HUI]UAL FIRE AND DISASTER PROTECTION
AND ASSISTANCE AGREEMENT

PROTECTION DISTRIC?, WHITNEY FIRE PROTECTION DISTRICT, THE
CITY OF MERIDIAN AND THE }4ERIDIAN FIRE PROTECTION DISTRICT,
EAGLE FIRE PROTECTION DISTRICT, STAR FIRE PROTECTION DISTRICT,
KUNA FIRE PROTECTION DISTRICT, AND DESER1 EAST FIRE PROTECTION
DI STRICT.
VI I T N E S S E T H:
WHEREAS, it is possible that a fire and/or disaster
could occur lrithin the boundaries of any of the Parties
hereto which would be of such magnitude that it rrould !e-
quire more men anil/or equipment than an individual- party
could provide; and
WHEREAS, the parties hereto have determined that
it is in the best interests of each of the parties and the
citizens wbom they serve to provide for additional men and
eguipment in the event of a fire and/or disaster which
requires more men and,/or equipmen! than an individual party
hereto could provide; and
WHEREAS, each of the partj.es heleto believe that
they can provide for such events by a cooperative agreement
for fire ahd/or disaster protection bet\reen the parties
hereto; and
I^]HEREAS, Ada County has adopted an EJnergency
operations Plan, vhich covers major disasters incLudj,ng
nuclear, natural and manmade and the Civil Defense Office is
charged r.,ith implementing that plan, or which thj.s Agleernent
sha1l becorne part;
NOri, THER-EFORE, the Parties agree as foLlo'",s:
L.
DEFINITIONS:
A. RESPONDING PARTY3 Any party to this Agreement
anothe! party to this Agreement tourho has been requested by

terms of this Agreement '
B. REQUES1 ING PARTY:Any party Co this Agreement
who suffers a fire and,/or disaste! within the boundaries of
its district or corporate politi,cal limits, and such fire
and/or disaster requires more equiphent and,/or nanpo'rer than
the said parEy can provide j.cself; and saj.d Party requests
of another party to thj.s Agreernent to fulnj"sh, Ioan and
dispaLch eguipment and personnel to aid said party.
II.
Llhenever a party to this Agreement suffers a fi)ae
and,/or disaster requiring more equipment and manpower than
the suffering party can itself provide, each of the other
parties to this Agreement, at the request of the party so
suffering, agrees to furnj.sh, Ioan and dispatch to the aid
of the Requesting Party such equipment and personnel as the
Chief of the Responding Fire Department, or his designee,
shall determine may be so furnished. In no event shafl any
liabitj.ty be imposed upon or attach to a Responding Party
fo! failure to fulnish any equipment o! pelsonnel. the
determination of the chief of the Responding Party, or his
designee, as to uhether any o! how much equipnent or personne]
will be furnished bej-ng f j-nal and conclusive fo! all. purposes.
III.
The Responding Party, if it determines to furnish
equj.pment and personnel, shaIl deliver its equipment and
personnef to the Iocation specj.fi.ed by the Requesting Party.

The Requestj.ng Palty shall first calL the party
nearest the fire and/or disaste!, unless the speciaL equip-
ment or manpovrer of a more distant party j,s required.
The Responding Party shall repolt to the pelson
desi.gnated by the Requesting Party. The Cornmanding Officer

of the Requesting Party shall assume fu1I resPonsibility for
the direction, supetvision, and deployment of aII equiPment
and personnel. dealing with the fire and/or dj.saste!, and for
the nanner in rnhich the file and/or disaster is to be
controlled or suppressed. In no case sha1l the Responding
Party be required to assume ovelal1 responsibility for or
direct the efforts to control or deal lrith the fire and/or
disaster. The Requesting Party shalI hold each Responding
Party harmless frorn and agaj.nst, and indemnify each such
Responding Party for any loss ot risk of liability to third
parti.es .includj.ng costs and reasonable attorneys fees arising
out of or in any way connected. with the exercise or faiLure
to exercise the responsibilj-ties herein imposed upon the
Requesting Palty.

AII equipment, personnel and manpouer loaned under
the terms of this Agreement shall be leturned to the Res-
ponding Party upon release by the Requesting Party or upon
demand by the Responding Party for the return of its equipment
and personnel. The Requesting Party shafl be responsible
for the replacement of any special fire extinguishing agents
used by a Responding ParLy.

The parties heleto futthe! aglee to schedule and
conduct continuinq training proglams for all personnel so
that procedures and technj.ques for dealing with fires and/o!
di-sastels can be s tandardized.
AGREEHENT l

Each of the Parties hereto shall at aII times be
sol.ely responsibte to its oun emPloyees for the Payment of
!{ages and other compensation and for workmanrs compensation
coverage. Each party shall be responsible for its ot^In
equipment and personnel and shal1 bear the risk of any loss
or damage to its equiprnent or injury to its personnel occurr-
ing as a result of ehe operation and use of said equipment
or pelsonnel under anq in accordance with the terms of this
Agreement.

Except as otherwise herein specified, the Requesc-
ing Party shal.I not be liable for any compensatlon to any
Responding Party for the foan of'personnel or equipment
under the terns of this Agreement,
XII.
Time is of the essence and the part.ies hereto
agree to take aIl necessary action to empower their personnel
,rith the authority to dispalch equipment and personnel as
prov i.ded in lhrs Agreement.
XIII.
This Agreement shall become effective upon the
execution hereof by aII of the parties hereto. Any of the
palties hereto may i,rithdrav,, from thj.s Agreement at any tine.
If any parcy determines, for any leason, to withdlaw from
this Agreement, withdrawal sha11 be effective upon servj.ce
of ,rri.tten noti.ce to all other parties.

Should any term or provision of this Agreement, or
the appli.cation thereof to any persons, parties or circurn-
stances, for any reason be illega} or invalid, such illegality
or invalidity shaII not affect arly other provision of this
Agreement and this Agreement shalL be const.rued anal enfolced
as if such il]eqal or inval.ld provision had not been contained
herein.
