We have reviewed the above referenced sUbmittals and offer the following comments, ns
conditions of approvaL These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:

The applicant, Hubble Engineering, has applied for Preliminary and Final Plat approval of four
(4) building lots on six (6) acres of land located at the southeast comer of Fairview and
Stonehenge Way. The Intermountain Outdoor Sports retail store sits on the largest of the four
lots, approximately 3.65 acres in size, on the eastern side of the subject property. The remaining
2.45 acres of land is currently vacant (other than a large white tent structure) and will be split
into three (3) smaller lots of land ranging from .69 acre to .8:t acre in size.
The Applicant has not proposed any new driveways (curb cuts) onto Fairview Avenue or
Stonehenge Way. Access to the new parcels will be provided by the existing the curb cuts and by
providing a cross access agreement and shared parking for the lots within the subdivision.
The Applicant has requested a variance to section 12-13-104 the Landscape Ordinance (Buffer
Size) which requires a thirty-five-foot (35') wide street buffer on an Entryway Corridor. The
subject property currently has only a six-foot (6') wide landscape buffer adjacent to Fairview
Avenue. In order to provide the additional landscaping adjacent to Fairview Avenue the owner of
the property would need to remove a row of asphalt parking and rearrange the current parking lot
configuration. The variance request also addresses the issue of allowing the street buffers to be
within a landscape easement rather than on separate common lots. Staff will address the
variance issues in detail later in the report. The applicant has also requested a variance to the
requirement for a pressurized irrigation system; however, after submitting their application, the
applicant's representative has discovered that there is an existing pressurized irrigation system
being fed by a well source.
A drive-up coffee kiosk with two (2) pick-up windows and an emissions testing van are located
on the same lot as the retail store. The coffee kiosk was placed at its cmrent location without

receiving approval from the City of Meridian, and there are numerous illegal temporary signs on
the property advertising the sale of coffee and emissions testing.
LOCATION
The subject property is located at the southeast comer of Fairview Avenue and Stonehenge Way.

PRELIMINARY AND FINAL PLAT FINDINGS AND REOUII~MENTS
Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed
subdivision, the Commission/Council shall consider the objectives of this title and at least the
following:
a. The conformance of the subdivision with the Comprehensive Developmem Plan;
The Comprehensive Plan's Generalized Land Use Map designates the land as "Mixed
Planned Development". Staff finds the subdivision to be in conformance with the
Comprehensive Development Plan.
b. The availability of public services to accommodate the proposed development;
Staff finds that public services can be made available to the lots within the proposed
subdivision, provided changes as may be required by the Public Works and Building
Departments are made.
c. The continuity of the proposed development with the capital improvement
program;
Staff finds that the subdivision will not require the expenditure of capital improvement
funds.
d. The public financial capability of supporting services for the proposed
development;
Staff finds that the development will not require major expenditures for providing
supporting services.
e. The other health, safety or environmental problems that may be brought to the
Commission's attention.
Staff finds that a sidewalk is needed adjacent to Fairview Avenue for pedestrian safety
considerations. Staff does not foresee any other health, safety or environmental problems

associated with this subdivision that need to be brought the attention of the Council or
Commission.
A~DmONAL CONSIDERATiONS
Staff does not support the variance request to allow the existing six-foot (6') street ,buffer in lieu
of providing the required thirty-five-foot (35') street buffer; however, staff does recognize that
requiring the full thirty-five-foot (35') street buffer on Lot 1 will significantly alter the interior
traffic circulation and parking lot layout for the existing retail store.
Staff recommends a compromise; the Applicant can remove the row of parking immediately
adjacent to the existing street buffer on Lot 1 (the coffee kiosk and the emissions van are located
in this area as well) and replace the parking area with landscaping. The removal of just one row
of parking will allow the traffic circulation to remain the same for the rest of the parking lot, and
it will provide a significant amount of new landscaping (approximately nineteen feet). The
resulting buffer (25'-26') will be less than the required thirty-five-foot (35') buffer, but it will be
a dramatic improvement. The remaining parking lot for the retail store will still provide the
minimum number of required parking spaces. Staff does not support reducing the street buffers
on any other lot.
When the Intermountain Outdoor Sports store was approved in 1994, the City's landscape
ordinance required one (1) three-inch (3") caliper tree for every fifteen hundred feet (1,500') of
asphalt. In order to comply with this requirement, the applicant counted the trees planted within
the street buffers on Stonehenge Way, originally part of Danbury Subdivision. Subdividing the
property will place the trees that were required for the retail store on the other three lots. If the
City approves the subdivision as proposed, Lot 1 will not meet the minimum requirements of
either the old or the present landscape ordinance.
As part of the compromise on the variance, staff recommends requiring the installation of
landscape islands in the existing parking lot per the current Landscape Ordinance. Requiring
interior landscape islands will increase the number of trees on Lot 1 by fourteen to fifteen (14-
15) trees.
Staff supports the request to allow the street buffers to be on an easement rather than on a
common lot as long as an association (homeowners or business owners, MCC12-13-10-3)
maintains the landscaping and if the street buffers for the entire development are installed prior
to the issuance of a building permit within the subdivision.
The illegal temporary signs need to be removed from the property prior to signature on the final
plat.
The coffee kiosk is not a permitted use on the subject property. The drive-up window use
requires a conditional use permit (MCCll-8-1). Staff recommends the removal of the coffee
kiosk prior to the signature on the final plat. The coffee kiosk owner may apply for a conditional
use permit for this site after the site has been brought into compliance with the City of
Meridian's Zoning and Subdivision Ordinances.

The white tent/Quonset hut structure on the current unimproved lots 2, 3, and 4 has not been
approved by the City, and must be removed.
SITE SPECIFIC COMMENTS fpreliminarv/finai plat)
1. Water and sewer service to this site shall be via service lines from the existing mains
adjacent to the property.
Applicant has indicated that a pressurized irrigation system will be provided to the three
(3) new buildable lots (already existing to Lot 1, Block 1) through the existing irrigation
system; however, no details of the system have been submitted. Applicant shall confirm
that the system will have adequate capacity for the additional lots. As part of the
development plan review process, the Public Works Department shall review plans and
specifications for the irrigation system. A draft copy of the pressurized irrigation system
O&M manual must be submitted prior to plan approval.
The coffee kiosk and tent/Quonset hut shall be removed from the property prior to the
City's signature on the final plat.
Landscaping shall be installed as required by the Landscaping Ordinance unless
otherwise approved by the City Council at public hearing (per the Applicant's variance
request). A new landscape plan shall be submitted to the Planning and Zoning Staff for
review and approval prior to the signature on the final plat.
Dead or dying landscaping shall be replaced. All non-organic mulch shall be removed
and replaced with either organic mulch or vegetation.
Visually depict the width of the landscape easements on the face of the preliminary and
final plat.
Add a note to the face oftbe final plat requiring that a Business Owners Association will
be required to maintain the street buffers.
Show the existing easements for the Jackson Drain where it courses across the southern
boundary of the subdivision.
All required street buffers and irrigation lines shall be installed prior to the occupancy of
any new construction on Lots 1, 2, 3, or 4 of the proposed subdivision

Add a note to the face of the plat stating that the subdivision provides cross access and
cross parking among the parcels, for use with the previously approved driveways.
11.
All illegal/temporary signs shall be removed from the subject property prior to the City's
signature on the final plat and shall not be replaced. All signs must meet the Sign
Ordinance.

Construct a five=foot (5') wide sidewalk on Fairview Avenue. The sidewalk shall be
installed prior to the issuance of occupancy permits for Lots 2, 3, and 4 of the proposed
subdivision.

Add a note on the final plat indicating: "The bottom elevation of structural footings shall
be set a minimum of 12 inches above the highest normal ground water elevation."

1. Please submit a copy of the Ada County Street Name Committee's final approval letter
for the subdivision name, and the lot and block numbering. Make any corrections
necessary to conform.
2. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
A letter of credit or cash surety in the amount of 110% will be required for all fencing,
landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the
final plat.
All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting,
crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per
City Ordinance 12-4-13. The ditches to be piped should be shown on the site plans.
Plans will need to be approved by the appropriate irrigation/drainage district, or lateral
users association, with written confirmation of said approval submitted to the Public
Works Department.

The subject property is located in an area designated as Mixed Residential in the Meridian
Comprehensive Plan. The 1993 Comprehensive Plan contains a variety of goals and policies that
are relevant to this application. Staff has selected the following sections that most directly apply
to the proposed project.
Goal 3 is '~to encourage the kind of economic growth and development which supplies
employment and economic self-sufficiency for existing and future residents, reduces the present
reliance on Boise and strengthens the City's ability to finance and implement public
improvements, services, and its open space character."

Facts and Findings:
The Ada County Highway District (ACHD) staff has received the above referenced application
requesting preliminary plat approval to plat a 4-lot commercial subdivision. The proposed
subdivision has one existing commercial building (Intermountain Outdoor Sports) and will have
three additional commercial lots. The 6-acre site is located on the southeast comer of Fairview
Avenue and Stonehenge Way. This development is estimated to generate 830 additional vehicle
trips per day (2,460 existing) based on the Institute of Transportation Engineers Trip Generation
Manual.
The application and site plan stamped and received by'the 'City of Meridian on March 11, 2002,
and submitted to the District on March 13, 2002, has been reviewed by the ACHD Planning and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by the ACHD Commission unless the site plan
is changed in such a manner as to not conform to District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
D. On March 18, 2002, the District Planning and Development staffinspected this site and
evaluated the transportation system in the vicinity. On March 22, 2002, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.

For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use of this development has been classified as Specialty Retail. (Per the ITE Manual)
The impact fee rate from the fee tables for this use is $1,885 per thousand square feet of gross
building area, based on the impact fee ordinance in effect at this time. Note: This rate is
provided for informational purposes only and shall not be construed as an impact fee rate
certification. The impact fee will be assessed at the time of plans acceptance by District
staff, and shall be based on the fee tables and provisions of the District's Impact Fee
Ordinance in effect at that time.
Development patterns in the surrounding area are commercial and residential. To the north of
the site is the Idaho Athletic Club. To the south of the site are approximately 13+/-acres of non-
developed parcels. To the west of the site is Danbury Subdivision. To the east of the site is an
auto:~.~alvage yard. ~:B~odion:devetopment p~~.fhis area and the resulting traffic
generation, staff anticipates that the transportation system will be adequate to accommodate
additional traffic generated by this proposed development at accepted levels of service.
The existing commercial building (Intermountain Outdoor Sports) will remain and the proposed
additional lots will be utilized for commercial use. No specific tenants or uses were included in
the preliminary plat application: -
In the preliminary site plan, the applicant is not requesting additional access points to Fairview
Avenue or Stonehenge Way. The three existing driveways were approved with the original
application of Intermountain Outdoor Sports.
Previously approved Driveway # 1 is located on Fairview Avenue approximately 25-
feet west of the east property line.
Previously approved Driveway # 2 is located on Fairview Avenue approximately 190-
feet east of the west property line.
Previously approved Driveway # 3 is located on Stonehenge Way approximately 340-
feet south of tho north property line.
The three additional proposed commercial lots will be utilizing the existing two driveways on
Fairview Avenue and one existing driveway on Stonehenge Way.
Fairview Avenue is classified as a principal arterial roadway with 114-feet of right-of-way, and is
improved with 5-travel lanes, with curb, gutter and sidewalk on the north side across from the
proposed subdivision. No additional right-of-way is required from this development at this time.
Stonehenge Way is classified as a local/local commercial roadway with 54-feet of right-of-way
tapering to 50-feet abutting the site, and is improved with 2-travel lanes, curb, gutter, and
sidewalk. No additional right-of-way is required from this development at this time.

There are currently no improvements on Fairview Avenue abutting the proposed site. In
accordance with District policy (7204.7.2) the applicant should be required to construct a 5-foot
wide concrete sidewalk on Fairview Avenue located 2-feet within the right-of-way.
Special Recommendations to the City of Meridian:
The applicant should provide the District with a copy of a recorded access easement among the
parcels for use of the previously approved driveways to the public streets prior to final plat
approval.
The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to ACHD approval of the final plat:
Site Specific Requirements:
No additional access points to Fairview Avenue or Stonehenge Way have been proposed and
none are approved with this application.
Pave the existing driveway on Stonehenge Way that is located approximately 340-feet south of
the north property line to its full-required width of 24 to 30-feet and to a point 30-feet beyond
the edge of pavement of Stonehenge Way with 15-foot curb radii tapers abutting the existing
roadway edge.
Construct a 5-foot wide concrete sidewalk on Fairview Avenue located 2-feet within the fight-
of-way. Coordinate the location and elevation of the sidewalk with District staff.
Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during
the construction of the proposed development. Contact Construction Services at 387-6280
(with file number) for details.

then all utility relocation costs associated with improving street frontages abutting the site shall
be borne by the developer.
8. Any existing irrigation facilities shall be relocated outside of the fight-of-way.

Other than the access points specifically approved with this application, direct lot or parcel
access to Fairview Avenue is prohibited. Lot access restrictions, as required with this
application, shall be stated on the final plat.
Standard Requirements:
The Commission shall hear and decide appeals by an applicant of the final decision made by
the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this
section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law,
abused discretion or acted arbitrarily and CaPriciously in the interpretation or enforcement of
the ACHD Policy Manual.
'Filing:Fee: .i~':C~mission may; ?~~*~to time, set reasonable fees to be
charged the applicant for the processing of appeals, to cover administrative costs.
Initiation: An appeal is initiated by the filing of a written notice of appeal with the
Secretary of Highway Systems, which must be filed within ten (10) working days
fi.om the date of the decision that is the subject of the appeal. The notice of appeal
shall refer to the decision being appealed, identify the appellant by name, address,
and telephone number, and state the grounds for the appeal. The grounds shall
include a written summary of the provisions of the policy relevant to the appeal
and/or the facts and law relied upon and shall include a written argument in support
of the appeal. The Commission shall not consider a notice of appeal that does not
comply with the provisions of this subsection.
Time to Reply: The ROWDS Manager shall have ten (10) working days fi.om the
date of the filing of the notice of appeal to reply to the notice of the appeal, and may
during such time meet with the appellant to discuss the matter, and may also
consider and/or modify the decision that is being appealed. A copy of the reply, and
any modifications to the decision being appealed will be provided to the appellant
prior to the Commission hearing on
Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the
appeal will be noticed and scheduled on the Commission agenda at a regular
meeting to be held within thirty (30) days following the delivery to the appellant of
the ROWDS Manager's reply to the notice of appeal. A copy of the decision being
appealed, the notice of appeal and the reply shall be delivered to the Commission at
least one (1) week prior to the hearing.
Action by Commission: Following the hearing, the Commission shall either affirm
or reverse, in whole or part, or otherwise modify, amend or supplement the decision
being appealed, as such action is adequately supported by the law and evidence
presented at the hearing.

Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #195, also known as Ada County Highway District Road Impact
Fee Ordinance.

All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prePare and certify all improvement plans.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
Consmuztion, uso and,~ipra~perty: development~l~ttli~+i~conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.

Conclusion of Law:
ACHD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

the proposed project:

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects .involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is~
preventing groundwater and surface water degradation. Manuals that could

Dear Commissioners:
The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
application be filed. Please ,contact Ms. Donna Moore, Asst. Secretary/Treasurer at the
District's main office at 466-7861.
All laterals and waste ways must be protected and all municipal surface drainage must be
retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation
District must review drainage plans. The developer must comply with Idaho Code §31-
3805. It is recommended that irrigation water be made available to all developments
within the Nampa & Meridian Irrigation District.

"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate

SITE SPECIFIC COMMENTS (preliminary/final plat)
1. Water and sewer service to this site shall be via service lines from the existing mains adjacent
to the property.
Applicant agrees
Applicant has indicated that a pressurized irrigation system will be provided to the three (3)
new buildable lots (already existing to Lot 1, Block 1) through the existing irrigation system;
however, no details of the system have been submitted. Applicant shall confirm that the system
will have adequate capacity for the additional lots. As part of the development plan review
process, the Public Works Department shall review plans and specifications for the irrigation
system. A draft copy of the pressurized irrigation system O&M manual must be submitted
prior to plan approval.
Applicant agrees that the development plans for each of the new lots will include details for the
pressure irrigation system, including an 0 & M manual for the irrigation system.
The coffee kiosk and tent/Quonset hut shall be removed from the property prior to the City's
signature on the final plat.
Applicant has provided information to the City regarding approval for the coffee kiosk to
remain on the site. The tent/Quonset hut will be removed from the site prior to the City's
signature on the final plat.
Landscaping shall be installed as required by the Landscaping Ordinance unless otherwise
approved by the City Council at public hearing (per the Applicant's variance request). A new
landscape plan shall be submitted to the Planning and Zoning Staff for review and approval
prior to the signature on the final plat.
Applicant agrees to install landscaping as approved by the City Council at the public hearing.
Applicant will submit a plan reflecting the Council approved landscaping to the P & Z Staff
prior to signature on the final plat.
Dead or dying landscaping shall be replaced. All non-organic mulch shall be removed and
replaced with either organic mulch or vegetation.
Applicant agrees that dead and dying existing landscaping will be replaced. Applicant agrees
to replace non-organic mulch with organic mulch or vegetation.
Visually depict the width of the landscape easements on the face of the preliminary and final
plat.
Applicant will show landscape easements, as approved by City Council, on the face of the
preliminary and final plats prior to City's signature on the final plat.

7. Add a note to the face of the final plat requiring that a Business Owners Association will be
required to maintain the street buffers.

8. Show the existing easements for the Jackson Drain where it courses across the southern
boundary of the subdivision.

9. All required street buffers and irrigation lines shall be installed prior to the occupancy of any
new construction on Lots 1, 2, 3, or 4 of the proposed subdivision
Applicant agrees that buffer landscaping and irrigation will be installed prior to issuance of
certificates of occupancy for new construction on Lots 1,2,3 or 4.
10. Add a note to the face of the plat stating that the subdivision provides cross access and cross
parking among the parcels, for use with the previously approved driveways.
Applicant has added this note to the final plat.
11. All illegal/temporary signs shall be removed from the subject property prior to the City's
signature on the final plat and shall not be replaced. All signs must meet the Sign Ordinance.
Applicant agrees that illegal/temporary signs will be removed from the property prior to the
City's signature on the final plat.
12. Add adjacent platted subdivision names, or unplatted to the face of the plat.
Applicant has added platted names or" unplatted" to the final plat.
13. Construct a five-foot (5') wide sidewalk on Fairview Avenue. The sidewalk shall be installed
prior to the issuance of occupancy permits for Lots 2, 3, and 4 of the proposed subdivision.
Applicant agrees to construct a 5-foot wide sidewalk on Fairview Avenue prior to the issuance
of occupancy permits for lots 2,3 and 4.
14. Add a note on the final plat indicating: "The bottom elevation of structural footings shall be set
a minimum of 12 inches above the highest normal ground water elevation."

GENERAL COMMENTS (preliminary/final plat)
1. Please submit a copy of the Ada County Street Name Committee's final approval letter for the
subdivision name, and the lot and block numbering. Make any corrections necessary to

Mr. John Priester, Ada County Surveyor, has indicated approval of the applicant's request for
the subdivision name, "Intermountain Outdoor Subdivision" Final approval of the
subdivision will take place when to plat is recorded. The lot and block numbering are shown
on the final plat.
2. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
Applicant agrees to coordinate fire hydrant placement with City of Meridian Public Works
Department
A letter of credit or cash surety in the amount of 110% will be required for all fencing,
landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final
plat.
As noted in Site Specific Condition #9, the applicant will install the landscaping and irrigation
prior to the occupancy of any new construction on lots 1,2,3 or 4.

Ail irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing
or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance
12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be
approved by the appropriate irrigation/drainage district, or lateral users association, with
written confirmation of said approval submitted to the Public Works Department.
Jackson Drain and Settlers Canal are adjacent to the site and will not be in be enclosed in pipe
or improved in any way. Because irrigation water originates from an on-site well, not an
irrigation ditch, and because runoff is captured by catch basins and infiltrated, the irrigation
and drainage systems adjacent to the site will not be affected. Applicant will obtain written
confirmation of these site-specific conditions from Nampa Meridian Irrigation District. A copy
of applicants letter to the Nampa & Meridian Irrigation District has been forwarded to the
City.
RECOMMENDATION
Staff recommends a compromise on the variance request, as noted above, under the heading
"Additional Considerations". Upon resolution by the City Council of the variance request, staff
recommends approval of the preliminary/final plat request with the aforementioned comments and
conditions.
Applicant appreciates the planning staff's assistance on all aspects of the subdivision process for this
site. Applicant agrees with the staff recommendation of approval upon resolution by the City Council
of the variance requests and with the comments and conditions as noted by staff and responded to by
the applicant above.

Dear Mr. Henson:
As we discussed by phone on Monday, April 15, 2002, the owners of the subject property
are proposing to divide the pm'cd into 4 lots, with one of the lots encompassing the
existing store and parking lot. The 3 new lots will be developed at some time in the
~uture. Those lots are located on the grass/gravel area at the comer of Fairvicw Avenue
and Stonehenge Way.
The existing retail store operates and rnain~ns an on-site well for irrigation water and
will continue to do io after the subdivision ofthe property. Any development that occurs
on the 3 new lots will also use this irri~tion system. Therefore, thc Nampa & Meridian
Irrigation District will not be asked to own, o~erate or maintain the irrigation system.
Runoff from the existing lot drains into area catch basins, passes through oil and grease
separators and is infiltrated into subsurface soils. Any development that occurs on the 3
new lots will typically use the same storm water management system. Therefore the
Nampa & Meridian Irrigation District dr~uage ditch adjacent to the site will not be
impacted.
In addition, the applicant for the subject subdivision has agreed to add a note to the final
plat stating: "Development or redevelopment of any lot in this subdivision will requite
the approval of the Nampa & Meridian Irrigation District."
If these conditions adequately address your concerns regarding the impact of the subject
subdivision, please respond to me in writing to the address/fax noted above so that I c~
tr~smit your approval to the City of Meridian.

The following Findings and/or Recommendations from Planning and Zoning and Engineering staff should be modified to include the following information:
2. Applicant will provide information on system capacity and a draft O & M manual to the
Public Works Department as part of the plan review process for the development of the
new lots.
3. As noted at the Planning and Zoning Meeting on April 18, 2002, the coffee kiosk is a
permitted use and can remain on the site. The tent/Quonset hut, used for various
community activities, will be removed from the property prior to the City's signature on
the final plat.
4. Landscaping will be installed as approved by the City Council at public hearing.
18. The Nampa and Meridian Irrigation System's Jackson Drain is located adjacent to the site
and will not be enclosed in a pipe. The easement for the Jackson Drain is shown on the
final plat and will not be impacted by the irrigation system, as requested in the Irrigation
District's letter dated April 25, 2002. As noted in the Irrigation District's letter to the
applicant dated April 19, 2002, plans for the development of the 3 new lots will need to be
approved by the Irrigation District. A note to that effect has been added to the final plat
19. The owners of the subject site will work with Mr. Steve McNiff, as a representative of the
Danbury Subdivision, to work out the appropriate irrigation system for the landscaping
along Stonehenge Way.

D. The staff notes that this finding cannot be made because the original variance was beyond
the scope of the Alternative Compliance Section. Alternative Compliance Section 15.5
allows for a variance to be filed when the Alternative Compliance Section cannot be met.
Applying for a landscape variance, as allowed in this section, will not alter the purpose of
the Landscape Ordinance. An affirmative finding can be made.
In addition, a revised landscape plan and revised variance request letter will significantly
alter the reduction in landscape requirement being requested by the applicant. Such
revisions will allow an affirmative finding to be made.

On behalf of our client, Mr. Gerry Sweet at Intermountain Outdoor Sports, we have
submitted preliminary and final plats for the subdivision of the property at 1375 E.
Fairview Avenue. In accord with the requirements of the Meridian Subdivision
Ordinance we also requested a variance to the landscaping requirements for the
preliminary and final plats. After discussions with and assistance from the Planning and
Zoning Staff, we are resubmitting this revised variance request letter to reflect many of
the staff recommendations. A landscape plan prepared by South Landscape Architecture
reflects the revised landscaping that is proposed.
We had previously requested a variance to retain the six-foot, landscaped buffer in front
of the existing store. Staff recommended that the buffer be 25 to 26 feet wide in the
location of the first row of parking adjacent to Fairview Road. The revised landscape
plan shows a new landscape buffer in front of the existing store that is in keeping with the
staff s recommendation, excepting a portion of the buffer to allow for the continued
operation of the existing coffee kiosk and the emissions van. With this plan, over 60% of
the buffer will be the width suggested by the staff. Eighteen (18) existing parking spaces
will be removed with this design; however, the coffee kiosk and emissions van can
remain as noted in the staff recommendation. The dead and dying landscaping in this
portion of the buffer will be removed and replaced. The existing lava rock will be
replaced with lawn as required by the landscape ordinance.
The existing landscaping continues along the Fairview Avenue frontage adjacent to the
empty lot. This landscaping then continues south along the entire frontage of Stonehenge
Way, a local street. The landscape buffer along Fairview will be 35 feet wide as required -
by the landscape ordinance. (Please note that the proposed Comprehensive Plan would
change the landscape requirement on this portion of Fairview Road to 25 feet.) The
landscape buffer on Stonehenge Way will be 20 feet wide as required by the landscape
ordinance. We agree with staffs' recommendation that the landscape buffer be locat d
within an easement rather than in a common lot.
We continue our request that the Council grant a variance for the interior landscaping as
required by the ordinance. The addition of landscaped medians within the existing paved
parking will remove up to 16 more parking spaces. Most importantly, constructing
landscape islands will require ripping up existing pavement throughout the entire parking
lot to install the irrigation system to each of the islands. The work is expensive and be
disruptive to the operation of the existing store.
With this reduction in the number and level of.variance requests, all the necessary
findings to approve the variance can be determined in the affirmative. I respectfully
request, on behalf of our client, that the landscape variance be granted for the simple
subdivision of this commercial property. The new commercial properties will provide
convenient and accessible services to residents and an economic asset to the City.
