We have reviewed the above referenced submittals and offer the following comments, as
conditions of approval. These conditions shall be considered in full, unless expressly modified
or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant, the City of Meridian, has applied for the annexation, and zoning of a 1-acre parcel
of ground on the west side of Locust Grove, approximately 1,500 feet north of the Ustick and
Locust Grove intersection. The City of Meridian and the Meridian Fire Department intend to use
the land for the construction of a new Fire Department substation. The substation will be a
permitted use in the requested L-O zoning designation.
LOCATION
Thc property is located on the west side of Locust Grove, approximately 1,500 ft. north of Ustick
Road.
SURROUNDING PROPERTIES
North: Rural residemial, zoned RUT (County). The proposed Heritage Commons Subdivision is
located to the northwest of subject property.
South: Rural residential, zoned RUT (County).
East: Summerfield Subdivision, zoned R-4.
West: Rural residential, zoned RUT (County).
ANNEXATION & ZONING ANALYSIS
According to Ordinance 11-15-11, General Standards Applicable to Zoning Amendments, both
the P&Z Commission and Council are required "to review the particular facts and circumstances
of each proposed zoning amendment in terms of the following standards and shall fred adequate
evidence answering the following questions about the proposed zoning amendment."
The following is the list of standards found in 11-15-11 and analysis by staff.'

Will the new zoning be harmonious with and in accordance with the
Comprehensive Plan and, if not, has there been an application for a
Comprehensive Plan amendment;
Staff finds that the requested zoning designation, L-O, is harmonious with and in
accordance with the adopted Comprehensive Plan and Generalized Land Use Map
if it is used by the Fire Department as a Substation. The subject property is
currently depicted on the 1993 Generalized Land Use Map as "Single Family
Residential".
Has there been a change in the area or adjacent areas which may dictate that
the area should be rezoned. For example, have the streets been widened, new
railroad access been developed or planned or adjacent area being developed
in a fashion similar to the proposed rezone area;
Surrounding properties include rural residential properties and residential
subdivisions. New development projects have been proposed in the area,
including the aforementioned mixed use Heritage Commons Subdivision, which
will place more demand on existing emergency services. Staff finds that the
requested zoning designation of L-O for a fire substation will be harmonious with
the existing and future developments.
Will the proposed uses be designed, constructed, operated and maintained to
be harmonious and appropriate in appearance with the existing or intended
character of the general vicinity and that such use will not change the
essential character of the same area;
Staff finds that the proposed use (Fire Department substation) will not change the
existing or intended residential character of the area.
Will the proposed uses not be hazardous or disturbing to existing or future
neighboring uses;
The Commission and Council should rely on public testimony to determine
whether or not the proposed use will be disturbing or hazardous to the existing or
future neighboring uses.
Staff does not anticipate that the proposed uses will be hazardous or disturbing to
future or existing neighbors.
Will the area be served adequately by essential public facilities and services
such as highways, streets, police and fire protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the
establishment of proposed zoning amendment shall be able to provide
adequately any of such services;

Staff finds that the property to be annexed will be served adequately by all
essential public facilities and services.
Will not create excessive additional requirements at public cost for public
facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that there will not be excessive additional requirements at public cost
and that the annexation and zoning will not be detrimental to the community's
economic welfare.
Will the proposed uses not involve uses, activities, processes, materials,
equipment and conditions of operation that will be detrimental to any
persons, property or the general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors;
Staff finds that the proposed substation will not create excessive traffic, noise or
other nuisances that would be detrimental to the general welfare of the
surrounding area.
Lights and sirens may be of concern to neighbors; however, staff does not
consider the use of safety equipment such as lights and sirens, as a justifiable
reason to deny the annexation of land to be used as a fire substation.
Will the area have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public
streets;
Staff finds that the subdivision of the property will not create significant
interference with the existing traffic on Locust Grove.
Will not result in the destruction, loss or damage of a natural or scenic
feature of major importance; and
Staff finds that no natural or scenic features of major importance will be lost or
damaged by approving the annexation and re-zone. Any existing trees larger than
4" caliper that are removed shall be mitigated for, per the Landscape Ordinance.
Is the proposed zoning amendment in the best interest of the City of
Meridian. (Ord. 592, 11-17-1992)"

ANEXATION AND ZONING COMMENTS
The legal description submitted with the application appears to meet the requirements of the
City of Meridian and State Tax Commission and places the parcel contiguous to existing city
limits
2. The requested zoning of L-O is compatible with City Comprehensive Plan.
3. The subject property is within the Urban Service Planning Area. Essential City services are
or will be available to the subject property.
Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service, per City Ordinance Section 5-7-517, when services are
available from the City of Meridian. Wells may be used for non-domestic purposes such as
landscape irrigation.
Future development of this property as a Fire Department Substation shall be in compliance
with City of Meridian development ordinances in place at the time of development. The
property shall be restricted for only public use and be subject to conditional use if a fire
substation is not constructed at this location.
RECOMMENDATION
Staff recommends approval of the proposed annexation and rezone of the property for use as a
Fire Department Substation.

Roadway Improvements Adjacent To and Near the Site
There is approximately 70-feet of right of way for Locust Grove Road abutting the site. Locust Grove
Road is improved with 2 lanes of traffic with no center tum lane. There is no curb, gutter or sidewalk
adjacent to this site, however there is a sidewalk on the east side of Locust Grove Road directly across
from the site.

Existing Right-of-Way
Locust Grove Road is the only public read abutting this parcel. Locust Grove Road has approximately 70-
feet of right-of-way (25-feet from centerline) abutting this parcel.
Existing Access to the Site
There is an existing driveway into the site serving the single-family residence. The driveway is located
approximately 25-feet north of the south property line.
8. Five Year Work Program
There are not any streets or intersections in this area that are currently in the Five Year Work Program.
Other Development in Area/Miscellaneous
In April of 2001, ACHD staff retained the services of Washington Group International to conduct a six-
square mile traffic study of the northwestern Meridian area from Ustick Road to Chinden Boulevard, and
from Meridian Road to one-half mile west of Black Cat Road. The study revealed that the traffic
capacities of the surrounding roadways (Ustick Road, McMillan Road, Ten Mile Road, Locust Grove
Road and Linder Road) with the proposed developments is expected to push the roadways to their 2020
planning thresholds upon build-out of the projects.
After completion of the original study, and after meeting with representatives of the Meridian City Council,
Ada County Commissioners, ACHD Commissioners, and COMPASS, the study was expanded to a 12-
mile area from Eagle Road to McDermott Road and Ustick Road to Chinden Boulevard. This has been
deemed the "North Meridian Planning Area". The traffic impact study is nearing completion and details
the need for expanded roadways, signalized intersections, and intersection improvements (see the study
"conclusions" listed below). The next phase of the study, the economic phase, cannot be prepared until
the traffic impact phase is complete, and will focus on the cost of the improvements deemed necessary
by the study, including right-of-way costs. The outcome of the economic study will provide the District
with an estimate of the costs to improve the roadways in the North Meridian Planning Area to handle the
traffic generated by the proposed developments in the area.
Staff anticipates that an extraordinary impact fee or Local Improvement District (LID) will be
implemented/established for the North Meridian Planning Area in order for the roadway system to be
adequately upgraded to handle the traffic generated by the development in this area. This current
project under review may also be subject to any extraordinary fees that the District may impose, Should
an extraordinary fee be imposed in this area, future building permits for this project may also be
subject to the fee, regardless of a development agreement. If the applicant were opposed to such
a fee, that opposition would be testified to at a public hearing to establish such a fee.
B. Findings for Consideration
Right-of-Way
There is currently 70-feet existing right-of-way (25-feet from centerline). District policy (Figure 72-F3) for
a minor arterial classified roadway is 96-feet required right-of-way (48-feet from centerline). This width
allows for the construction of a 5-lane roadway with curb, gutter, 5-foot wide detached sidewalks (7-foot
attached) and bike lanes.
Sidewalk
District policy 7204.7.2 requires 5-foot wide (minimum) concrete sidewalk if located 5-feet or more behind
the curb, or a 7-foot wide (minimum) sidewalk if located adjacent to the curb on all arterial streets.

Access Points
District policy (Figure 72-F4 and Figure 72-F5) requires driveways on arterial roadways to be constructed
220-feet from a signalized intersection for right-in/right-out operations; 440-feet for full access; and 315-
feet for full access if there are no intervening driveways. Policy also requires driveways to be offset a
minimum of 230-feet from any existing or proposed driveways (based on 45 MPH).
Driveways
District policy requires the applicant to pave the driveways to their full-required width and to a point 30-
feet beyond the edge of pavement of Locust Grove Road with 15-foot curb radii tapers abutting the
existing roadway edge (Figure 72-F9).
Emergency Signal
Due to the nature of the site, it will be necessary to install an emergency signal for the emergency
vehicles to enter onto Locust Grove Road. The District will supply the materials for the emergency
signal. The applicant should construct the emergency signal on Locust Grove Road abutting the site.
The applicant should coordinate the location of the signal with District staff.
C. Site Specific Conditions of Approval
If the rezone is approved and the District receives a development proposal, the District intends to
provide the following requirements, in addition to any additional requirements that may apply upon
District review of future development, to the City of Meridian:
Dedicate 48-feet of right-of-way from the centerline of Locust Grove Road abutting the parcel by
means of a warranty deed. The right-of-way pumhase and sale agreement and deed must be
completed and signed by the applicant prior to scheduling the final plat for signature by the ACriD
Commission or prior to issuance of a building permit (or other required permits), whichever occurs
first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested
material. The owner will be paid the fair market value of the right-of-way dedicated which is an
addition to existing ACriD right-of-way if the owner submits a letter of application to the impact fee
administrator prior to breaking ground, in accordance with ACriD Ordinance #195.
Construct a 5-foot wide concrete sidewalk on Locust Grove Road located 2-feet within the right-of-
way. Coordinate the location and elevation of the sidewalk with District staff.
As required by District policy, restrictions on the width, number and locations of driveways, shall be
placed on future development of this parcel.
Pave all driveway(s) to their full-required width and to a point 30-feet beyond the edge of pavement of
Locust Grove Road with 15-foot pavement tapers abutting the existing roadway edge.
5. Comply with all Standard Conditions of Approval.

1. Any existing irrigation facilities shall be relocated outside of the right-of-way.

All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
Replace any existing damage curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.
All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
Construction, use and property development shall be in conformance with all applicable requirements
of the Ada County Highway District prior to District approval for occupancy.
Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance.
It is the responsibility of the applicant to verify all existing utilities within the right-of-way. Existing
utilities damaged by the applicant shall be repaired by the applicant at no cost to ACriD. The
applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to
breaking ground within ACriD right-of-way. The applicant shall contact ACriD Traffic Operations 387-
6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of
construction.
No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
Conclusions of Law
If the proposed rezone/annexation is approved and the District receives a development proposal, the
District intends to provide the previous requirements, in addition to any additional requirements that
may apply upon District review of future development, to the City of Meridian.
ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

APPEAL GUIDELINES
Request for Appeal of Staff Decision
Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROVVDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
being appealed, identify the appellant by name, address and telephone number and state

of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
wdtten argument in support of the appeal. The Commission shall not consider a notice of

Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply, and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.

Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.

Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at
the hearing.

The ~following will be the requirements and/or concerns to provide mimmum levels of fire protection for
the proposed project:
I. : That a fire-flow consistent with Appendix III-A of the Uniform Fire Code be provided to service
the entire project. Fire hydrants shall be placed an average of 400' apart. 1997 UFC Appendix III-A
2. ~ Operational fire hydrants are required before combustible construction begins.
UFC 901.4.2 & 901.3
3;: Acceptance of the water supply for fire protection will be by the Meridian
Water Deparlment.
4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department.
5. All radii shall be 28' inside and 48' outside radius.
