We agree with all the conditions except the following: VIII.A.1f – “A tot-lot amenity shall be added to the central open space lot (Lot 1 Block 2) prior to receiving any certificate of occupancy.” Per UDC 11-3G-3C, the size of our plat requires a least one (1) site amenity and we selected a shade structure and picnic area. The code is designed to add amenities proportionately as the size of projects increase. Our application meets the code with one amenity because of its size. We request this added condition be removed. Removal of this conditions will also require condition VIII.A.2b be removed. VIII.A.1g – “All common drives shall serve no more than two (2) lots.” Our plat has four (4) common driveways. Each provides access to three (3) lots. UDC 11-6C-3D allows common driveways to serve a maximum of six (6) dwelling units. Our design meets the code by providing half the allowed maximum. We request this added condition be removed. These items are scheduled to be on the City Council agenda on May 26, 2020. The public hearing will be held at City Hall, 33 E. Broadway Avenue, beginning at 6:00 pm.
