Roberta,
Typically the curb location is the ultimate ROW. I am more concerned with the ROW along Meridian Road. If ITD widens
the road I want to make sure that there will be a 35-foot wide landscape buffer in place after the widening. I hope this
provides clarity.

Hi Bill: Oops, I spoke too soon. I’m not sure if we have a problem or not with the Staff Report for Victory Commons. I
think there is actually a simple “mis-statement” on page 7 of the report (Landscaping section) that may need to be
clarified. The Report states that the landscape buffer is to be measured from the “ultimate right-of-way” in conformance
with UDC 11-3B-7C1.c. See excerpt below:
According to Horrocks Engineers, the measurement is typically from back of curb, not ultimate right of way. It seems
like Section 11-3B-7-C1a(2) is the more pertinent code section. See excerpt below. It states that street buffers with
detached sidewalks shall be measured from back of curb. Additionally, when I look at UDC 11-3B-7C1.c as cited in the
Staff Report, it pertains to an alternative compliance application when undue hardship exists. Is it possible that the Staff
Report requirement of “ultimate right-of-way” is a misstatement?
