Dear Caleb Hood,
Toll ID I LLC, hereby applies for an Alternative Compliance for the pathway landscaping and
easement width at Bicentennial Farm Subdivision No. 1. This application will specifically apply
to Lot 1, Block 1, address 6393 S Arable Way.

We are requesting alternative
compliance to UDC 11-313-12C
that requires a five -foot -wide
landscape strip on either side of
the pathway. As you can see in
Figure 1, the site has been
constructed with just the 5' wide
landscape strip on one -side of the
pathway. We are requesting to
modify this requirement with only
one side of the landscape strip
As the pathway extends into the common lot in Figure 2, it then meets the requirement of having
a 5' wide landscape strip on both sides of the pathway. The subdivision lots surrounding the
pathway have been constructed,
sold and utility services have been
installed, leaving options to shift
the location and construct the
pathway to be in compliance with
UDC requirements impossible to
meet.

Unfortunately, during the
construction of this phase there was
a change in management, as a
result this small area was an

unfortunate oversight. We apologize for this breakdown in communications and hope the City
will consider this pathway's interconnectivity with Brighton's Century Farms Development as a
benefit for both communities in their consideration of this application. The total footage of the
sidewalk path, within Figure 3, illustrates we are out of compliance by 91.3 feet.

In addition, we added additional landscaping that was beyond our approved landscape
requirements by enhancing Phase 1 entry frontage berm with addition plantings. We also
improved the pond with additional landscaping by adding extra trees and bushes, please see
attachment.
