Request for Vacation of the Five-Foot Drainage, Pressure Irrigation, Public Utility,
Construction and Maintenance Easement Adjacent to all Lot Lines Not Fronting a
Public Street or Private Road in Honor Park Subdivision No.3, by Franklin/Stratford
Investments, LLC (Robert Russell) (File No. V AC-O5-008).
We have reviewed this submittal and offer the following comments, as conditions of the Applicant.
These conditions shall be considered in full, unless expressly mod(fied or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The Applicant, Franklin/Stratford Investments, LLC, requests the City of Meridian's consent to
vacate platted easements in Honor Park Subdivision No.3. The subject subdivision is located at the
southwest comer ofE. Franklin and S. Stratford. There are nine existing easements to be vacated, as
depicted on the exhibit in the application. All ofthe easements were created via the original plat for
the purpose of drainage, pressure irrigation, public utility, construction and maintenance. While the
application does not state the reason for the vacation, it is staffs understanding that the applicant
desires more flexibility to locate buildings and adjust lot lines for future development.
The Applicant owns nine of the 17 building lots in Honor Park Subdivision No.3. The vacation
request applies to the interior lot lines within each ofthose lots. Two ofthe nine lots (Lot 27 and Lot
16, Block 2) propose to vacate five-foot easements which abut matching easements on lots the
Applicant does not control (Lot 28 and Lot 12, Block 2). Vacating the five-foot easements on these
two lots would result in a single five-foot easement remaining on Lots 28 and Lot 12 (versus the
standard ten-foot wide easement). While this may not pose a problem for these adjacent lots, we
question the need to vacate these two easements, especially since lot line adjustments are unlikely in
these two locations. Staff is recommending the easements on the south side of Lot 16 and the west
side of Lot 27. Block 2 remain intact and not be vacated at this time. We also request the Applicant
address his understanding of the purpose of the "construction and maintenance" portion of the
platted easements at the Commission and City Council meetings.
The Applicant has provided proof of relinquishment of the easements by Cable One, Qwest

County Highway District also submitted a letter of no opposition. However, Idaho Power Company
has not provided consent for any of the proposed easement vacations.
Idaho Code 50-1325 requires that all easements created on subdivision plats "shall be vacated in the
same manner as streets" and must be approved by the local jurisdictions. State statute further requires
an easement vacation be filed when a landscape or irrigation easement is involved. Even though the
other types of easements can be addressed through Letters of Agreement (e.g. drainage, gas,
telephone, etc.), the landscape, maintenance and irrigation easements are not specifically exempt
under I.C. 50-1306.A, and must be formally vacated through the standard process.
All easements not specifically vacated shall remain intact.
SURROUNDING USES
North - E. Franklin Road and C-G (General CotnIllercial) and I-L (Light Industrial) uses
South - Warehouse and light manufacturing uses within Honor Park Subdivision, zoned C-G
(Commercial)
East - S. Stratford Drive and Meridian Cemetery, zoned RUT (Ada Co.)
West - Storey Park (baseball/softball diamonds), zoned C-G (CotnIllercial)
OWNERS OF RECORD
The owner of record of the lots on which the proposed easements to be vacated is Franklin/Stratford
Investments, LLC. Robert Russell, Manager, has provided notarized consent for Tealey's Land
Surveying to submit the application.
SPECIAL CONSIDERATIONS
1. Process: The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the
Planning & Zoning CotnIllission to review and make a recotnIllendation on Vacation
applications. A public hearing is then required before the City Council.
CONDITIONS OF APPROVAL (V AC-O5-008)
1. Applicant shall submit a relinquishment letter for the proposed vacations from Idaho Power
Company prior to the City Council hearing.
2. The five-foot easements located on the south side of Lot 16, Block 2 and the west side of Lot 27,
Block 2 are not approved and shall remain as currently platted.
RECOMMENDATION
Staff recotnIllends approval of application V AC-05-008, with the conditions as noted above.
