The face of the fence shall be set a minimum of 10 feet from the yard-side edge of sidewalk along Old Stone Way. 2. The ground area between the fence Œld sidewalk shall be IŒldscaped Œld maintained by you, 3. The board side of the fence shall face out toward the street. 4, The City of MeridiŒl has no jurisdiction in the enforcement of the provisions of your subdivision's Protective CovenŒlts. OVer the last four yearn, my neighbolS and I have been working on our adjacent fences, In the process, of the sides of my property have been fenced. When I began planning to complete the fencing last fall, I called Dig Une, checked plats and p.-operty lines. I checked with my neighbolS, (who both approved of my plan and offered to help build the fence). I invited the president of the homeownelS' association to walk the proposed fence lines with me. We both walked the sidewalk and compared to other fenCe lines, We both agreed that the design results were both use-full and appealing, It Is my understanding that the fence is snowed underthe restrictiVe covenants of the subdiVision. have been as meticulous as possible in the construction of the fence, I have used concrete to hold posts that I spent houlS to make sure were in line, I checked grade, utilities, spacing, and meterials. However, I did fan to get the fence panni!, Had I done so, I would have leamed of the fence setback and I wouldn' be in this position, I had neariy completed the portion adjacent the curve of the road when the inspector (Steve Pearson) noticed the fence. I have spoken to Mr. Pearson (4116/99, 3:59pm, ext. 207) and he has verbally allowed me to put the last pickets up on that side concurrent with the variance application. If the variance is not approved, the pickets are not the difficult part of moving a fence. Completion will help with the safety of my children. I am applying for this fencing variance in order to be allowed to leave the fence line in place. At the Beginning ofthe Curve, (approximately where our property begins), the fence line is 15 feet from the sidewalk and appro (. 14 feet from the property line. The distance grows as the road curves from the fence line and shrinks as the curve comes around. At the next comer of the fence, the property line (to my understanding) is closer to the sidewalk, possibly next to or under it. At that Point of the Curve, the fence is 15 feet to 16 feet from the property line and sidewalk. Aflert¡ylng to be so careful about how I built this fence, I am emberrassed about the setback. issue.
