The City Council strongly recommends: 1. That you take time to carefully, review the Findings and Kecommendations of th~ Planning and Zoning Commission, and 5e prepared to state your position on this application by addressing the Findings and Recommendations of th~ Planning and Zoning Commission; and 2. The Pos?ion statement form for this application is available at the City Clerk s office. It is recommended that you prepare a Position Statement and deliver it to the City Clerk prior to the hearing, if possible. If that is not possible,please present your Position Statement to the City Coundl at the hearing, along with eight (8) copies. The copies will be presented to the Mayor, Coundl, Planning and Zoning AdnSinistrator, Public Works and the City Attorney. If you are a part of a group, it is strongly recommended that one Position Statement be filled out for the group, which can be signer by the representative for the group. C-~ Attorney's Office BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR PRELIMINARY AND FINAL PLAT FOR INTERMOUNTAIN OUTDOOR SUBDIVISION HUBBLE ENGINEERING, INC., Applicant Case No. PFP -02-001 RECOMMENDATION TO CITY COUNCIL 1. The property is approximately 6.00 acres in size and is located at 1375 East Fairview Ave., Meridian. 2. The owner of record of the subject property is Gerry Sweet, CEO of Intermountain Outdoor Sports. 3. Applicant is Hubble Engineering. 4. The subject property is currently zoned C-G. The zoning of C-G is defined within the City of Meridian Zoning and Development Ordinance Section 11-7-2. 5. The subject property is within the city limits of the City of Meridian. 6. The entire parcel is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 7. The Applicant proposes to develop the subject property in the following manner: 4 building lots for expansion of an existing commercial development. 8. There are no significant or scenic features of major importance that affect the consideration of this application. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the preliminary and final plat as requested by the applicant for the property described in the application, subject to the following: RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF PRELIMINARY AND FINAL PLAT FOR INTERMOUNTAIN OUTDOOR SUBDIVISION - - Page 1 A. Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: 1. Water and sewer service to this site shall be via service lines from the existing mains adjacent to the property. Applicant has indicated that a pressurized irrigation system will be provided to the three (3) new buildable lots (already existing to Lot 1, Block 1) through the existing irrigation system; however, no details of the system have been submitted. Applicant shall confirm that the system will have adequate capacity for the additional lots. As part of the development plan review process, the Public Works Department shall review plans and specifications for the irrigation system. A draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. 3. The coffee kiosk and tent/Quonset hut shall be removed from the property prior to the City's signature on the final plat. Landscaping shall be installed as required by the Landscaping Ordinance unless otherwise approved by the City Council at public heating (per the Applicant's variance request). A new landscape plan shall be submitted to the Planning and Zoning Staff for review and approval prior to the signature on the final plat. 5. Dead or dying landscaping shall be replaced. All non-organic mulch shall be removed and replaced with either organic mulch or vegetation. 6. Visually depict the width of the landscape easements on the face of the preliminary and final plat. 7. Add a note to the face of the final plat requiring that a Business Owners Association will be required to maintain the street buffers. 8. Show the existing easements for the Jackson Drain where it courses across the southern boundary of the subdivision. 9. All required street buffers and irrigation lines shall be installed prior to the occupancy of any new construction on Lots 1, 2, 3, or 4 of the proposed subdivision 10. Add a note to the face of the plat stating that the subdivision provides cross access and cross parking among the parcels, for use with the previously approved driveways. 11. All illegal/temporary signs shall be removed from the subject property prior to the City's signature on the final plat and shall not be replaced. All signs must meet the Sign Ordinance. 12. Add adjacent platted subdivision names, or unplatted to the face of the plat. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF PRELIMINARY AND FINAL PLAT FOR INTERMOUNTAIN OUTDOOR SUBDIVISION - - Page 2 13. Construct a five-foot (5') wide sidewalk on Fairview Avenue. The sidewalk shall be installed prior to the issuance of occupancy permits for Lots 2, 3, and 4 of the proposed subdivision. 14. Add a note on the final plat indicating: "The bottom elevation of structural footings shall be set a minimum of 12 inches above the highest normal ground water elevation." 15. Submit a copy of the Ada County Street Name Committee's final approval letter for the subdivision name, and the lot and block numbering. Make any corrections necessary to conform. 16. Coordinate fire hydrant placement with the City of Meridian Public Works Department. 17. A letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. 18. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 12-4-13. The ditches to be piped should be shown on the site plans. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 19. The Planning and Zoning Commission further recommend that applicant provide its own pressurized irrigation or work out an agreement with the Danbury Subdivision as to their supplying pressurized irrigation. Adopt the Recommendations of the ACHD as follows: No additional access points to Fairview Avenue or Stonehenge Way have been proposed and none are approved with this application. Pave the existing driveway on Stonehenge Way that is located approximately 340-feet south of the north property line to its full-required width of 24 to 30-feet and to a point 30-feet beyond the edge of pavement of Stonehenge Way with 15- foot curb radii tapers abutting the existing roadway edge. Construct a 5-foot wide concrete sidewalk on Fairview Avenue located 2-feet within the right-of-way. Coordinate the location and elevation of the sidewalk with District staff. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF PRELIMINARY AND FINAL PLAT FOR INTERMOUNTAIN OUTDOOR SUBDIVISION - - Page 3 Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Meet District drainage requirements per section 8000 of the ACHD Development Policy Manual. If utility relocation is necessary to construct improvements required with this development, then all utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. Any existing irrigation facilities Shall be relocated outside of the right-of-way. Other than the access points specifically approved with this application, direct lot or parcel access to Fairview Avenue is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. Adopt 1. 8. Adopt the Recommendations of the Meridian Fire Department as follows: Provide a fire-flow consistent with the 1997 Uniform Fire Code Appendix III-A. Fire hydrants shall be placed an average of 400' apart. 2. All comers will have to have 28' inside radius and 48' outside radius. 3. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. 4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department. 5. Acceptance of water supply for fire protection will be by the Meridian Water Department. 6. The roadways shall be built to Ada County Highway Standards with a minimum street width of 37'. All proposed uses and storage practices shall comply with the Uniform Fire Code. A 20' wide fire access road shall be maintained at all times. the Recommendations of Central District Health Dept as follows: 1. The Applicant's central sewage and central water plans must be submitted to and approved by the Idaho Department of Health & Welfare, Division of Environmental Quality. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF PRELIMINARY AND FINAL PLAT FOR INTERMOUNTAIN OUTDOOR SUBDIVISION - - Page 4 2. Run-off is not to create a mosquito breeding problem. 3. Stormwater shall be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality. The Engineers and architects involved with the design of the subject project shall obtain current best management practices for stormwater disposal and design a stormwater management system that prevents groundwater and surface water degradation.
