Request for Vacation of portion of the 10- foot wide easement centered on the interior
common lot line of Lots 1 and 2, Block 2, Olson and Bush Industrial Park
Subdivision, by Dennis Kelley and Walter Sigmont (File No. VAC-O5-007).
We have reviewed this submittal and ofJer the following comments, as conditions of the Applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The Applicants, Dennis Kelley and Walter Sigmont, request the City's consent to vacate platted
easements in Olson and Bush Industrial Park Subdivision. The subject subdivision is located at the
intersection of Lanark Street and Eagle Road.
The Applicant requests the vacation of the easements so that owners may not be encumbered by
platted easements which run through the center of a parking lot and will not be used. The portion of
the easement to be vacated is described as follows: "The 10-foot wide easement centered on the
interior common line of Lot 1 and 2, Block 2, Olson and Bush Industrial Park Subdivision, except
the north 10 feet adjacent to Lanark Street and the south 10 feet adjacent to the southerly boundary of
Lots 1 and 2." The easement was created on the plat of Bush and Olson Industrial Park Subdivision,
as "Easements: 10' along exterior lot lines, 10' centered on interior lot lines, others as noted hereon".
The applicant has provided proof of relinquishment of the easements by Cable One, Qwest
Communications, Intermountain Gas Company, and Idaho Power Company.
Idaho Code 50-1325 requires that all easements created on subdivision plats "shall be vacated in the
same manner as streets" and must be approved by the local jurisdictions. State statute further requires
an easement vacation be filed when a landscape or irrigation easement is involved. Even though the
other types of easements can be addressed through Letters of Agreement (e.g. drainage, gas,
telephone, etc.), the landscape and irrigation easements are not specifically exempt under I.C. 50-
l306.A, and must be formally vacated through the standard process.
All easements not specifically vacated shall remain intact.

1. Process: The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the
Planning & Zoning Commission to review and make a recommendation on Vacation
applications. A public hearing is then required before the City Council.
