Subject: Postponement Request of Delano Application Scheduled for May 12 City Council
Dear Mayor Simison and City Council Members,
On behalf of the residents of Alpine Pointe HOA, we are respectfully requesting a postponement of the City
Council item pertaining to the Delano application scheduled for the May 12 City Council meeting until the City
Council meetings are once again open to the public for in-person testimony. Now that Meridian City Hall has
re-opened, one can believe that City Council meetings will once again be available for public testimony soon.

As you know, there has been a great deal of interest by our residents regarding this project. When we had been
allowed to participate in the process as was designed, in-person testimony, we have had anywhere from 50-85
residents in attendance at the various ACHD, P&Z and City Council meetings.
The virtual meeting as designed is putting our residents at a distinct disadvantage by not being able to be seen
and to be present for testimony. The virtual meeting as designed is flawed. The council members are not able to
see just how passionate our residents are about this project, to ensure it is properly vetted. There was no way for
the P&Z members to know how many residents participated on You Tube……and Zoom did not allow our
residents to be seen. Yet the Delano rep was seen by the P&Z members but not one of our residents was visible
to the P&Z members……that is not a fair due process.
And based on an email from Chris Johnson dated April 14, there were known flaws in the Zoom virtual process.
This undoubtedly led to frustration by many of our residents not to participate. Do not allow this matter to be
heard using a flawed system (as your staff has indicated) since in-person testimony can be heard within a few
weeks. If it’s an open meeting, our residents will definitely participate, which is their right as citizens of
Meridian.
At the P&Z meeting a few weeks ago, there was no way for the P&Z members to know just how many of our
residents wanted to participate. There was considerable concern, and justifiably so, that the Zoom format was
possibly hackable. This caused many residents to either not participate or to use the You Tube version only. The
You Tube version only allowed residents to watch, no testimony was allowed via You Tube. It was very
difficult to hear the P&Z members clearly due to the connectivity at my house so I’m sure many other residents
were experiencing the same issue…..again, not a fair due process for our residents.
In addition, since our residents consist of a large population of elderly citizens, many do not have access to
participate by computer or they do not have the knowledge to do so. Yet, when it’s a live testimony at City Hall,
they are more than capable of driving there to participate. Again, the current virtual format is a distinct
disadvantage to our residents, your citizens. Also, based on the discussion by the P&Z members, they obviously
did not read the many letters and submissions of written testimony by our residents. While I have great respect
for the efforts of the City Council members, we all know that nothing beats the opportunity to be seen AND
heard, especially about this very important matter.
We are asking that you postpone the Delano application until in-person testimony is once again possible, so that
our residents are provided their due process in this matter.
