From: Josh Wilson, Associate City Planner CC: Anna Canning; Craig Slocum, CSWQA; file Date: October 20, 2005 Re: Farmers and Merchants CUP Modification (CUP-05-030) At the October 11, 2005 City Council hearing, Craig Slocum, representing Farmers and Merchants State Bank, requested reconsideration by Council of CUP-05-030. The question was then raised whether the application needed to be remanded back to the Planning and Zoning Commission for reconsideration or whether the reconsideration could be by the City Council. This memo addresses how the application was noticed to the public and haw the application was considered at the Planning and Zoning Commission hearing. The public notice for the hearing was worded as follows: "Request for a Conditional Use Permit to modify the Conditions of Approval for CUP-03-050, in order to allow the existing building at 703 North Main Street to remain and to allow a public use in the O-T zone for Farmers and Merchants State Bank, by Farmers and Merchants State Bank - 703 North Main Street." The public notice implies that retention of the existing building will be permanent. The staff report far the Planning and Zoning Commission hearing on September 1, 2005 did not evaluate the request to keep the existing building as temporary, and the conditions of approval and findings were written under the impression that the request was to allow the building to permanently remain. Staff presented the application at the Planning and Zoning Commission hearing as a request to permanently retain the building, and the Commission placed Conditions of approval on the application accordingly.
