Idaho Meridian, Idaho 83642 Re: Request for Reconsideration of Ashtyn Park Annexation and Rezone Denial Dear Mayor De Weerd and Council Members: On June 28, 2005, I appeared before you for the hearing of my application for annexation and rezoning of Ashtyn Park. As you are aware, the subject parcel has the unique characteristic of being partially residential and partially public/quasi-public, in designation. In retrospect, I recognize that my testimony presented two L-O rezoning options based on either of these designations, and this led to confusion that affected the entire application. I have since met with the P & Z staff and recognize the shared concerns of you and the staff, that the use of this property must be such that the intent of the comprehensive plan is fully protected. I sincerely apologize to you for any misunderstanding or confusion that may have resulted from my testimony. I was completely unaware that I could or should consult the staff, concerning my thoughts or testimony, in between the P&Z Board decision and the Council meeting. I inaccurately believed that after the P & Z hearing, the Board and staff were no longer involved in the process and it was only a City Council function. This is my fITst effort at any type of development and I confess to being a novice and naïve to the process, so there has been a substantial learning curve associated with this application experience. Because I am not a professional developer, I have approached this as a project that is very personal (naming it after one of my grandchildren) and I have worked hard to establish relationships with the adjacent neighbors, property renters, as well as personally being involved in the background work on irrigation, arborist concerns and site plans. My purchase of this property is contingent upon L-O rezoning, so I am concerned about the financial impact of starting this process over again, as well as doing a full plat workup, at this stage in the purchase and development process. At this time, I wish to assure to you that the conceptual plans, submitted in the staff report for the L-O development of this property, are an accurate reflection of my intentions for design and use. I am in full support of the P & Z Board and statfrecommendations submitted to you for approval of the limited L-O zoning designation for the entire parcel, pursuant to the December, 2004 special resolution # 04-454. By way of the required development agreement, included in the staff recommendations, I am willing to address any concerns you may have, or the expressed concerns of the adjacent neighbors for fencing, lighting and traffic considerations. Although my efforts at the Council meeting were sincere and well intended, it is clear that they led to unanticipated complexities and confusions, which I regret. Accordingly, I ask that you please look favorably upon my request for reconsideration, and that you provide this opportunity at the next council meeting that city notification rules and regulations will allow.
