CUPOS-OO4 NM-IIOl-2-11A, NM-llOl-2-11, NM-II03 NY-611-001-00, NY-612-00-00 Boise City Planning: The United States' Ten Mile Feeder Canal lies within the boundary of the above- mentioned location. The easement for this lateral is held in the name of the United States through the Bureau of Reclamation under the authority of the Act of August 30, 1890. (26 Stat. 391; 43 U.S.c. 945) The Boise Project Board of Control is contracted to operate and maintain this canal. We assert this federal easement 35 feet north and 25 feet south of the canal's centerline. Whereas this area is for the operation and maintenance of our facility, no activity should hinder our ability to do so. The Boise Project board of Control has many locations within the Project where our asserted easements overlap property boundaries. It is essential to be able to enter these easements on both sides of our canals, laterals, pipelines and existing facilities. The Boise Project Board of Control will NOT approve the proposed irrigation upon the Project facilities. The seeding of grass other than an approved non-irrigated drought resistant grass by Boise Project will not be acceptable. "Pedestrian and Greenway Easements" will need tQ be relocated and segregated from canal maintenance operations. The Project maintains its facilities with large vehicles and heavy equipment, to include dump trucks, dozers, graders, backhoes and long booms with counter weights. Although our operators possess the highest regard for safety, this machinery offers many blind spots, which limit visibility. Project work easements are barely wide enough for this equipment. The Boise Project Board of Control takes great pride in our community. We support the Ditch Safety Committee and the Otto Otter Program in our school systems in both Ada and Canyon Counties. In the interest of public safety, activities such as bicycling, rollerblading and children playing in general should be protected by a separate green way easement. To insure public safety and prevent encroachments, appropriate fencing must be constructed just off the canal easements. The construction of any road~ay crossings must be conducted only during the non-irrigation season when the lateral is dewatered. In any case no work shall take place within the easement before the proper crossing agreements have been secured through the Bureau of Reclamation and the Boise Project Board of Control. Where there is a request by the landowner to install a bridge on the easement of our facility with rails that restrict passage parallel to the canal Boise Project Board of Control will need an approved alternate route out and around each end of the bridge. This shaH be done by a donated easement from the landowner with an approved width for the operations and maintenance of the Ten Mile Feeder. Utilities, which plan to cross irrigation facilities in order to service this development, must do so only in accordance with the master policies now held between the Bureau of Reclamation and each utility. In any case no work shaH take place within the easement before the proper crossing agreements have been secured through both the Bureau of Reclamation and the Boise Project Board of Control. The request for relocated delivery points for this subdivision and Dartmoore Subdivision appears to be acceptable by the Boise Project Board-of Contr-ol at-~,landowner's expense. The design and construction of new delivery points will have to be approved by Boise Project. The construction (of all appurtenant boxes and/or structures) must be warranted by the landowner for a period of (5) five-years. The Warrantee Agreement must be secured prior to ANY disturbance ofthat facility. Boise Project Board of Control requires that all appurtenant boxes and/or structures be poured in place. The New York and Nampa & Meridian Irrigation District's both service this proposed subdivision, Boise Project will need notification as to how this property will be assessed.
