WHEREAS, an Agreement with Addendum between Owner and Pete

has taken any action relating Eo said notice, and
WHEREAS, Owner elects to terminaEe said contract and addendum
wiEh Pete Cope Drilling Company pursuant to paragraph 23, and
have said contract performed

Owner agrees to pay Second ConEractor pursllant to the
contracE and the work change order, and furEher, that in the
event any party should instirute legal proceedings relating to
any work or materials furnished or other circumstances which
occurred prior to l4ay 2, 1973, and should Second ConEractor be
named in said action, the Owner agrees to defend said Second
contractor.
Further, Second Contractor agrees to furnish a performance
and paymenE bond in a standard form issued by a surety company
authorized to do business in Idaho, in the sum of $25,000.00.
The parties further agree thaL Work Change Order No. 1 is
not in effect,
