in full;
I.IHEREAS, the city of lrleridian does not use the water lt
receives froa the Na.pa & meridian Irrigation District and
)rhereas Jensen is desirous of purchasing the water supplied to
and available to the land owned by the City; that for the right
to the brater to the land owned by the City, the City pays an
as5essrent to the Narpa & meridian Irrigation Districti that the
assess.ent for the water for 1991 y,ras the su. of tlr378.6Oi that
the City also pays in addition to the water assessient, an
assessrent for operat ion and naintenance of the Naopa & lrlerldian
Irrigation District! and other annual taxes and assessrents to
the Na.pa & Meridian Irrigation District.

HERETO AS FOLLOWS:
1. That for a terr of the irrigation season of 1991r the
Eity of Meridian hereby transfers and assigns to Jensen its right
to receive the nater which would be applicable to the land that
it owns as describecl in Exhibit "4".
?. That Jengen shall pay to the Clty the su. of 11,37A.6@
which represents lOOr( of the total a.ount due for the water.
3. That in addition to the above arounts paid to the City
of meridian for the use of the water Jensen shall also pay all
operation and .aintenance asses5aents and other taxes and
asses5rents of the Naipa & Meridian Irrigation District that are
due for the year l99li that such sum shall be paid to the City of
,{eridi,an upon presentation to Jensen of billings for the amounts
due.
4. That this Agreerent shall be effective for the
irrigation season of 1991, and shall terninate on Novenber 1,
1991, if not sooner teroinated by the turning off of the r.rat er by
Narpa & Meridian Irrigation District.
5. That this Agree.ent is binding upon the heirs and
executors, and the adiinistrators of the parties hereto.
5. That in the event suit or enforcenent proceedinBs are
necessary by either party to enforce this Agreerent, the
prevailing party shall be entitled to its costs and attorney
fees.

THIS AGREEI,'l EtlT l'{ADE AND EtITERED into by and between the
City of Meridian, a Mun'i cipal corporat i on of the State of Idaho,
hereinafter referred to as "City", and |lark Jen sen, herejnafter
referred to as "Jensen".
IIHEREAS, the City is the owner of the I and described in
Exhibit "A", which by this reference is incorporated herej n as
if set forth in full, which has water rights in the Nampa and
Meridian Irrigation District, which b,ater right is k nown under
the Assessment No. 1209A-;
l,lHEREAS, Jensen is the owner or Lessee of the property
described in Exhibit "B", which is attached hereto and by th'i s
reference i ncorporated herein as if set forth in ful1;
liHEREAS, the City of Meridian does not use the trater it
receives from the Nampa & Meridian Irrigation District and
whereas Jensen 'i s des i rous of purchas ing the water suppl ied to
and available to the I and owned by the City; that for the right
to the v{ater to the land owned by the City' the City pays an
assessment to the Nampa & Meridian Irrigation Distri ct; that the

the City also pays in addition to the lvater assessment' an
assessment for operat j on and maintenance of the Narnpa & Meridian
Irrigation District, and other annual t axes and assessments to

of l'leridian upon presentation to Jensen of billings for the

4. That this Agreement shall be effective for the

1. We must oxidize and disinfect the \,rater to meet

The golf course irrigation well- is exempt under these
guidelines.
4. lle cannot apply the rvater within 300 ft. of any house.
This may be dropped to 100 ft. if the fecal average
can be lor.vered lo 2.2 org./100 rn1 . Further treatment
rvould be required to achieve this.
5 . l{e cannot apply the rvater r,,rithin 50 f t. of any public
access.
6. The application site must be fenced.. A pasture type
fence fulfilLs this criteria.
At the present t j-r'ne, 1t appears that watering the
r,rith trasteuater efiluent is not a viable option.
