Further, we request reconsideration of the Council's decision regarding CUP-03-040 (incorrectly listed as CUP-05-040). The applicant was directed by planning stafftbat their presence at the Planníng and Zoning public hearing and the City Council public hearing was not necessary as the proposed modification to CUP 03-050 was initiated for the sale purposed of modifying the single condition that the existing Fanners & Merchants building be demolished and a. pedestrian pJazs' be constructed in its place. The applicant was not infonned that modify1ng this condition would allow additional conditioru; to be placed on the project. Thus, the applicant has not had the opportunity to address the additional conditions proposed to be imposed. Specifically, Fanners & Merchants takes exception to Condition 1.5. Had Fanners & Merchants proceeded with the project as approved, they would not be required to enter into a cross access agreement with Washington Federa1. The requirement to enter into this agreement would place an unnecessary encumbrance on the property, potentially affecting the value of the property. Additionally, the applicant has COllcems regarding safe traffic movements if this condition is imposed. Additionally, Fanners & Merchants takes exception with CondWon 1.6. Had Fanners & Merchants proceeded with the project as approved, they would have demoHshed the existing buiJding and constructed the pedestrian plaza at an already established cost. This condition leaves the possibility open that Farmers & Merchants will be required to demolish dle existing building and construct the pedestrian plaza at an unknown time in the future, at a substantially increased cost. We \Tust that the Council will find the previously described items of substantial reason to reconsider their decision regarding this item.
