Project Name
Approximately'/2 mile south of E. Amity Road, in the SW 1/4 of the NW 1/4 of Section 31,
Project Location Township 3N.,Range 1E, east of SH-69 milepost 6.64
Construct a subdivision consisting of 60 single-family residential lots and 7 common lots on
Project Description 13.52 acres.
Applicant Schultz Development
The Idaho Transportation Department(ITD)reviewed the referenced final plat applications and has the following
comments:
1. This project abuts the State highway system.
2. This project is requesting a new public road to SH-69 at the mid-mile between Amity Road and Lake
Hazel Road, approximate mile point 6.64(right). The applicant's is in the process of submitting remaining
documentation for ITD to review and approve before an encroachment permit can be issued.
3. ITD has received,reviewed and accepted a Traffic Impact Study(TIS) encompassing the entirety of
Prevail No. 1 and Prevail No. 2 formerly known as the Percy Development.As stated in ITD's TIS
acceptance letter dated September 6,2019,the TIS has shown the need for mitigation on SH-69 for traffic
produced by the development.
4. Applicant shall construct a mid-mile public road to ACHD's standards with a minimum approach radius
of 28ft and radii between 30ft-40ft. The public road shall be centered on the mid-mile to match the platted
road on the west side of SH-69. Applicant shall construct a concrete median barrier using ITD' Type 1
Traffic Separator to limit the approach to right-in,right-out, left-in.
5. Applicant shall remove existing approach approximately 320ft north of the proposed public road. All
pavement shall be removed and area regraded to match adjacent drainage features.

6. Applicant shall work with ACHD to install a"U-Turn" sign at the intersection of SH-69 and Amity Road
for the northbound to southbound u-turn movement.
7. The City is reminded that the SH-69 corridor is already congested. This project will increase the number
of vehicle trips in the corridor. As the City continues to add additional trips to the corridor through
development,the congestion will worsen until the roadway system is ultimately overloaded and fails.
8. ITD District 3 has issued Memo 39-Development Proportionate Share Contribution as a means to request
equitable contribution from developers to improve public facilities needed to serve new growth and
development. ITD will require the developer to contribute a proportionate share cost of$33,107 for
mitigation improvements to the SH-69 corridor. This contribution covers mitigation for both Prevail No. I
and Prevail No. 2 Subdivisions. This contribution shall be paid directly to ITD and is required prior to
issuance of the ITD encroachment permit.
9. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
10. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant may contact

information.
11. ITD objects to the proposed application due to traffic concerns. ITD will withdraw any objection to the
proposed application once above described items No. 2,4, 5, 6 and 8 have been addressed with ITD Staff.
