We have reviewed this submittal and offer the following comments. These comments shall be
considered in full, unless expressly modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicants, James & Carrie Jewett, have requested Annexation and Zoning (AZ) approval of
0.56 acres fromR6 (Ada County) to L-O (Limited Office District). The subject property is located on
the northwest comer of Locust Grove Road and Carol Street. Currently, the site is zoned R6 in Ada
County and contains a single- family home and a large shop. The applicant is proposing to retain the
existing structures. The applicant intends to remodel the home into an office and use the shop for
storage related to the office use. The approximate square footage ofthe remodel is 4,000 square feet.
Approval of the subject AZ application would allow the applicant to obtain an office zone.
According to current City Code, professional and sales offices and clinics are principally
permitted in the proposed L-Q zone (MCC-1l-8-1). The applicant has submitted a site plan
and landscape plan of how this site will redevelop with the office building, parking and
landscaping. On the submitted plans, the applicant has depicted one access to Carol Street.
Although this site has frontage on Locust Grove Road, no access is proposed to Locust Grove
Road. The applicant states, in the submittal letter, that the proposed change fits very well with
the surrounding area as there is a Walgreen's to the south, a Fred Meyer to the east and
residential uses to the north and west (see the applicant's submittal letter).
The applicant is requesting an alternative method of compliance for the landscape buffers on
the western and northern sides of the property. MCC 12-13-12 requires a 20-foot wide
landscape buffer between office uses/zones and single-family homes. Due to existing site
conditions, space limitations, and change of use on the property, the applicant is proposing to
construct a 6-foot tall privacy fence and trees and shrubs to buffer the proposed use. The width

of the proposed landscape buffer to the north is 10 feet, and the buffer to the west is 5 feet
wide adjacent to the existing shop and lO-feet wide adjacent to the proposed parking lot. See
Special Considerations below for analysis of the proposed alternative compliance request.
This property is designated for low density residential uses on the Comprehensive Plan Future Land
Use Map. The applicant is not proposing residential zoning for this site. However, the City recently
approved Resolution No. 04-454, which amended Chapter VII, Section 1, of the Comprehensive Plan
to include the following language: "At the discretion of City Council, areas with a Residential
Comprehensive Plan designation may request office uses if the property has :frontage on an arterial
street or a section line road and is 3 acres in size or less in size. In this instance, no ancillary
commercial uses shall be permitted." See Annexation & Zoning Analysis "A" below for detailed
analysis of the requested zone and its relationship to the Comprehensive Plan.
Staff is recommending approval of the subject annexation request to L-O, with a requirement for a
development agreement as outlined in this report.
LOCA TION
The subject site is located on the northwest comer of Locust Grove Road and Carol Street, within
Section 6, Township 3 North, Range 1 East.

North: Single-family residence, zoned R6 (Ada County)
South: Commercial pharmacy with a drive-through, zoned C-G
East: Commercial, zoned C-G
West: Single-family residence, zoned R6 (Ada County)

Richard & Carolyn Haynes are the current property owners and Carolyn Haynes has submitted
notarized consent for James L. Jewett to submit the subject application.
ANNEXATION & ZONING ANALYSIS
According to Ordinance 11-15-11, General Standards Applicable to Zoning Amendments,
both the P&Z Commission and Council are required "to review the particular facts and
circumstances of each proposed zoning amendment in terms of the following standards and
shall Îmd adequate evidence answering the following questions about the proposed zoning
amendment."
The following is the list of standards found in 11-15-11 and analysis by staff:
A.
Will the new zoning be harmonious with and in accordance with the Comprehensive
Plan and, if not, has there been an application for a Comprehensive Plan
amendment;

As noted in the summary above, the 2002 Comprehensive Plan Future Land Use Map
designates the subject property as "Low Density Residential". The purpose of a low density
residential designation is to allow for the development of single- family homes on large lots
where urban services are provided. Uses may include single-family homes at densities of
three dwelling units or less per acre (Page 95, Chapter VII, 2002 Comprehensive Plan).
The City recently approved Resolution No. 04-454, which amended Chapter VII, Section 1,
of the Comprehensive Plan to include the following language: "At the discretion of City
Council, areas with a Residential Comprehensive Plan designation may request office uses if
the property has frontage on an arterial street or a section line road and is 3 acres in size or
less in size. In this instance, no ancillary commercial uses shall be permitted." Staff finds that
the subject property has frontage on Locust Grove Road, an arterial street, and is less than 3
acres in size (0.56 acres total).
Because the property is less than 3-acres in size, is located on an arterial street, and has
existing commercial uses around it, staff believes that a residential use of the property may
not be the best use of the land. Staff believes that an office zone and use on the subject
property is appropriate as the request is consistent with the intent of Resolution No. 04-454.
Please see the following facts and circumstances and the Special Considerations below for
further analysis of the proposed zoning designation and anticipated office use.
Staff finds the following Goals, Objectives, and Action items contained in the 2002
Comprehensive Plan to be applicable to this application (staff analysis is in italics below
policy):

"Restrict curb cuts and access points on collectors and arterial streets." (Chapter VII,
Goal IV, Objective D, Action item 2)
On the submitted plan, the applicant is proposing a single access to Carol Street. No
access to Locust Grove Road, an arterial street, is proposed.

"Require appropriate landscape and buffers along transportation corridors (setback,
vegetation, low walls, berms, etc.)." (Chapter VII, Goal IV, Objective D, Action item
4)
Locust Grove Road is designated as an arterial street. By City Ordinance, a 25-foot
wide landscape buffer is required adjacent to Locust Grove Road (MCC 12-13-10-4).
Landscape buffers will be required by the City with Certificate of Zoning Compliance
(CZC) approval.

"Require all commercial businesses to install and maintain landscaping." (Chapter V,
Goal III, Objective D, Action item 5)
The applicant has shown both internal and perimeter landscaping on the submitted
plans. The applicant is requesting alternative compliance for the required landscape
buffers adjacent to the single-family homes to the north and west. Prior to occupancy
of the buildings on this site for office uses, the applicant will be required to construct
internal and perimeter landscaping in accordance with City Ordinances.
. "Permit new. . . commercial development only where urban services can be
reasonably provided at the time of final approval and development is contiguous to
the City." (Chapter IV, Goal I, Obj. A, #6)
This parcel is contiguous to the city via the Walgreen's site to the south and Fred
Meyer site to the east. Sanitary sewer and water are available to this parcel.

(Chapter VII, Goal 1, Objective B)
StaJfbelieves that the proposed zone, which allows office uses, does contribute to the
variety of uses in th~s area.
Staff finds that the new zoning to L-O should be harmonious with and in accordance with the
Comprehensive Plan, as amended by Resolution No. 04-454. Staff recommends that the
Commission and Council rely on staff's analysis, other agency/department comments, and
any other comments received regarding the appropriateness ofzoning this site for an office
use.
B.
Is the area included in the zoning amendment intended to be rezoned in the future;
Concurrent with the annexation and zoning application, the applicant has submitted a site
plan and a landscape plan. These plans depict the remodeled office, a storage shop,
parking, and landscaping improvements for this property. Staff does not anticipate that
the applicant plans to rezone the subject property in the future if the subject
annexation/zoning is approved, as the anticipated office use is allowed in the requested L-
0 zone. Please see Finding "C".
c.
Is the area included in the zoning amendment intended to be developed in the
fashion that would be allowed under the new zoning -for example, a residential area
turning into a commercial area by means of conditional use permits;
Staff finds that professional offices, laboratories, libraries and medical clinics would be

permitted uses within the requested L-O zone. However, there are several uses in the
requested L-O zone that can occur with conditional use permit approval. Staff is
concerned that this site may turn into a commercial retail site, and is recommending that
the City limit the uses that can operate on the site. Please see Special Consideration #2
below for proposed uses that will be permitted on this site.
D.
Has there been a change in the area or adjacent areas which may dictate that the
area should be rezoned. For example, have the streets been widened, new railroad
access been developed or planned or adjacent area being developed in a fashion
similar to the proposed rezone area;
This area has seen many recent changes. Most notably, Office Jet Subdivision, which is less
than ~ of a mile to the north of the subject site on Locust Grove Road. Office buildings have
recently been constructed within Office Jet Subdivision. Locust Grove Road is currently
improved to five lanes. Carol Street has curb, gutter and sidewalk on the south side of the
street (adjacent to Walgreen's). These facts contribute to recommending that this area is
changing and should be rezoned.
E.
Will the proposed uses be designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing or intended character
of the general vicinity and that such use will not change the essential character of
the same area;
The applicant will be required to re-construct, operate and maintain the office building(s)
in accordance with City Code. Although this area was intended for residential uses when
the 2002 Comprehensive Plan was adopted, staff finds that an office zone also complies
with what is intended for this intersection, as Resolution No. 04-454 allows the City
Council to consider office uses in this location. Staff finds that the design of the
submitted layout could be harmonious with the adjacent properties if adequate
landscaping/screening is provided. Staff further finds that the proposed office zone/use
will change the existing character of the area, but that the proposed zone and future use
should be harmonious and appropriate in appearance with the character of the overall
area. Staff finds that any future uses, if designed, constructed and operated in accordance
with adopted city ordinances, should be harmonious and appropriate in appearance with
the intended character of the vicinity.
F.
Will the proposed uses not be hazardous or disturbing to existing or future
neighboring uses;
Staff finds that the use of this site for professional offices should not be hazardous or
disturbing to existing or future neighboring uses if the applicant enters into a
development agreement with the City and all development and landscaping ordinances

are exercised. Commercial (office) vehicular access to this site could cause a potential
disturbance to existing and/or future residential uses in this area. The 2002
Comprehensive Plan Future Land Use Map designates the properties to the north and
west as low density uses and this office lot would take access to a primarily residential
street, Carol Street. Staff does not believe that this office will generate a significant
amount of traffic. However, staff has received several letters and phone calls ttom nearby
property owners stating that an office use on this property will be disturbing. Some of the
neighbors have stated that getting into and out of the subdivision is very difficult. Due to
the location of the Walgreen's driveway, the Fred Meyer driveway and cars stacking up at
the Locust Grove/Fairview intersection, access to Carol Street has become difficult for
the residents in this area. Therefore, in addition to staffs analysis, the Commission and
Council should rely on public testimony (oral and written) to determine whether or not
the potential disturbance of allowing a commercial access int%ut of this site will
substantially affect the existing or future neighboring uses.
G.
Will the area be served adequately by essential public facilities and services such as
highways, streets, police and fIre protection, drainage structures, refuse disposal,
water, sewer or that the person responsible for the establishment of proposed zoning
amendment shall be able to provide adequately any of such services;
Sanitary sewer is available in N. Locust Grove Road and has already been stubbed into
W. Carol Street which abuts the southern boundary of this property.
The applicant and/or future property owners will be required to pay any applicable park
and highway impact fees as well as construct on-site storm water drainage facilities.
On July 1, 2005, a joint agency and department comments meeting was held with
representatives of key service providers to this property. Based on the joint meeting and
other comments received ttom agencies and departments, staff finds that the public
services listed above can be made available to accommodate the proposed development.
The Commission and Council should reference any written and/or verbal testimony
submitted by any public service provider, regarding their ability to adequately service this
project.
H.
Will not create excessive additional requirements at public cost for public facilities
and services and will not be detrimental to the economic welfare of the community;
If approved, the developer will be financing the extension of sewer, water, local street
infrastructure, utilities and irrigation services to serve the project. Other required site
improvements will be funded and constructed by the developer through the CZC approval
process. The primary public costs to serve the future uses will be fire and police facilities
and services. Staff finds there will not be excessive additional requirements at public cost

and that the proposed zoning and subsequent development will not be detrimental to the
community's economic welfare.
I.
Will the proposed uses not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any persons, property or the
general welfare by reason of excessive production of traffic, noise, smoke, fumes,
glare or odors;
The purpose of the L-Q zone is to "permit the establishment of groupings of professional,
research, executive, administrative, accounting, clerical, stenographic, public service and
similar uses.. . shall not involve heavy testing operations of any kind or product
manufacturing of such a nature to create noise, vibration or emissions of a nature
offensive to the overall purpose of this District." (MCCl1- 7-2.G) As such, staff does not
anticipate future uses will create smoke, fumes, glare, or odors that will be detrimental to
the general welfare of persons or property in the area. Staff does not anticipate the
proposed annexation and subsequent use(s) will create excessive noise, smoke, fumes,
glare, or odors. Staff finds that the proposed office zoning/use should not be detrimental
to people, property or the general welfare of the area.
If the subject annexation and zoning application is approved, the applicant intends to remodel
the existing home into an office. Staff finds that any future uses on this site will generate
additional traffic on adjacent roadways above and beyond what the existing residence
generates. Staff recognizes that traffic and noise will increase with the approval of this
development; however, do to the smaller size of the site staff does not believe that the
amount generated will be detrimental to the general welfare of the public. However, the City
has received several letters from home owners in this area, some stating that the proposed use
may be detrimental to persons, property and/or their general welfare. In addition to staffs
analysis, the Commission and Council should rely on any and all public testimony (oral and
written) provided when determining this finding.
MCC 11-16-4 provides the P&Z Commission and City Council the authority to require a
property owner to enter into a Development Agreement with the City of Meridian that may
require some written commitment for all future uses to more fully comply with this finding.
Due to the close proximity ofthe existing residential uses, staffbelieves that a Development
Agreement is necessary to ensure that the purpose of the L-O zone is maintained. Please see
Annexation & Zoning Facts and Comments below.
J.
Will the area have vehicular approaches to the property which shall be so designed
as not to create an interference with traffic on surrounding public streets;
This parcel has approximately 100 feet of frontage on Locust Grove Road. Any driveway
to the site from Locust Grove Road would be close to the Carol Street/Locust Grove Road

intersection. Therefore, the applicant is proposing a driveway approach to Carol Street
and not Locust Grove Road. ACHD considers access points in their analysis of
development applications and their staff is recommending approval of the proposed
vehicular approach. Staff believes that the proposed uses (and access) should not be
hazardous to neighboring uses or traffic flows. The Commission and Council should rely
on public testimony, ACHD staff, and City staffs analysis when determining whether or
not the proposed vehicular approach to Carol Street will create an interference with traffic
on surrounding public streets.
K.
Will not result in the destruction, loss or damage of a natural or scenic feature of
major importance; and
Staff is unaware of any natural or scenic features of major importance on this site and
finds that no natural or scenic features of major importance will be lost or damaged by
approving the annexation and zoning application. Any existing trees larger than 4" caliper
that are removed shall be mitigated for, as determined by the City Arborist.
L.
Is the proposed zoning amendment in the best interest of the City of Meridian. (Ord.
592,11-17-1992)"
The legal description submitted with the application, prepared by Arrow Land Surveying,
Inc., shows that the property is contiguous to the existing corporate boundary ofthe City of
Meridian. The land directly south and east of the subject property has previously been
annexed into the City and this is a logical expansion of the City boundary. The applicant is
proposing to develop the land in substantial compliance with the City's Comprehensive Plan.
In accordance with the findings listed above, staff finds that the annexation and zoning of
this DroDerty would be in the best interest of the City. NOTE: Staff has included
Development Agreement stipulations for annexation and zoning of this property below.
SPECIAL CONSIDERATIONS (ANNEXATION & ZONING)
1. Existing ShOD and Adjacent Uses: There is an existing shop on the west side ofthis site that
is approximately 5 feet from the west property line and approximately 14 feet fiom the north
property line. The applicant intends to retain the existing shop and utilize it for storage
related to the office use. The applicant is also proposing to add onto the existing house,
bringing the office addition to within ten feet of the north property line.
If the subj ect annexation and zoning application is approved, L-O property will be adj acent to
rural residential properties zoned R6 in Ada County. There are single- family homes to both
the north and west of the subject property. MCC 12-13-12 requires a20-foot wide landscape
buffer between office uses (Class III) and single-family homes (Class I). MCC 11-9-1
requires a 20 foot rear building setback.

The city recognizes that the specific requirements of this landscape ordinance cannot and do
not anticipate all possible landscape situations. In addition, the city recognizes that there may
be landscape proposals which conform to the purpose, intent, and objectives of the landscape
regulations but were not anticipated in the specific regulations. Therefore, the City may allow
for a method of alternative compliance in the event of these situations (MCC 12-13-18-2).
West: As an alternative method to the standard 20-foot landscape buffer, the applicant is
proposing to retain the existing shop and provide a 6-foot tall vinyl fence along the west
property line. Staff is supportive of this request because the location of the existing shop and
home do not allow enough room to provide the full 20- foot buffer and required parking.
Further, staff believes that the intent ofthe land use buffer will be maintained if a fence and
landscaping are installed as proposed. Staff recommends that the existing shop be allowed to
remain as a non-conforming use. Further, staff recommends that the applicant be granted
alternative compliance for landscaping adjacent to the existing shop and proposed parking on
the west property line. Landscape buffers shall be reduced to approximately five feet adjacent
to the shop and to ten feet adjacent to the proposed parking stalls.
North: Similar to the west property line, the applicant is proposing to construct a six-foot tall
vinyl fence and additional tree and shrub plantings along the north property line (see
applicant's letter dated July 13,2005). Where the shop encroaches into the required 20-foot
wide buffer to the north, staff is supportive of allowing alternative compliance (down to 14
feet). However, MCC 12-13-18-2 allows altemative compliance only when certain conditions
are proved by the applicant. Staff does not believe that any of the conditions/circumstances
listed in MCC 12-13-18-2 (topography, space limitations, environmental quality issues,
safety, etc.) are present adjacent to the proposed parking area and office addition; the
applicant is creating a non-conforming use. Therefore, staff recommends that the proposed
office addition and parking requirements be located outside of the required 20-foot wide
buffer and building setback to the north. Except adjacent to the existing shop, the applicant
should provide a 20-foot wide landscape buffer with materials in accord with MCC 12-13-
12-3 adjacent to the north property line. See Annexation & Zoning Facts and Comments #3
below.
2.
Future Development:
Office Use: Professional and sales offices, laboratories, health care services and medical
clinics are some of the most common principally permitted uses within the requested L-O
zone. Staffbelieves that these principally permitted uses are appropriate for this property and
meet the intent of Resolution No. 04-454. However, there are several retail and ancillary
commercial uses that can occur in the L-O zone with conditional use permit approval. Staff is
concerned that this area may turn into a commercial retail site, and is recommending that the
City limit the uses that can operate on the site to office and clinic type uses. This
recommendation is intended to protect the neighbors from more intense commercial uses that
could potentially operate on this property with CUP approval, and to ensure that the uses

intended in Resolution No. 04-454 (light office, low-impact businesses) are upheld. See
Annexation & Zoning Facts and Comments #3 below.
According to MCC 11-19-1- A, no building or other structure shall be erected, moved, added
to or structurally altered, nor shall any building, structure or land be established or changed in
use without a Certificate of Zoning Compliance (CZC) issued by the Administrator. A CZC
shall be issued only in conformity with the provisions of this Title and shall be required
before the issuance of a building permit. Prior to construction of any building on this site, a
CZC pennit should be obtained.
Upon annexation and zoning of the property to L-O, the existing residence will become a
non-conforming use. The applicant, Commission and Council should be aware that no
alterations, expansions, reconstructions or other enlargements to the structure will be
permitted except through a CZC permit and except where the use of the structure changes to
a use permitted in the L-O zone. Prior to operating an office use on this site, a certificate of
zoning compliance permit should be obtained. See Annexation & Zoning Facts and
Comments #3 below.
Hours of Operation: In the applicant's submittal letter, the applicant does not address the
hours of operation for the proposed development. Because this site abuts single-family
residences, staff is recommending that the hours of operation for businesses on this site be
limited through a Development Agreement from 6 am to 10 pm. See Annexation & Zoning
Facts and Comments #3 below.
Landscaping: Locust Grove Road is a classified arterial roadway. A 25-foot wide
landscape buffer is currently required adjacent to arterial roadways (MCC 12-13-10-4). A
IO-foot wide landscape buffer is currently required adjacent to Carol Street, a local road
(MCC 12-13-10-4). Landscape buffers construction adjacent to Locust Grove Road and
Carol Street will be required by the City with CZC approval.
See the Special Consideration for the "Existing Shop" above for landscaping requirements to
the north and west.
Parkin!!: For professional offices, parking stalls are currently required at the rate of one space
per 400 s.t. of gross floor area (MCC 11-13-5.B). The applicant has shown 10 parking spaces
on the submitted site/landscape plan (Sheet LI.O, prepared by The Land Group, Inc., dated 6-
9-05). The applicant should be required to provide on-site parking in accordance with MCC
11-13 with CZC approval.
3.
Sanitary Sewer: Sewer and water are stubbed into East Carol Street from North Locust
Grove Road. The applicant shall be responsible to construct sewer and water mains to
and through this development, coordinate main size and routing with Public Works.

ANEXATION & ZONING FACTS AND COMMENTS
1. The subject property is within the Urban Services Planning Area. The legal description
submitted with the application (dated 6-9-05, stamped by Darren R. Leavitt) shows the
property as contiguous to the existing corporate boundary of the City of Meridian. The
Public Works Department has confirmed that the submitted legal description meets the
requirements of the City of Meridian and the Idaho State Tax Commission.
2.
Any future subdivision and/or development of this property shall comply with the City of
Meridian ordinances in effect at the time.
3.
Prior to the annexation ordinance approval, a Development Agreement (DA) shall be
entered into between the City of Meridian, property owner (at the time of annexation
ordinance adoption), and the developer. The applicant shall contact the City Attorney.
Bill Nary. at 888-4433 to initiate this process. The DA shall incorporate the following:
. That no alterations, expansions, reconstructions or other enlargements to the existing
single-family structure will be permitted except through a Certificate of Zoning
Compliance (CZC) and except where I) the use of the structure changes to a use
consistent with this Development Agreement and 2) the structure shall meet all
applicable development standards such as setbacks, frontage, height, etc. of the L-Q
zone.
. That no building or other structure shall be erected, moved, added to or structurally
altered, nor shall any building, structure or land be established or changed in use without
a Certificate of Zoning Compliance (CZC).
. That all future uses shall not involve uses, activities, processes, materials, equipment and
conditions of operation that will be detrimental to any persons, property or the general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors.
. That the following shall be the only allowed uses on this property: professional and sales
offices, personal or professional services, clinics (medical, dental and optical), and health
care or social services. As the only exception to the uses specifically allowed by
Resolution 04-454, the applicant may apply for a Conditional Use Permit to operate a
child care facility on this property in the future.
. That the hours of operation shall be limited to 6 a.m. to 10 p.m., unless otherwise
modified through a future Conditional Use Permit.
. That any new structure(s) (or remodel of existing structure(s)) shall be generally
compatible in appearance and bulk with the surrounding residential properties, as
determined by the Planning Director or otherwise approved through a Conditional Use
Permit.
. That the existing shop be allowed to remain as a non-conforming structure.
. That the City has approved alternative compliance for the landscaping adjacent to the
west and north property lines. The landscape buffer to the west shall be reduced to
approximately five feet adjacent to the shop and to ten feet adjacent to the proposed

parking stalls. The landscape buffer to the north shall be reduced to 14 feet adjacent to
the existing shop, and shall be 20 feet wide in all other locations. Landscape materials
along the buffers to the north and west shall be in accord with MCC 12-13-12-3, and as
proposed by the applicant on the landscape plan labeled LI.O, prepared by The Land
Group, Inc., dated 6-9-05.
. That the applicant agrees to construct a 6- foot tall vinyl privacy fence along the north and
west property lines, as proposed.
. That vehicular access to this site shall be restricted to those approved by ACHD and
the City. No vehicular access to Locust Grove Road is approved.
OTHER AGENCY/DEPARTMENT COMMENTS
NOTE: Ifthe subject annexation and zoning is approved, the following agencies/departments
intend to provide the following requirements and conditions.
MERIDIAN FIRE DEPARTMENT (AZ.OS-O32)
1. Commercial and office occupancies will require a fire-flow consistent with the International
Fire Code to service the proposed project. Fire hydrants shall be placed per Appendix D.
2. All aspects of the building systems (including exiting systems), processes & storage practices
shall be required to comply with the International Fire Code.
3. Provide exterior egress lighting as required by the International Building & Fire Codes.
4. Where a portion of the facility or building hereafter constructed or moved into or within the
jurisdiction is more than 400 feet (122 m) from a hydrant on a fire apparatus access road, as
measured by an approved route around the exterior of the facility or building, on-site fire
hydrants and mains shall be provided where required by the code official. For buildings
equipped throughout with an approved automatic sprinkler system installed in accordance with
Section 903.3.1.1 or 903.3.1.2 the distance requirement shall be 600 feet (183).
a. For Group R-3 and Group U occupancies, the distance requirement shall be 600 feet
(183 m).
b. For buildings equipped throughout with an approved automatic sprinkler system

5. Any basements in the building(s) shall comply with the IFC and IBC for sprinklers and
opemngs.

submit stamped (approved) plans with your certificate of zoning compliance application.
MERIDIAN PUBLIC WORKS DEPARTMENT
1. Street signs are to be in place, water system shall be approved and activated, fencing shall be
installed, drainage lots constructed, road base shall be approved by the Ada County Highway
District, and the Final Plat for this subdivision shall be recorded, prior to applying for
building permits.
2. All development improvements, including but not limited to sewer, fencing, micro-paths,
pressurized irrigation and landscaping shall be installed and approved prior to obtaining
certificates of occupancy.
3. Applicant shall be required to pay Public Works development plan review, and construction
inspection fees, as determined during the plan review process, prior to signature on the final
plat per Resolution 02-374.
4. It shall be the responsibility ofthe applicant to ensure that all development features
comply with the Americans with Disabilities Act and the Fair Housing Act.
5. Applicant shall be responsible for application and compliance with and NPDES Permitting
that may be required by the Environmental Protection Agency.
6. Applicant shall be responsible for application and compliance with any Section 404
Permitting that may be required by the Army Corps of Engineers.
7. All grading ofthe site shall be performed in conformance with MCC 1I-I2-3H.
8. Compaction test results shall be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.

9. Any existing domestic wells and/or septic systems within this project shall be removed from
domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-
domestic purposes such as landscape irrigation.
10. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing
or lying adjacent and contiguous to the area being subdivided shall be tiled per City
Ordinance 12-4-13. Plans shall be approved by the appropriate irrigation/drainage district, or
lateral users association (ditch owners), with written approval or non-approval submitted to
the Public Works Department. If lateral users association approval can't be obtained,
alternate plans shall be reviewed and approved by the meridian City Engineer prior to final
plat signature.
11. Please submit all updated groundwater/soils monitoring data to the Public Works Department
for review. Any drainage areas (detention/retention basins) must be designed to ensure that
water is retained only during 1 OO-year storm events, and for a period of time not to exceed 24
hours. Side slopes within drainage areas shall not exceed 3: 1. Any portion of a drainage area
not improved with sod/grass seed (or other approved landscaping) shall not count towards the
required open space area. The project engineer should pay close attention to the results of
field studies determining the groundwater, soil type & and characteristics during the design
and construction phases.
12. Two-hundred- fifty and one hundred watt, high-pressure sodium streetlights shall be required
at locations designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final
design locations and quantity are determined after power designs are completed by Idaho
Power Company. The street light contractor shall obtain design and permit from the Public
Works Department prior to commencing installations.
13. Applicant's engineer shall be required to submit a signed, stamped statement certifying that
all street finish centerline elevations are set a minimum of three feet above the highest
established normal groundwater elevation.
RECOMMENDATION
Staff is recommending that the property be annexed into the City with an L-O zoning
designation with the aforementioned Annexation & Zoning Facts and Comments included in a
Development Agreement.

Dear Commissioners,
we purchased our home in the Doris
Subdiviáion in July 2004. We really liked
this subdivision because it"had all the qual-
ities we were looking for. It was quiet, very
little traffic and close to shopping, doc~ors,
hospitals andanything else we would ever want.
If you. allow a real e -(tate odffice to be at the
1560 ~. Caol street )roperty, that would inc-
rease traffic and noise. In the mornings and
late afternoons it is very difficult to get
out onto Locust Grove and a business at that
address would increase the ~raffic flow at the
entrance to our subdivisi~n. Our C C & R'B
restrict these properties in the Doris Sub-
division to residental and we want to see it

above. As a homeowner just 2 homes to the West from this property, the approval of
such application will have a direct economic impact on me.
I purchased my home approximately 6 years ago in a residential neighborhood. I
strongly feel that mixing commercial property with residential in such close proximity
will devalue my property and impede any future sale. Further, property taxes in a
"mixed" development are generally higher than a strictly residential area.
With the rising costs of homes, and particularly homes with similar features like
mine, I would be unable to sell my home and replace it with another should my value be
effected by this application.
Each and every home in this subdivision will be negatively impacted by the
approval of this application. Once one property is allowed to go commercial, the
floodgates are open to others.

Our home is next door to the above address and we understand our neighbors desire to
move because Locust Grove has become more congested and noisy, but we do not want
to be put in the same situation by having said property annexed and changed to
commercial. Promised changes on Locust Grove when Walgreen's was built have not
been kept and additional traffic on Carol Street is unacceptable. Adding a parking lot
with traffic exiting towards Locust Grove so close to the intresection while residents are
entering the subdivision is a recipe for additional accidents.
We purchased our home in a residential area and we want it to continue as residential.
As a realtor, Carrie Jewett is aware that commercial property added in a residential area
only decreases the value of other properties in the subdivision.
The majority of residents within Doris subdivison not facing Locust Grove have
signed the enclosed petition against the annexation and change to commercial of the
above property. All the residents that signed stated the same concerns I have listed
above.

Our home is in a residential area and we want it to continue to be zoned residential. We
have small children and we are very concerned about the increased traffic a business
would bring. It is already a challenge to get in and out of our neighborhood onto Locust
Grove. There have been traffic accidents and many, many near misses at this location.
A business with a parking lot would make bad situation worse.
96% (24 out of 25 houses) of the residents on Carol Street have signed the enclosed
petition against the annexation and change to commercial of the above property. All the
residents that signed share the same concerns as us.

As you can see nom the attached list of property sold, on the active market and sale
pending, property like those found in the Carol Subdivision are very hard to come by.
This list represents all property on 1 acre or more sold in the North East Meridian area in
2005. Each property has it's own unique features but none have the amenities of those
here.
We believe that this information proves the hardship allowing commercial property to
come into our neighborhood and decrease our property values would cause. We would be
hard pressed to replace the homes we currently own with ones similar in nature and from
a selling point, when there is commercial property so near residential property the
residential property takes a dip in value.
Of the 11 properties sold the average sq. ft. price is $105.85. Here in the Carol Sub the
average price $99.25 with out the addition of commercial property to the neighborhood.
As you can see nom these numbers we cannot afford to have the property at 1560 Carol
be turned commercial. The impact on property values would be too great.

We are requesting an alternative method of compliance for the western and northern sides
of the property due to existing site conditions, site space limitations, and change of use of
the site as listed in 11~5B-S: B. Applicabmty: 2. s. b. and 3.a. The existing site
conditions include an existing shop building located within the required buffer, space
]imitations for providing the required number of parking stalls, and a change of use from
a residential structure to an office use.
We win comply by providing a 6' Vinyl privacy fence along both property lines alo~
with additional tree and shrob plantings. The density of addiûonal tree and shrub
plantings wiJl be substantially greater tban code requires.

As a homeowner' residing at 1870 West carol, we. are oppœed to the annexa,tion and fe-zoningl of
Lot 8 of Block. 4 in the Doris SubdiviSiOn for the following reaoons:
Meridian Planning and Zoning Commission
1. ThissubdMsion has only one entJanœj exit which passes by the lot in question. During
many hours of the day it is nearly impossible to turn North (left) out of Itte subdivision.
There have been many accidents at this intersection due to the fact it is located directly
across from a very heavily used Fred Meyer entrance and exit.
2., There is no left turn lane from locust Grove onto South Carol Street when coming from
the south. It is virtually unprotected. There have been many times cars will be backed
up past our subdivision entrance on locust Grove while waiting to tumleft onto FailView
Avenue. We have been forced to sit in the lane of traffIC to turn west into our subdivision
until the light changes and enables these cars to move. There is no mention of four
entrances onto North locust GrO'Æ within 300 feet d each other. See the attached map
on Page 2.
3. Through the course of construction and remodel, carol Street homeowners will have to
rontend with heavy equipment fur dfâìnageß gravel base and paving potentially blocking
the only entrance/exit into the sutxlivision.
4. The proposed name for the 1560 South Carol Street buikling is "West carol Street
Professional", This will be mnfusing as it is located on South carol Street.
.In our opinion this 500 foot section d North locust Grove cannot handle the additional traffic that
a commercial property will draw into the residential neighborhood.

Roadway Improvements Adjacent To and Near the Site
Locust Grove Road is currently improved with 3-traffic lanes with vertical curb, gutter sidewalk and
bike lanes.
Carol Street is currently improved with 2-traffic lanes with no curb, gutter or sidewalk abutting the site.
There is vertical curb, gutter and sidewalk that is constructed to one-half of a 36-foot street section
that is located on the south side of Carol Street that was constructed with the Walgreen's.
Existing Right-of-Way
Locust Grove Road has a total of 82-feet of right-of-way (41-feet from centerline).
Carol Street has a total of 45-feet of right-of-way (25-feet from centerline).
Existing Access to the Site
The site has an existing 20-foot driveway that intersects Carol Street approximately 80-feet west of
Locust Grove Road. This driveway accesses the existing single-family dwelling.

approximately 150-feet west of Locust Grove Road.

The District has not previously reviewed a development application on this site.

Capital Improvements PlanlFive Year Work Program
This segment of Locust Grove Road and Carol Street is not included in the District's Five Year Work
Program of Capital Improvements Plan.
B.
Findings for Consideration
1.
Locust Grove Road
District policy requires 96-feet of right-of-way on arterial roadways (Figure 12-F1 B). This right-of-way
allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks
and bike lanes.
. Locust Grove Road is currently fully improved with 3-traffic lanes and a bike lane with vertical
curb, gutter and sidewalk abutting the site. Locust Grove Road was improved in 2004. When
Locust Grove Road was improved, the right-of-way on Locust Grove Road was acquired for
the project. Based on the assessor's information and the parcels legal description, it appears
that the right-of-way abutting this parcel was not fully acquired. In order to clean up the
property lines abutting this site, the applicant should dedicate 41-feet of right-of-way from the
centerline of Locust Grove Road to be consistent with the right-of-way dedication to the north
and the south of this site.
. The applicant is not proposing to construct any driveways on Locust Grove Road and no
driveways have been approved.
Carol Street
Right-ot-Way
District policy 1204.4.1 and Figure 12-F1A requires 50-feet of right-of-way on local streets. This right-
of-way allows for the construction of a 2-lane roadway with curb, gutter and 5-foot wide concrete
sidewalks.
Improvements
District policy 1202.8 and 12-F1A, requires roadways abutting commercial developments to be
constructed as a 40-foot street section with curb, gutter and 5-foot concrete sidewalk within 54-feet of
right-of-way.
. Typically the District would require the applicant to dedicate 21 -feet of right-of-way from the
centerline of Carol Street and construct Carol Street as one-half of a 36-foot street section
with vertical curb, gutter and a 5-foot attached concrete sidewalk. When the Walgreen's site
was constructed to the south of this site, the District required Walgreen's to dedicate 25-feet of
right-of-way from the centerline of Carol Street and construct Carol Street as one-half of a 36-
foot street section that includes vertical curb, gutter and an attached concrete sidewalk
abutting the site. Due to the fact that Walgreen's was required to dedicate 25-feet of right-of-
way and construct Carol Street as one-half of a 36-foot street section that includes vertical
curb, gutter and an attached concrete sidewalk, staff is recommending that this applicant do
the same. This will create a consistent street section and will allow 3-traffic lanes at the
intersection of Locust Grove Road if parking is restricted on both sides of the roadway.
Parking will be prohibited on both sides of the road.

Driveways
District policy 72-F4 (1) and 72-F4 (2), requires driveways located on commercial/industrial roadways
to offset a controlled and/or uncontrolled intersection a minimum of 50-feet (measured near edge to
near edge).
District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles
to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type
facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for
driveways accessing collector and arterial roadways.
Graveled driveways abutting public streets create maintenance problems due to gravel being tracked
onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to
pave the driveway its full width and at least 3D-feet into the site beyond the edge of pavement of the
roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge.
. The applicant is proposing to close the two existing driveways with standard vertical curb,
gutter and sidewalk. Staff is supportive of the applicant's proposal.
. The applicant is proposing to construct a new 24-foot wide curb cut driveway that intersects
Carol Street approximately 120-feet west of Locust Grove Road. The location and design of
the driveway meets District policy and should be approved with this application.

Other Access
Locust Grove Road is classified as a minor arterial roadway. No access points have been proposed
and none have been approved with this application.
C.
Site Specific Conditions of Approval
1.
Dedicate 41-feet of right-of-way from the centerline of Locust Grove Road abutting the parcel by
means of execution of a warranty deed prior to issuance of a building permit (or other required
permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication
after receipt of all requested material. The owner will not be compensated for this additional right-of-
way due to the fact that the applicant is cleaning up property lines of right-of-way that was purchased
in 2003.
2.
Dedicate 25-feet of right-of-way from the centerline of Carol Street abutting the parcel by means of
recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building
permit (or other required permits), whichever occurs first. Allow up to 30 business days to process
the right-of-way dedication after receipt of all requested material. The owner will not be compensated
for this additional right-of-way because Carol Street is classified as a commercial roadway and is to
be brought to adopted standards by the developers of abutting properties.

Construct Carol Street as one-half of a 36-foot street section (that is constructed to a commercial
standard) that includes vertical curb, gutter and an attached concrete sidewalk abutting the site.
Close the two existing driveways with standard vertical curb, gutter and sidewalk, as proposed.
Construct a new 24-foot wide curb cut driveway that intersects Carol Street approximately 120-feet
west of Locust Grove Road, as proposed. Pave the driveway its full width and at least 3D-feet into
the site beyond the edge of Carol Street.
Comply with all Standard Conditions of Approval.

Standard Conditions of Approval
1.
Any existing irrigation facilities shall be relocated outside of the right-of-way.
All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.

Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.

Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.

All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
6.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
7.
Construction, use and property development shall be in conformance with all applicable requirements
of the Ada County Highway District prior to District approval for occupancy.
8.
Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #200, also known as Ada County Highway District Impact Fee Ordinance.
9.
It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in
the event any ACHD conduits (spare or filled) are compromised during any phase of construction.
10.
No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
Conclusions of Law
The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular transportation system within the vicinity impacted by the
proposed development.

Request for Appeal of Staff Decision
1.
Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the
final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not
properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error
of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or
enforcement of the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged
the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary
of Highway Systems, which must be filed within ten (10) working days from the date of the
decision that is the subject of the appeal. The notice of appeal shall refer to the decision
being appealed, identify the appellant by name, address and telephone number and state
the grounds for the appeal. The grounds shall include a written summary of the provisions
of the policy relevant to the appeal and/or the facts and law relied upon and shall include a
written argument in support of the appeal. The Commission shall not consider a notice of
appeal that does not comply with the provisions of this subsection.
C. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of
the filing of the notice of appeal to reply to the notice of the appeal, and may during such
time meet with the appellant to discuss the matter, and may also consider and/or modify
the decision that is being appealed. A copy of the reply, and any modifications to the
decision being appealed will be provided to the appellant prior to the Commission hearing
on the appeal.
d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal
will be noticed and scheduled on the Commission agenda at a regular meeting to be held
within thirty (30) days following the delivery to the appellant of the ROWDS Manager's
reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal
and the reply shall be delivered to the Commission at least one (1) week prior to the
hearing.
e. Action by Commission: Following the hearing, the Commission shall either affirm or
reverse, in whole or part, or otherwise modify, amend or supplement the decision being
appealed, as such action is adequately supported by the law and evidence presented at
the hearing.
