RE: Bainbridge Subdivision No. 10 – Alternative Compliance
Dear Caleb,
Per UDC 11-3B-7C.2c. there is a required 35’ wide street buffer along Ten Mile Rd. The project qualifies for
alternative compliance under conditions UDC 11-5B-5B-2(b) and (c). “The site involves space limitations or
an unusually shaped lot” and “Other regulatory agencies or departments having jurisdiction are requiring
design standards that conflict with the requirements of this article.”
On the attached exhibit, the highlighted red portion depicts a subsurface ACHD seepage bed. The darker red
portion of the highlight, represents the actual seepage bed. The lighter portion represents the 10’ clear zone
of the seepage bed. The blue portion represents the 10’ clear zone of the seepage bed associated with Ten
Mile Rd.
ACHD design standards does not allow for trees nor permanent structures (ie fences) to be installed in the
clear zone or seepage bed.
This leaves an approximately 5’ strip between the two seepage beds and their clear zones. The trees were
planted in this strip, as required by the staff report condition 5A. To allow for tree growth, it was determined
that the fence was to be installed approximately 12’ away. Due to “space limitations” and “other regulatory
agencies having jurisdiction”, we were unable to install the fence posts in the seepage bed itself, so we opted
to install the fence in the clear zone to the east of the trees, with a license agreement from ACHD.
This changes the distance from back of curb to fence to approximately 19’. However, there is continuance of
the landscaping for approximately 47’ behind the fence.
Therefore, we request your approval of the alternative compliance.
