AP-05-001 ORDER APPROVING AN APPEAL FOR THE DENIAL OF A FENCE WAIVER This matter coming before the Planning and Zoning Commission for Appeal approval pursuant to Meridian City Code § 11-1-11.A for an appeal for the denial of a fence waiver application for Justin Martin, Hearing Date: September 1, 2005 to the Planning and Zoning Commission, the Commission takes the following action: IT IS HEREBY ORDERED THAT: 1. The appeal by Justin Martin of the decision of the Planning Director is granted in part subject to the following comments of the Commission: 2. Hearing Date: September 1,2005. ORDER APPROVING AN APPEAL FOR THE DENIAL OF A FENCE WAIVER FOR JUSTIN MARTIN (AP-OS-OOI) Page 1 of 3 3. The face of the fence shall be set a minimum of 1 0 feet from the property line along N. Ten Mile Road with a 45 degree chamfer at the side property lined to bring the fence back to 20 feet at such lines. 4. You must landscape and maintain the ground area between the fence and sidewalk. 5. If applicable, the board side of the fence shall face out toward the street( s). 6. You must also obtain a building permit for your fence from the City of Meridian Building Department prior to construction. You must also call for an inspection of the fence once you have completed construction, and by this reference incorporated herein. NOTICE OF FINAL ACTION Please take notice that this is a final action of the governing body of the City of Meridian, pursuant to Idaho Code § 67-6521. An affected person being a person who has an interest in real property which may be adversely affected by this decision may, within twenty-eight (28) days after the date ofthis decision and order, seek a judicial review as provided by Chapter 52, Title 67, Idaho Code.
