LOCATION: The site is located on the west side of N.
Black Cat Road, midway between W.
McMillan Road and W. Chinden
Boulevard.
I. PROJECT DESCRIPTION
Six month time extension to obtain the City Engineer’s signature on the final plat.
II. APPLICANT INFORMATION

III. STAFF ANALYSIS
The preliminary plat was originally approved by City Council on November 5, 2014 (PP-14-013),
Phase 2 final plat (H-2016-0134) was approved by City Council on January 24, 2007 , and Phase 3
final plat (H-2018-0113) for this project was approved by City Council on December 4, 2018. The
final plat consists of sixty-two (62) single- family residential building lots, seven (7) multi-family lots
and twelve (12) common lots on 21.64 acres of land in the R-8 and R-15 zoning districts.
The Applicant requests approval of a six (6) month time extension in order to obtain the City
Engineer’s signature on the final plat. Condition number three in the Phase 3 final plat staff report
(under The Planning and Public Works Conditions) required the Developer to obtain the City
Engineer’s signature on the final plat by August 23, 2020. The Applicant is currently ready to submit

the mylar to the City for signature, in the event of a delay in obtaining the City Engineer’s signature
by August 23, 2020, this request for a time extension was submitted.
With all extensions, the Director may require the final plat to comply with the current
provisions of this title. Staff is not recommending any additional conditions of approval for
this extension.
IV. DECISION
Staff:
Staff recommends approval of the proposed six (6) month time extension on the final plat to expire on
February 23, 2021.

VI. CITY/AGENCY COMMENTS & CONDITIONS
A. Planning Division
Site Specific Conditions:
1. Applicant shall comply with all terms of the annexation and associated development
agreement provisions, the preliminary plat (PP-14-013), and the final plat (H-2018-0113)
approved for this property.
2. The applicant shall obtain the City Engineer’s signature on the final plat by February 23,
2021 in accord with UDC 11-6B-7 in order for the final plat to remain valid; or another time
extension may be requested.
