THIS INDENTURE, made and entered into this ��ay of Dec-
ember, 1955 , by and between HENRY NOTEBOONI and NELLIE NOTEBOOM,
husband and wife , of Ada County, Idaho, as grantors , and the
CITY OF MERIDIAN, Ada County, Idaho, a municipal corporation, as
grantee , WITNESSETH :
WHEREAS , the said grantors are the owners in fee simple of
a parcel of land, particularly described as follows :
A strip of land 30 feet wide , being the East 30 feet
of the SW4 of Section 1 , T. 3N. , R 1W, Boise Meridian,
in Ada County , State of Idaho.
AND WHEkiEAS , the grantee herein desires to construct a road-
way along said parcel of land for the purpose of ingress and
egress to and from the sewage treatment plant of the grantee sit-
uated on the E2 of the NE4 of the NEI of the SW4 , Sec. 1, T 3N,
H 1W, B.It�. , yda County, Idaho;
NOW THEREFORE, in consideration of the sum of one dollar
( -1.00) lawful money of the United States and other good and val-
uable consideration in hand paid, the receipt for which is hereby
acknowledged, the undersigned, Henry Noteboom and Nellie Noteboom
husband and wife , do hereby give and grant to the City of Nierid-
ian, its successors and assigns , the right to construct and
maintain a roadway along the land first above described, for the
purpose of ingress and egress to and from said sewage treatment
plant by the said City and its agents, for all purposes connected
with tries easement .
The grantee shall at all times have full_ and free access to
the said property for any Necessary purpose connected with the
use , operation, contraction, repair and maintenance of said road-
way, and shallnave full and free access at all times through its
agents , servants and employees , to and across the above describ-
ed lands of the grantors for all purposes connected with this
easement.

use, but shall be limited to the use of the said City and its
agents for the purposes aforesaid , and if any time said roadway
shall cease to be used for the purposes herein contained then
said land shall revert to the grantors and their successors and
assigns.
Tnis easement and the consideration paid thereunder are
agreed by the undersigned grantors to oe in full settlement of
all damages which in any way or manner may be sustained by reas-
on of the construction, maintenance , repair, use and occupancy
of the said roadway through and across the land first above des-
cribed of the grantors , except as herein specifically stated.

Meridian, Ada County, Idaho, a municipal corporation, herein
called Grantee, WITNESSETH :
VIEREAS , the parties heretofore entered into an option agre -
ment under the terms of which grantee was given the option to
purchase certain land of grantors upon which to construct a sewV,-_,
age treatment plant , and grantee has exercised said option, an

WHEREAS , the parties desire by this agreement to incopora-�"It,
to herein all their legal relations relative to said option; ,
NOW THEREFOR, in consideration of the covenants herein coi �- • ,
tained the parties hereto agree as follows:
1 . Grantors hereby sell to grantee the following described
property for the purpose of grantee constructing a sewage treat-
nt plant thereon:
The E21 of the NE4 of the NEI of the SW4, Section 1,
T. 3 N• , R. 1W, Boise , Meridian, in Ada County, Idaho ,
subject to United States Bureau of Reclamation
drainage right-of-way.
2. Grantee agrees to pay grantors therefor in the follow-
ing manner: �1,3(76.00 cash on the execution of this agreement,
the receipt for which is her, acknowledged; and the balance
ther:of or tho sum of w3 ,1'2�;00, ii�tarest ii=ee , payable on de-
mand icy grantors at any tic;te' and in such amounts as demanded by
grantors , provided however that final payment shall be made not
L 4 later than J _years from the date of this agreement.
3. Grantors will forthwith execute and deliver their r --wa r
1 n anty deed to grantee covering said property, and will also forth
/o with furnish grantee a title insurance policy showing good and
marketable title in grantors free and clear of all encumbrances.
LI•. As part of the consideration for this agreement grantor
will promptly execute and deliver to grantee a right of way
easement for road purposes to and from said sewage treatment
plant across the following described property:
A strip of land 30 feet wide , being the East 30 feet
of the S1,1 of Section 1 , rI'. 3N. , R 1W, Boise Meridian,
in Ada County, State of Idaho.
Qr 5 As part of the consideration for this agreement it is
agre that the grantee will , at its oi�m_ expense , connect the
residence of grant;ox-5 , situated -to the west of said roadway,
With r sewer line running north and south along said roadway.
As part of the consideration for this agreement it is
agr e that the city will lay the connecting line to grantors ?
residence free of charge , and that grantee will not charge grant-
ors the customary hook-up charge , but that the plumbing work
shall be at tale expense of grantors .

7. As further consideration for this agreement it is agreed
that grantee will , at its own expense, construct an access road-
way from the roadig easement described in paragraph 4 above in
a westerly direction to a point near grantors ' residence on the
south side thereof. The location of said roadway shall be desig-
nated by grantors to be on their own land, and after construction
thereof grantee shall have no interest therein.
This agreement shall be binding on the heirs , assigns and
legal representatives of the parties hereto.

acknowledged, the undersigned, Henry Noteboom and Ne11ie Noteboon
husband and wife, do hereby give and grant to the City of Merld-
ian, its successors and assigns, the right to construct and
maintain a roadway along the land first above described, for the
purpose of ingress and egress to and fron said sewage treatment
plant by the said City and its agents, for all purposes connected
with this easemerrt.
The grantee shall at all times have full and free access to
the said property for any necessary purpose connected with the
use, operation, contruction, repair and maintenance of said road-
way, and shallhave full and free access at all times through its
agents, servants and employees, to and across the above describ-
ed lands of the grantors for all purposes connected with this
easement.
This is not a dedlcation of said land to the general public
