PINE STREET SCHOOL AGREEMENT
y~ This Agreement made and entered into this / / ~~ day of
/~~ , 1994, by and between the CITY OF MERIDIAN, first
party, hereafter referred to as "CITY", and JOINT SCHOOL DISTRICT
N0. 2, ADA AND CANYON COUNTIES, party of the second part, hereafter
referred to as "SCHOOL",
WHEREAS, parties, jointly, undertook a project to rehabilitate
the Pine Street School house in the northwest corner of the
intersection of Pine Street and Meridian Road, described as
WHEREAS, the rehabilitation of the Pine Street School was
designed, and was, part of the Centennial celebration for the City
of Meridian;
WHEREAS, the above described property is owned by the SCHOOL
but the CITY has an interest in preserving the Pine Street School
as part of the CZTY'S heritage;
WHEREAS, it is the intent of the parties to share the costs of
the care and maintenance of the Pine Street School as equally as
possible;
NOW, THEREFORE, It is agreed by and between the parties as
follows:
1. It is agreed that the above recitals are incorporated herein
as if set forth in full and are contractual and binding
between the parties.
2. That the term of this agreement shall be from the date hereof
until it is terminated as provided far in Paragraph 8, below.
3. That the SCHOOL shall provide and pay for the following cost
relating to the Pine Street School:
a. Fire and casualty insurance.
b. Electrical power and maintenance.
c. Water.
d. Winterization of water and sprinkler lines.
e. Janitorial service of minor maintenance, vacuuming,
dusting, snow shoveling, etc.
f. Scheduling of use of the Pine Street School, which
include key checkout, opening for guests, Pine Street
Schaal groups, collecting deposits if necessary, etc.
4. That the CITY shall provide and pay for the following cast
relating to the Pine Street School:
a. Lawn care and upkeep including mowing, [$~W}edging,

fertilizing, sprinkler repair, etc.
b. Maintenance and upkeep including care for the
schoolhouse, outhouse, playground equipment, signs, steps
and ramp, repair of wear and tear, vandalism damage,
window breakage, furnace repaiz, painting, repairs, etc.
c. Intermountain gas casts.
d. Liability insurance.
e. Janitorial service of extezior window cleaning, step and
ramp cleaning.
f. Receiving calls for repairs, reports of damages, etc. of
which shall be relayed onto the SCHOOL and shall be
monitored by SCHOOL.
5. That the parties shall equally share all liabilities,
whatsoever, of the Pine Street School not coveted by insurance
on the Pine Street School, and agree to hold harmless and
indemnify the other party to the extent of one-half (1/2) of
any liability enforced yr collected from the other party.
6. That in the event action, not including legal action, or legal
suit be instituted by either party to enforce this agreement,
the prevailing party shall be entitled to its costs and
attorneys fees.
7. It is specifically agreed by the Parties that neithez Party
shall assign or transfer, in any fashion, their intezest,
right, duties ox obligations in this Agreement or the Pine
Street School without the written consent of the other party.
8. That either of the Parties to this agreement may terminate it
by first giving the other party sixty (60) days prior written
notice of intent to terminate the agreement. This is the only
fashion in which this agreement may be terminated.

Enclosed is the invoice for the "open" sign for Pine Street School. You had agreed to pay this
cost. The lettering was for a three sided sign, which explains the three sets. Thank you very
much.
The old school clock has stopped working. The school district maintenance department is trying
to fix it. I might need to call someone if the district man cannot figure out the problem.

I am writing to you in regards to a project that our department was involved in for Pine
School. We chose the Pine School as our Neighborhood Day project. I believe Trish
Dunkle was the coordinator that worked with you to set this up. There were some expenses
that were associated with the work that we did, and my understanding was that you had
agreed to pay them. The expenses were for paint, linseed oil and some other cleaning
supplies. I believe that you have the receipt from HomeBase, and I have one more from
Columbia Paint for $60.85. I apologize for the lateness of contacting you. I have enclosed
the copy of the bill from Columbia Paint.
We all enjoyed working at the Pine School, and would like to try and help again next year.
I will contact you as soon as possible to see if there are any questions or if there is any more
information that I can help you with. Please feel free to give me a call at 344-7117 if you
wish.
