The applicant, Pinnacle Engineers, Tnc., submitted a variance request for a time extension to ale the
final plat for Schwenkfelder Tire Subdivision with the Ada County Recorder's office. The final plat
for this subdivision was approved by City Council on December 18, 2001. A time extension was
granted on January 7, 2003 and expired on January 7, 2004. On January 27, 2004, a variance for a
time extension was granted for 6 months which expired on July 27, 2004. The applicant submitted a
third time extension request that was scheduled for the October 18`"' meeting. Upon review of the
variance request by staff and the City Attorney, we determined that the applicant is not eligible to
apply for another time extension on a plat that has been expired for over a year. Staff has requested
that the Finance Department refund the applicant's fees.
