RE: Vacation and Exchange of W. Twisted Creek Street
Dear City Council:
Please accept this letter as our formal request to vacation of portion of the existing public right of way of
W. Twisted Creek Street. Are highlighted in attached Exhibit A.
Please accept this letter as our formal request to vacate and exchange a portion of the existing right of
way of W. Twisted Creek Street located approximately 900 feet south of the intersection of N. Blackcat
Road and W. Gondola Drive.
In the original preliminary plat approval of Jump Creek Subdivision, ACRD allowed for a temporary
access easement to be installed at the current location of W. Twisted Creek Street.
There was an oversight at the time that Jump Creek Subdivision No 1 was platted and recorded. This
oversight allowed a public right of way to be installed instead of the temporary access easement. The
record is clear that this access point to N. Blackcat Road was never intended to be a permanent access.
The record is also states that this access was to be removed when the northern connection to N. Blackcat
Road could be made.
As this access point was platted as public right of way it requires us to go through the right of way
vacation process to remove it.
We intend on leaving all the easements as they exist today and are only seeking remove the vehicular
access to N. Blackcat Road. The vacated ground will then be turned into additional common area for the
subdivision

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.

UDC 11-5A-5.
