APPLICATION SUMMARY The applicant, Doug Tamura, is requesting approval to modify the site plan and building design proposed for building pad #5 on Lot 4, Block 3 in Devon Park Subdivision No. 1. II. SUMMARY RECOMMENDATION Staff recommends approval of the requested modifications to the conditional use permit, with changes and conditions, in accord with UDC 11-5B-6G. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The site is located at 910 E. Fairview Avenue (Parcel No. R1819650070). B. Owner: Fairview Lakes, LLC 732 Santa Paula Place Boise, ID 83712 C. PROCESS FACTS A. The subject application is for a conditional use permit minor modification. The Director is the deciding body on this matter in accord with UDC Table 11-5A-2. V. LAND USE A. Existing Land Use(s) and Zoning: The property is currently zoned C-G and is improved with two existing commercial buildings and two vacant pad sites. B. Character of Surrounding Area and Adjacent Land Use and Zoning: 1. North: Commercial businesses, zoned C-N 2. West: Commercial businesses, zoned C-G The Griddle Page 2 3. South: Commercial businesses, zoned C-G 4. East: Single-family detached homes in Settlers Village Subdivision, zoned R-8 C. History of Previous Actions: a. In 2002, the subject property received conditional use permit (CUP-02-014) approval for development. b. In 2006, the subject property received conditional use permit (CUP-06-032) approval to modify the conceptual planned development (PD) for Fairview Lakes/Devon Park Subdivisions pertaining to building pad #5 on Lot 4, Block 3 in Devon Park Subdivision No 1. c. In 2012, the subject property received conditional use permit (MCU-12-001) approval to modify the site plan and building design proposed for building pad #5 on Lot 4, Block 3 in Devon Park Subdivision No. 1. VI. STAFF ANALYSIS The applicant is requesting a modification to the existing conditional use permit (MCU-12- 001) to amend the site layout and building design (elevations) for building pad #5, Lot 4, Block 3 of Devon Park Subdivision No. 1 as shown on Exhibit A.3 and A.5. The modification to the site/landscape plan and building design are desired by the applicant to construct a 3,464 square foot restaurant (The Griddle) on the vacant building pad north of Banner Bank at Fairview Lakes. The Unified Development Code (UDC) (11-5B-6G) authorizes the Director to approve or deny specified minor modifications, provided such modifications were not the subject of review during the original public hearing and will not adversely impact adjacent properties. Such minor modifications include, but are not limited to the following: 1. Minor relocation of dwelling units or building pads for practical reasons such as road alignment, topography or access. Staff has reviewed the site/landscape plan and elevations provided with this application and has determined the site area, parking, and building pad location are generally consistent with the current approval for this site. However, the building elevations proposed do not meet the design standards in the Architectural Standards Manual for commercial properties in the C-G zoning district and the building design lacks cohesion in materials and that are similar to the surrounding buildings within the subdivision. Therefore, Staff hereby approves the modifications proposed to the site/landscape plans and elevations submitted by the applicant as conditioned in Section B below. VII.EXHIBITS A. Drawings 1. The applicant shall meet all applicable terms of the conditional use permit (CUP-02-014) and the modification to conditional use permit (MCU-12-001). 2. The proposed site/landscape plan as shown on Exhibit A.3 is approved, however; the proposed elevations as shown on Exhibit A.5 do not meet the design standards in the Architectural Standards Manual. Additionally, the proposed elevations are not consistent in design and use of materials with the surrounding buildings within the subdivision. The approved elevations as shown on Exhibit A.4 meet the design standards in the Architectural Standards Manual and provide a cohesive design with the surrounding buildings within the subdivision. 3. The applicant must obtain certificate of zoning compliance (CZC) and administrative design review (DES) approval for the site/landscape plan and propose a building design that is consistent with the elevations as shown on Exhibit A.4.
