Watertower Ln., Ste. 202 Meridian, Idaho 83642 May 22, 2002 :Re: Variance Application Dear Sirs: I am requesting a side yard setback variance from ten (10) feet to five (5) feet on one side of a home that I built last year in Packard Estates. During the course of construction, I built a dormer facing the west side yard, not realizing that this might cause a problem with the setback on that side. By the time I realized what had happened, it was completed. I met with the builder of the adjacent lot, John Cotner of Cotner Building Co., and bought five feet of his lot. (Please see enclosed check and purchase agreement.) I thought that this would cure the problem. We both thought that the other was doing the lot line adjustment, when in fact, neither one of us got it done. Upon finishing my home, I put in the landscaping, and included my "new" five feet, complete with lawn and sprinklers. Since that time, my home sold, and so did the Cotner home next door. The next thing I know is that Cotner's homebuyer wants to put up a fence and discovers this five- foot encroachment on her property and is suing my homebuyer over this. She isn't willing to sell her "extra" five feet. As you can see, I made an error that I am trying to get resolved and am asking for your help in granting me a variance on the west side yard setback. Like I stated earlier, it is only a bonus room dormer, not a solid, two-story wall. It is my understanding that a certificate of occupancy was issued and a variance granted last year on a similar situation in Packard Estates Lot 2 Block 1. Your understanding and consideration is greatly appreciated. I have enclosed all the pertinent information with this application.
