Request for a One-Year Time Extension on the approved Conditional Use
PermitlPlanned Development for Buich Subdivision, by Pinnacle Engineers, Inc. (File
No. TE-05-007).
We have reviewed the above referenced submittals and offer the following comments as conditions
of approval. These conditions shall be considered in full, unless expressly modified or deleted by
motion of the Meridian City Council:
APPLICATION SUMMARY & BACKGROUND
The applicant, Pinnacle Engineers, Inc., has requested approval of a one. year time extension on the
approved conditional use permit/planned development (CUP-03-048) for Buich Subdivision. The
approved planned development consisted of a nursing home facility for up to 40 patients and 5 office pad
sites with reduced setbacks, reduced landscape buffers, and reduced landscaping along Cherry Lane.
The conditional use permit/planned development was approved by City Council on February 10, 2004.
The applicant has submitted their request for a time extension within 18 months of the original approval,
as required by MCC 11-17-4.
The applicant states that the reason for the delay in commencing construction is that the site layout was
modified (a lot was removed and another lot was enlarged) in order to make the project more marketable
which required revision ofthe improvement plans. For this reason, they are unable to meet the time
requirements as specified in MCC 11.17-4.
LOCATION
The property is located on the north side ofW. Cherry Lane, approximately ~ mile west ofN. Linder
Road, in the SE ~ of Section 2, T.3N., R.l W.
RECOMMENDATION
Planning and Zoning staff recommends approval of the requested one year time extension on the
approved conditional use permit/planned development for Buich Subdivision.
