Idaho Ave. The outdoor patio is to serve as outdoor dining for the existing tenant. Per MCC 8-1-2(C), the linear clear zone must be at least five feet (5') wide, maintained by the property owner and free of obstructions. In lieu of a linear clear zone between the use and street furnishing zones, you are proposing to provide a 5400t wide "clear zone" and redirect pedestrians through the street furnishing zone (see attachment). In your narrative, you believe the current dimensions of the area make it impractical to develop the site with a smaller patio due to the existing site conditons. It is your opinion that the proposed location of the outdoor patio enhances the approved fayade improvement and will contribute to a more active downtown. The alternate route proposed through the street furnishing zone provides the 5-foot minimum width required by City code, does not grant a right or special privilege to the property owner and should provide a safe route for pedestrians. The Director has reviewed your proposal and grants the approval based on the following: • You are proposing to relocate the existing trash receptacle and raised planter farther to the west in order to provide an alternate route and a 5-foot wide clear zone. A preferred option may be to remove the tree and relocate the tree grate closer to the street as a long- term solution. Before commencing with the modifications in the street furnishing zone, you must contact Elroy Huff in the Parks Department. • The addition of the outdoor patio will contribute towards a vibrant streetscape and provides a pedestrian element to the outside of the building. • The alternate clear zone must be 54eet wide at all times, free of obstructions and maintained in good repair by the property owner in accord with MCC 8-1-2(C and D). • Due to the existing site conditions, full compliance is impractical in accord with MCC 8- 1-2(C). • The UZEP approval is valid for one year and must be renewed annually in accord with MCC 8-1-2(B)(6). The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before November 27, 2019, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11-SA-6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. This will entail some interior modifications (submitted for via Tenant Improvement) and some exterior upgrades including the addition of an Outdoor Patio facing Main Street. Of the three windows facing Main Street, the left and right will be replaced with sectional glass overhead doors. The Left side would have railing installed in front of it (air circulation only) but the right would be open for customer circulation. This will also provide a view into the interesting Improvements planned for the interior. The patio will be rectangular in shape, enclosed in wrought iron fencing. There will be a precast concrete countertop placed along the perimeter, with any other small tabletops that will fit without crowding the space. Exterior string lights will run from the building over customers to posts mounted at the wrought iron railing with fixtures that tie back into the fixtures used on the interior. The clear zone for Pedestrian use will be relocated to be along the curb at the patio location, as well as relocating a trash receptacle and planter. To accomplish this, we must obtain a Use Zone Encroachment Permit as well as receive approval for Alternative Compliance. It is our belief the proposed design enhances the charm, appeal and marketability of the whole corner. Relocating the trash receptacle and planter further enhances the pedestrian Clear Zone and provides the same opportunities for circulation as is available currently. In nearby downtown areas, the grate around the tree is used to obtain the 5' wide pedestrian zone so using it at this location will not be detrimental to the public or noncompliant. Said current pedestrian path also crosses an existing curb cut (to remain) but still maintains 5' clear. Our alternate design is larger and more comfortable, making it more usable and ultimately bringing more people and activity to that corner. The design would not be detrimental in any way to the public nor impair the rights of neighbors of the Hop Haus to use the Use Zone in front of their space.
