AGREEMENT BETWEEN THE MERIDIAN POUCE DEPARTMENT AND THE
MERIDIAN SCHOOL DISTRICT
SCHOOL RESOURCE OFFICER AGREEMENT
THIS AGREEMENT, effectîve January 1,2005 is entered into by the City of Meridial1,
a political subdivision of the State of Idaho through, the Meridian Police Department and Joint
Schoo1 District Number 2, Meridian, Idaho, hereinafter referred to as the "District."
WHEREAS, the District desires increased law enforcement services from the City of
Meridian, through the MeridiàI'l Police Department; and
WHEREAS, the City of Meridian and the Meridian P01Îce Department desire to
provide increased law enforcement services to the District through the Meridian Police
Depa.rtment; and
WHEREAS, the parties recogni7.e thcir mutual interest ca.n be furthered through the use
of the School Resource Officer Program of the Meridian police Department;
NOW~ THEREFORE, fOf and in consideration of the mutual covenants and promìses
contained herein, thè parties agree as follow~:
1.
Interoretation of Benefit. This Agreement shaH be for the sole benefit of the
District and The City of Meridian and shan not be interpreted to benefit third parties. The
re1ationship of the parties hereto is that of contractor and independent contractor, and Ît is expre5s]y
understood a)d agreed that each party and tlleir officers, agents~ and employees do not in any way
nor for any purpose become a pa,rtner, agent, joint venture. servant, or employee of the other.
2.
Basic Services. The Meridian Police Department, shall provide Scl1001 Resource
Officers (SRO) servìccs at Meridía,r1 High School, Meridian Middle School, Lewis and Clark
Middle School, and the Sawtooth Middle School as refercnced in P\1ragraph 3 below, including, but

not limited to: investigating and, where possible, preventing crimes against persons or property;
identifying and arresting vìolators of state and local laws; :filing investigative reports and other
required report5 or documents; patrolling; and, to a limited extent, maintaining building security,
controlling traffic, and enforcing traffic laws (but not District e5tabHshed-parking regulations)- It ís
under5tood tl1<'11 the Meridian Police Department is not required to provide tr~ffic control services
for special events held on any campus under the control of the District, nor is the Meridian Police
Department required to provid,e additional personnc, for those purposes except under the terms
provìded in Paragraph 13 herein.
3.
Personnel Assignments. a) The Meridian Police Department shaH place one
School Resource Officer at Meridian High School, and one Scho01 Resource Officer at Meridian
Middle School, Lewis and Clark Middle School. and Sawtooth Middle School wîth the Sehool
Resource Officer's time split in a. ms,nncr agreeable with the 8cllo01 DÎstrÎct Administration and
affected schoo1 principals- b) When it becomes necessary to select a.. new or replacerhcnt School
Rcsouree Officer for Merid1an High School Or the Meridian Middle Schools, the Meridian Police
Department policy sha1l govern the procedure; however, the Meridian School District shaH be
allowed the opportunity to provide input into the selection or the Schöúl Resource Officer, "however
the final assÎgnmc:nt decision wi11 rest with the Meridian PoHce Department.
4.
Officer Duties. The Meridian Police Department shall have the discretion to
determine how the Officer perfonl1ing the dut,ies under this Agreement will be deployed and the
manner in which the services contemplated by this Agreement shall be provided. T11e parties agree
that the interiors of buildi'ngs will not be patrolled by Officers eXcèpt as is necessary to investigate
crimes and apprehend. criminal suspects, however, the Officer shatl maÎntain high visibility with
students during breaks and lunCh periods. The School ResOurce Officer shall be an active melTlber
'ofthe schools' Student Management Teams.

the parent or guardia:o ofthe student that a Meridian Police Officer questioned the
student or removed the student from campus, as the ease may be, and may further
state that additional information may be obtained by contactIng the Meridian
Police Department. Liabi1ity arising from such actions shall be governed by
paragraphs 7 and 18.
iv. If a student's parent or guardian contacts the principal about interviews
conducted by a, Merìdían PoJice Officer, the principal may disclose any
information concerning school matters, but will refer questions regarding ctiminal
issues or investigations to the Meridian Police Dcpartmettt.
7. TraiTling:. Scheduling and Activity Log. a.) Meridian Police Department shall
use suitably trained Meri,dian Police OfficersÎn meeting the obligations contained in paragraph 3(a)
above of this Agreement. Throughout the tenn of this Agreement, the Offieers will be assigned
School Resource Officer duties at the assigned schoo] as their primary dU1y. If the SRO will be
absent from the assigned school for 8, :fun day the SRO shan notify the school principal in advance
or as soon as practical. Emergency situations shall be handled by the District by utilization of the
Emergency 911 syst:em or other District approved procedurt,;:.
b) Scheduling shal1 be mutually agreed upon by the assigned schoo] principal and the
M$tjdian Police Depa,rtment.
e) The School Resource Officers will provide the assigned principal with an Activity
Log indic;(Iting where and on wnat school activÎtÎes he or she was invotved during the prior week, if
reQuested by the assigned principal.
8.
Meridian Police Department Schoo] Resource Officers shall be gÎvef1 a
performance evaluation annually as required by City of MeridÎan. The evaluating supervisor wi II
discuss the perfonnance ofthe School Resource Officer with the principal of the assigned schoo!.

dollars ($3,555.00).
This amount is included is the total amount of the Agreement noted in
paragraph 12.
b) Districts Schools other than Meridian High School and the Me'ridian Midd1e
Schools.
The remaining secondary and elementary schools in the District that are within the
incörpotated area of the City of Meridian shall have a Meridian Police Department Detective
assigned to the area however, that assignment in not within the tenlls of this Agreement. Specifîe
law enforcement services to the District's secondary schools În this area are at the sole discretion of
the Meridian Police Depa,rtment. The Meridian Polìce Department will work elosdy with the
5chool principals of those secondary schools regarding law enforcement needs.
14. Office Suace. The District agrees to provide Officers with adequate office space
a.nd suitable desks chairs, and telephone for the purposes of this Agreement.
15. EmpJqyment. It is acknowledged by the parties that the M¡;:ridian Police Officers
acting pursuant to this Agreement are not the employees or agents of the District or schools within
the District, but rather, they t'$mail1 the employees of The City of Meridian.
16. Al,Jthorized Absence!!. Law cnforcement Officers acting pursuant to this
Agreem,ent may be absent from their assigned campuses on holidays observed by The City of
Meridian, as well as holidays obsélved by the District, in addition to sick Icave time and authorized
vacation time.
17. Qistríct to Hold the Cit}: of Meridian Harml,es~. In the event the City of Meridian
or any of its officers~ agents, employees, insurers, or indel11nitors have any cla,im. demand, 5nìt, or
judgment a.sserted against them which arises from acts or omissions of the District, its Officers,
agents, or ét1ployees, the District shall, at its expense, defend and indemnify the City of Meridian,
its Officers, agents, employees, insurers, and indemnitors, and hold them harmless.
18. County to Hold District Han'1.1!lli§. In the event District or any of its officers,
ägents, emploYt::es, insurers" or indemnitors have any claim, demand, suit, or judgment asserted
