APPLICATION SUMMARY The Applicant, Todd Amyx, requests approval of a landscape plan modification to redesign a portion of a buffer that parallels W. McMillan Road on the north boundary and delay the installation of the required fencing along Common Lots 1 Blocic 3 and Lot 1 Blocic 4, until the construction of homes on the adjacent lots. To ensure the fencing is installed, the applicant is proposing tha City hold tha fence surety until it is installed per the approved landscape plan. II_ SUMMARY RECOMMENDATION Staff recommends approval of the requested modification to the final plat landscape plan and release of all surety exceptfor what pertains to fencing. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located at 943 W. McMillan Road, in the NE'/< of the NW '/. of Section 36, Township 4N. Ranga 1 W. (Parcel No. 50436212400). B. Applicant's Statament/Justification: Please see applicant's narrative £or this information. N_ HISTORY OF PREVIOUS ACTIONS: In September of 2018, the subject property received annexation, zoning to R-4 and preliminary plat approval for 128 lots on 40.6 acres (H-2018-0074). In April of 2019, the Council approved the final plat for the first phase, which included 45 single family residential lots on 17.96 acres (H-2019-0033). Whitecliffe Estates No. 1 —LPM Page 1 V. STAFF ANALYSIS UDC Table I1-2A-5 requires a 25-Foot wide landscape buffer along arterial streets (W. McMillan Road). However, the area along McMillan Road is encumbered by a 60-foot wide Idaho Power easement and a 50-foot wide Lemp Canal easement. Per the approved landscape plan, a 30-foot wide landscape buffer was approved along the McMillan Road frontage consisting o£ 10 feet o£lawn in front of the sidewalk, a 5-foot wide detached sidewalk and 15 feet of landscaping between the sidewalk and the buildable lots, exceeding the requirements of the UDC. During the inspection of the subsequent development by the City, staff discovered the lawn in front of the sidewalk was replaced with 1 O feet of gravel. Further, some ofthe required fencing was not installed along Common Lots 1 Block 3 and Lot 1 Block 4. The Applicant contends the Settlers Irrigation District would not allow the lawn in front of the sidewalk as previously approved. This is because Irrigation District needs to access the canal from the south due to the proximity o£ the canal to McMillan Road, and during maintenance operations o£ the canal, heavy equipment would destroy the grass. The additional 15 feet of landscaping and the 5-foot wide detached sidewalk should not be affected. In analyzing the applicant's request, UDC 11-3B-7 (Landscape Buffers along Streets), only requires the applicant to install a minimum o£ a 5-foot wide buffer when the area is encumbered by an easement. Therefore, staff finds the existing 15 feet o£landscaping is compliant with UDC standards, even though, lawn is desired as previously approved. The delay in the installation of the fencing was due to the Covid 19 outbreak and fence materials are limited at this time. The applicant requests the City release all of the performance surety except £or what is required for the fencing. Staff has reviewed the public record to verify these two items ware not topic o£ discussions during the public hearing. Staff concludes there had been discussions regarding the easements and timing £or the completion of the improvements, but otherwise most o£ the concerns involved traffic impacts. The McMillan Road street buffer and fencing was otherwise not specifically discussed. As noted above, Staff has reviewed the landscape plan modification £or compliance with all applicable landscape and fence regulations. Although the lawn north of the. 5-foot detached sidewalk is being replaced with gravel based on the SID requirements, the remaining landscaping to the south sti71 exceeds the minimum requirements. Staff also understands the Applicant's dilemma with getting approved fencing installed during the Covid l9 pandemic and is amenable to releasing all of the surety except for that which pertains to the fencing. Staff finds the landscape modification is consistent with previous approvals and approves of the modifications as proposed. VI. EXHIBITS A. Vicinity Map B. Drawings 1.
