Hethe Clark on May 19, 2020: T. Hethe Clark, Esq. seems to have given the public the impression that the public record didn't or doesn't exist prior to the November 2019 public hearing date of this application. This, in my opinion, is untrue. Anyone who has been following this application and all of its prior applications under any name know that it has a long history. There is an entitlement that runs with the property owner, no matter under whose name it is, transparent or not. These records are open to the public and follow the landowner, and the person to whom the entitlement has been granted. Arguing against an attorney/applicant who specializes in land use planning is probably not my best move, however, I will cite the Land Use Handbook by Givens Pursely LLP for the record. (It's too large to attach otherwise I would!) There has been much secrecy surrounding who the current applicant is and the lack of transparency seems to be a game that the public doesn't much like playing — especially with deep -pocket developers who want to outlast the neighboring homeowners who are simply trying to protect their safety, perform their due diligence and not get things thrown at them in meetings. This is not how professionals should treat those they want to be on their side. Having said this, safety is the utmost concern on the part of those who want to stick this out. Safety for themselves, their neighbors, and those who will use the streets, sidewalks and amenities that will be used by those who will be accessing the infill that is being proposed. If you cannot come to the table with the transparency that is due those who are also at the table, then at least do not muddy the water with vague comments that lead the rest of the public to believe things that are misleading to further exacerbate a contentious application. In addition, I support the continued closure (to through traffic) of N. Dashwood Place. Among the most obvious reasons is the continued one of safety. For no other reason than that, it should be remanded back to the ACHD ADA Citizens Advisory Committee for review. There have been concerns raised regarding the City of Meridians lack of accountability regarding current ADA standards in which there must be adherence. Items such as placement of trash receptacles that block clear pathways; mailbox placement in clear pathways; long vehicles being parked on short driveways that block clear pathways on sidewalks on trash pick up days (setbacks?); and other issues that should be addressed in this packet. Opening Dashwood PI is a can of worms that could be avoided by the option that has been offered by the Alpine Pointe/Dashwood Place Residents. Other jurisdictions have opted to lengthen their setbacks to allow for longer driveways to avoid these issues. Maybe it's time for the City of Meridian to revise their code? (As an example, Eagle City Code states "All front load garages shall be set back a minimum of 25 feet from the back of sidewalk." [ECC 8.2.4 Note Conditions: G]) I am opposed to the Reconsideration Request for Findings of Fact, Conclusions of Law for Delano Subdivision (H-2019-0027) by Boll Cook Investments, LLC located at 14120 W.
