AGREEMENT BETWEEN THE MERIDIAN POI.ICE DEPARTMJ<:NT AND THE
MERIDIAN SCItOOL DISTRICT
SCHOOL RESOURCE OFFICER AGJ:ttEMENT
THIS AGREEMENT, effective January 1,2005 is entered into by the City of Meridiàn,
a political subdivision of the State of ,Idaho through, the Meridian Police Department and Joint
Schoo1 District Number 2, Meridian, Idaho, hereinafter referred to as the "District."
WHEREAS, the District d/-;sires increased .law enforceme1t services from the City of
Meridian, through the Meridian Police Department; and
WHEREAS. the City of Meridian and the Meridian P01ice Department desire to
provide increa$ed law enforcement services to the District through the Meridian Police
Department; and
WHEREAS, the parties recognize their mutual interest can be fuIth~red through the LIse
of the School Resource Officer Program of the Meridian police Depattment;
NOW~ TH"ERBFORE, for and in ~onsideratioll of the mutual covenants and promises
contaIned herein, the parties agree as follows:
1.
Interoretation of Benefit. This Agreement shaH be for the sale benefit of the
District and The City of Meridian and shalt not be interpreted to benefit third parties. The
re1ationship of the pa.rties hereto îs that of contractor and independellt contractor, and it is expressly
understood and agreed that each party and thtìt officers, agents~ and emp1oyces do not in any way
Mr for any purpose become a partnet, ageut,joint venture, servant, or employee of the other.
2.
Basic Services. The Meridian Police Department, shaH provide Scho01 Res~rcc
Officers (SRO) services at Meridian High School, Meridian Middle SchooL Lewis and Clark
Middle School, and the Sawtooth Middle School as referenced in Pa.ra.grapn 3 below, including, but

not tÎmited to: investigating and, where possible, preventing crimes aga,inst persons or property;
identifying and arresting vìolators of stat~ and local laws; :filing investigative reports and other
required reports or docuJ:l1ents; patrolling; and, to a limited extent, maintaining building secLlrity~
controlling traffic, and enforcing traffic taws (but not District estabIished.parking regulations)- It is
understood that the Meridian Ponce Department is not required to provide traffic control services
for special events held 011 any campus ll11der the control of the District, nor is the Meridian Police
Department required to provide additional personnel for those purposes except under the terms
provided in Paragraph 13 herein.
3.
Personnel Assi~lJ1ents. a) The Meridian Police Department shaH place one
School Resource Officer at Meridian High Sc:hoo1, and one Scho01 Resource Officer at Meridian
Middle School, Lewis 9.nd Clark Middle School, and Sawtooth Middle School with the School
Resource Officer's time split in a manner agreeable with the School District Administration and
affected scho01 principals. b) When it becomes necessary to select a new or replacement School
Resource Officer for Meridian High School or the Meridian Middle Scl1ools, the Meridian Police
Department policy shan govern the procedure; however, the Meridian School District shall be
al1owed the opportunity to provide input into the selection of the School Resource Officer, 'however
the fina1 assignment decision wil1 rest with the Meridian Police Departll1ent-

Officer Duties. The Merídian Police Department shall have the discretion to
detennine how the Officer perfonl1ing the duties under this Agreement will be deployed and the
manner in which the seTVices contemplated by tJlis Agreement shall be provided. The parties agree
that the interiörs of bui1dings will not be patrolled by Officers except as is necessary to investigate
crimes and apprehend criminal suspects, however, the Officer sha1l maintain high visibility with
students during breaks and lunch periods. The School Resource Officer shaH bE: an active mel11bcr

student or removed the student from campus, as the case may be, and may further
state that additional information may be obtained by contacting the Meriðia.n
Police Department. Liabi1ity arising from sueh actíons shall be governed by
paragraphs i.7 and 18.
iv. If a student's parent or guardian contacts the principal about interviews
conducted by 3. Meridian Police Officer, the principal may disclosc s.ny
infonnation concerning school matters, but will refef questions r¡¡:garding criminal
issues or investigations to the Meridian Police Department.
7. Trainiml. Schedu1ing and Activi1Y Log. a) Meridian Police Department shall
use suitably trained Meridian Police Officers in meeting the obligations contained in paragraph 3(a)
above of this Agreement. Throughout the tern of this Agreement, the Officers will be assigned
School Resource Offi.cer duties at the assigned schoo] as their primary du1y, If the SRO will be
absent from the assigned scho01 for a full day the SRO shaH notify the school principal in advance
or as soon as practical. Emergency situations shaH be handled by the Di"trict by utilization of the
Emergency 911 system at other District approved procedure.
b) Scheduling shal1 be mutually agreed upon by the assigned schoo! principal and the
Meridian Potice Department.
c) The School Resource Officers wi] provide the assigned pritlcipal with an Activity
. Log indicating where and on what school activities he or she was involved dllring the priör week, if
requested by the assigned pritlCÎpal.
8.
Meridian Police Department School Resource Officers shall be given a.
performance evaluation annually as required by City of Meridian. The evaluating supe'rvisor will
discuss the perfonnance of the School Resource Officer with the principal of the as5Îgned schoo1.

This amount is included is the total amount of the Agreement noted in
paragraph 12.
b) Districts Schools other than Meridian High School and the MerÎdian Middle
Schools.
The remaining secondary and elementary scho01s in the District that are within the
incorporated area of the City of Meridian shall have a Meridian police Department Detective
assigned to the area however, that assignment in not within the tel1Tls of this Agreement. Specific
law enforcement 8CrV1ces to the District's secondary schools in this area are at the sole discretion of
the Meridian Police Depa,rtment. The Meridian Police Department will work eJosely with the
school principals ofthose secondary schools regarding law enforcement needs.
14. Office Space. The District agrcc8 to provide Officers with adequate office space
and suitable desks chairs, and telephone for the purposes ofthis Agreement.
15. EmpJo'ymcnt. It is acknowledged by the parties that the Meridian Police Officers
acting pursuant to this Agreement are not the employees or agents of the District or schools within
the District, but rather, they remain the employees of The City of.M¡¡:ridian.
16. Authorized Absence~. Law enforcement Officers acting pursuant to this
Agreement may be abS<':1:1t from their assÎgncd campuses on holidays observed by The City of
Meridian, as well as hoHdays observed by the District, in addition to sick leave time and authorized
vacation time-
17. District to Hold the Cit}: of Meridían Harmless. In the evçnt the City of Meridian
or any of its officers, agents, employees, insurers. or indemnitors have any clairn. demand, suit, or
judgmcnt a,sserted against them which arises from acts or omissions of thE: District, its Officers,
agents, or employees, the District shan, at its expense, defend and indemnifY the City of Meridian,
its Officers. agents, employees, insurers, and indemnitors, and hold them harmless,
