Fairview Avenue Variance Request Waiver Request Dear City Council: On behalf of our client, Mr. Gerry Sweet at Intermountain Outdoor Sports, we are submitting preliminary and final plats for the subdivision of the property at 1375 E. Fairview Avenue. In accord with the requirements of the Meridian Subdivision Ordinance we are also requesting a variance to the landscaping requirements for the preliminary and final plats. The variance is being requested due to the adverse impact · that meeting the ordinance requirements would have on the existing Intermountain Outdoor Sports retail store located at the site. In addition, we request a waiver of the requirement for pressure irrigation where a water right is established. As background, the plat request is for the purpose of subdividing the property to sell the unused lot adjacent to the existing Intermountain Outdoor Sports Store at the comer of Fairview Avenue and Stonehenge Way. This simple subdivision of property will provide for the development of one to three commercial businesses at that comer. Such development will be an asset to the City of Meridian and her citizens. The plat aPplication includes requirements that a new landscaping buffer be built along the Fairview Avenue frontage of the existing Intermountain Outdoor Sports Store. The current landscape ordinance requires a 35-foot landscape buffer be located adjacent to and outside the right-of-way. A landscape buffer already exists along the Fairview Avenue frontage. It is constructed in a slight berm, six feet wide, and heavily landscaped with seven 6-inch caliper trees spaced at 35 feet on center. There are approximately 30 mature shrubs intermingled with the trees. The landscaping was installed when the Intermountain Outdoor Sports Store was constructed. The current landscape ordinance would require this mature landscaping to be destroyed. The new wider buffer would necessitate the removal of an entire row of paved parking spaces, including curbing, in front of the existing stOre. The reduced parking would then put the existing retail store in non-compliance with the Meridian parking ordinance. We are asking for a variance that the requirement for a landscape buffer be satisfied with the eiisting mature landscaping located on the portion of the site in front of the existing store. The mature landscaping continues along the Falrview Avenue frontage adjacent to the empty lot. This landscaping then continues south along the entire frontage of Stonehenge Way. Stonehenge is a local street. The landscaping was installed in 1992 for the Danbury subdivision that was developed to the south. We are requesting a variance to the landscape guidelines that would require that a new landscape buffer be installed and put in a common lot. The existing landscaping includes nine 2-8 inch caliper trees, plus various shrubs and is adequate for the site. In addition, the existing landscaping can be used as a common theme for the entire site and landscape plans will be designed and reviewed by Design Review during the development of each of the new commercial lots: The existing landscaping does not have to be located in a common lot to be maintained. The landscaping can be located in an easement as shown on the preliminary plat and will be maintained by a property owners association. Maintenance can be outlined in CC and R's that can be submitted to the City prior to signature on the final plat. The requirement that the landscape buffer be put in a common lot would also reduce the number of buildable lots that we can subdivide using this process. Perimeter landscaping around each new lot would also be required with the subdivision of the property. Such landscaping will additionally impact parking by requiring the removal of 20 parking spaces along the west side of the existing building. Perimeter landscaping will also preclude cross access between the parcels that is being encouraged by the city, as is the shared driveway on Fairview Avenue. We are asking for a variance that the perimeter landscaping requirement be waived between the existing building lot and each of the 3 new lots. The existing landscaped areas are currently irrigated by an approved system using municipal water. This irrigation system serves the landscape planting along Fairview Avenue and Stonehenge Way. The system is adequate and should not be replaced with a pressure irrigation system. We are asking that the requirement for a pressure irrigation system be waived for this subdivision. We respectfully request that the above described variances and waiver be granted for the simple subdivision of this commercial property. We are also requesting a waiver for pressure irrigation. There is existing landscaping on the project site installed in 1994 with the construction of the existing Intermountain Outdoor Sports store. Providing landscaping according to the ordinance would necessitate the removal of mature landscaping and also remove parking that would put the retail store into non-compliance with the parking requirements. We ask that the existing landscape in front ofthe store be allowed to remain as constructed along Fairview Avenue. We ask that the existing landscape on the undeveloped portion of the site be allowed to be located in an easement instead of a common lot. We request that the perimeter landscaping between each lot be waived so that cross access and cross parking can occur. We request a waiver of the pressure irrigation requirement so that the existing sprinkler system, supplied by municipal water, doesn't have to be ripped out and replaced with a new irrigation system. The installation ora landscape buffer according to the ordinance would require the removal of an entire row of parking spaces, causing the existing retail use to be in non-compliance with the parking requirements for that use. If the landscape buffer is required to be located within a common lot, we would not be able to use the short plat process (for up to 4 lots), since the landscape lots would create a subdivision with 5 or 6 lots. The perimeter landscaping around each lot would first necessitate the removal of existing parking along the west side of the existing building, causing the store to be in non-compliance with the parking requirements. In addition, the perimeter landscaping would be located down the common drive aisle. The landscaping would interfere with the cross access that the common drive allows. Cross parking would also become more difficult with only limited passage between the lots. 10. 11. 12. 13. 14. The landscape ordinance is written for development of empty land. This site has an existing building, constructed in 1994, and landscaping that was design and installed as approved through the City of Meridian. The use of the common driveways on Fairview Avenue is in keeping with limited curb cut and access on that busy arterial. Requiring perimeter landscaping that would run down the driveway aisle is an unusual circumstance that should be handled by waiving the need for the perimeter landscaping. As noted above, the site is already developed with an existing retail store, including landscaping that was designed and installed for that development. That landscaping is now mature. The method of addressing the landscape requirements for sites that have existing development is through this variance process, whereby special considerations and accommodations are made. Other properties subject to the terms of this ordinance do not typically have existing development on the site. Compliance with the landscape requirements creates a non-compliance situation with the parking requirements. Landscaping along Fairview Avenue was installed within the Fairview Avenue right-of-way which was reviewed and approved by the City of Meridian and ACHD. The applicant followed these requirements, certainly not intending to rip out the mature landscaping only 8 years later. The sprinkler system was also installed according to City requirements and has served the site adequately for 8 years. In granting the variance request, the applicant will still have to meet the intent of the landscape ordinance by providing landscaping along roadway frontages. The landscape buffer requirement will be satisfied by the existing mature landscaping that was installed during development of the site, indicating that no special privilege is being granted this applicant. In addition, each of the new development sites will still be required to comply with development ordinance and design review as are other similarly developed sites. The applicant will only gain convenience by not having to rebuild a landscape buffer with juvenile planting where a buffer of mature plantings already exists. The variance for the perimeter landscape requirement does not particularly profit the applicant but does provide a convenience to the Meridian citizen/shopper who can more easily access the uses by a common driveway and find parking for the uses in more commonly situated parking. The waiver for the municipal sprinkler will convenience the applicant by not requiring an unneeded replacement of the existing irrigation system 15. The Meridian Comprehensive Land Use Policy 4.3U includes language to "encourage new commercial development within under-utilized existing commercial areas." The policy can be met by understanding the particular characteristics of each potential development site and by providing opportunities for varying conditions of development approval. Providing for variance and waiver requests are ways to meet this Comprehensive Plan policy. Fairview Avenue is an entryway corridor, as addressed in the Comprehensive Plan policies on Community Design. Language in this part of the Comprehensive Plan ("Depending on the configuration of existing streets, land uses and site configuration, more extensive landscaping and more concern for site character may be required in Meridian.") shows that the Plan recognizes the variability in each development site and variations in the requirements that must be allowed.
