RE: Bainbridge Subdivision No. 10 – Alternative Compliance (A-2020-0222)
Dear Mr. Nauahi:
This letter is to confirm the Director approved your request for alternative compliance to Unified
Development Code (UDC) 11-3B-7C.2c, which requires fencing to be placed on the interior edge of the
street buffer.
The fence is located within the street buffer because two (2) separate ACHD storm drainage easements
exist in this area for the subdivision and for N. Ten Mile Rd. that prohibit trees within the easements.
There is a 5-foot wide (+/-) strip between the two easements and behind the fence where trees are planted
to satisfy the street buffer landscape requirements in UDC 11-3B-7C.3. The location of the fence within
the buffer will allow adequate area between the fence and the trees for trees to grow. A license agreement
exists with ACHD to allow the fence in the clear zone of the storm drainage easement along Ten Mile Rd.
The Director’s decision is based on the Findings listed in UDC 11-5B-5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
The Director finds strict adherence to the requirement in UDC 11-3B-7C.2c for placement of
fencing on the interior edge of the street buffer while feasible, would result in no trees within
the street buffer as there isn’t sufficient area in the 5-foot wide strip between the two
easements for placement of trees and a fence.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and

for meeting the requirements and allows for provision of the required trees within the street
buffer.
3. The alternative means will not be materially detrimental to the public welfare or impair the
intended uses and character of surrounding properties.

The location of the fence closer to the street will actually provide a larger, more usable common area behind the fence buffered from Ten Mile Rd. The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before January 6, 2021, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a final
decision on a land use application. You have the right to request a regulatory taking analysis under Idaho
Code 67-8003.
