AZ-05-015, PP-05-017, CUP-05-022 Dear Mayor and Council: We have reviewed the Staff Summary of Planning & Zoning Commission Recommendation to the City Council for the hearing date of October 4, 2005, and have the following responses: SITE SPECIFIC CONDITIONS - PRELIMINARY PLAT 1. Please note that the revision date for the preliminary plat is 9/12/05. 2. Please note that the requested change is included on the revised plat dated 9/12/05. 3. The applicant will comply. 4. Central District Health Department is an independent agency (not a division of the Idaho Department of Health and Welfare). The responsibility for insuring that the main floor of buildings and structures are a minimum of one foot above the flood elevation and that the foundations of all structures are designed and constructed to withstand flood conditions at the site lies with the builders of the individual structures. All building permit applications will need to be approved by the City's building inspectors. The applicant's engineer cannot provide a certification prior to signature on the final plat that all structures meet these requirements, as there will not be any buildings on the property prior to recordation of the final plat. We respectfully request that the last sentence of this item be deleted. 5. The applicant will comply. The applicant will submit a LOMR or provide certification that the required base floor elevation being constructed is one foot above flood elevation. This subdivision is not appropriate for basements. No basements should be allowed within the development. Consulting with my civil engineer, she believes this requirement is not necessary. When we design the subdivision, we have to meet a three-foot separation from groundwater to finished centerline of the roadway. When utilizing the drainage swales, we have to have a three-foot separation from the bottom of the swale to groundwater which equates to a 4.7-foot separation from the centerline of roadway. The conditions of this site are not unusual; we have encountered these conditions in other projects and take great care to design the project to meet or exceed the requirements of all applicable agencies. For these reasons, we respectfully request that a Master Grading and Drainage Plan not be required. The applicant proposed a 14-foot-wide access road along the piped Creason Lateral to provide access to NMID. If the Creason were piped, the access road could be used for NMID access and a multi-use pathway. I spoke with Bill Henson of Nampa-Meridian Irrigation District on July 21, 2005; he indicates that the Creason Lateral is not the South Slough. The South Slough is east of Venable Lane and is referred to as the Finch Lateral. NMID will not allow a multi-use pathway next to a live ditch of this size [requiring 48" reinforced concrete pipe (RCP)]. If the facility is piped, the District will allow a pathway. We respectfully request that the requirement to install a pathway along the Creason Lateral be contingent upon the City of Meridian's ability to enter into a license agreement with NMID to allow such a pathway. He indicated that he did not want the westerly stub street. He believed the number provided previously provided was acceptable (one north of his parcel, one south of his parcel).
