Request for Vacation of the Public Utility Easement on Lot 8, Block 20 of Paramount
Subdivision No.4, by Paramount Development, Inc. (File No. VAC-O5-009).
We have reviewed this submittal and offer the following comments, as conditions of the Applicant.
These conditions shall be considered in full, unless expressly modijìed or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The Applicant, Paramount Development, Inc., requests the City's consent to vacate a platted public
utility, property drainage, and inigation easement on Lot 8, Block 20 of Paramount Subdivision No.
4., located at 630 W. Barrymore Drive.
The Applicant requests the vacation of the easement due to a lot line adjustment which relocates the
north property line of Lot 8, which said easement is centered on. Specifically, the applicant has
requested vacation of "The 5 foot wide public utilities, property drainage, and inigation easement on
the northerly boundary line of Lot 8, Block 20 of Paramount Subdivision No.4, excepting the 10
foot wide utilities easement on the east and west sides of said Lot 8." The easement was created on
the plat of Paramount Subdivision No. 4, with Notes #1,4, and 5. The applicant has provided proof
of relinquishment of the easements by Qwest Communications, Intermountain Gas Company, Idaho
Power Company, and Settlers Irrigation District. The applicant has not submitted notarized proof of
relinquishment from Cable One. (See Condition of Approval #1)
Idaho Code 50-1325 requires that all easements created on subdivision plats "shall be vacated in the
same manner as streets" and must be approved by the local jurisdictions. State statute further requires
an easement vacation be filed when a landscape or inigation easement is involved. Even though the
other types of easements can be addressed through Letters of Agreement (e.g. drainage, gas,
telephone, etc.), the landscape and inigation easements are not specifically exempt under I.C. 50-
1306.A, and must be formally vacated through the standard process.
All easements not specifically vacated shall remain intact.

SPECIAL CONSIDERATIONS
1. Process: The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the
Planning & Zoning Commission to review and make a recommendation on Vacation
applications. A public hearing is then required before the City Council.
CONDITIONS OF APPROVAL (V AC~O5~OO9)
1. The applicant shall submit notarized proof of relinquishment of the easement by Cable One
prior to the City Council hearing on the application.
RECOMMENDATION
