STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could
be used for guidance are:

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
AnderSon, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.

Dear Commissioners:
The Nampa & Meridian Irrigation District requires that a Land Use Change/Site
application be filed. Please contact Ms. Donna Moore, Asst. Secretary/Treasurer at the
District's main office at 466-7861.
All laterals and waste ways must be protected and all municipal surface drainage must be
retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation
District must review drainage plans. The developer must comply with Idaho Code §31-
3805. It is recommended that irrigation water be made available to all developments
within the Nampa & Meridian Irrigation District.

The Ada County Highway District (ACHD) Staff has received the above referenced application
requesting preliminary plat approval to subdivide 20.01 acres into 5 lots.. The subject site is
located on the norhteast comer of Franklin Road and Eagle Road, approximatelY one mile south
of Fairview Avenue. The additional vehicle trips per day can not be determined for this site fully
built out, but there are 1700 existing trips based on the Institute of Transportation Engineers Trip
Generation Manual.
The application and site plan stamped and received by the City of Meridian on March 4, 2002,
and submitted to the District on March 6, 2002, has been reviewed by the ACHD Planning. and
Development staff and conforms to applicable District standards/policy, or can be made to
conform with the change(s) to the plan described in the requirements stated below.
This is a stafflevel approval and will not be heard by the ACI-ID CommiSsion unless the site plan
is changed in such a manner as to not conform to District standards/policy or an appeal of the
Planning and Development staff decision is submitted as described within the Standard
Requirements outlined below.
On March 11, 2002, thc District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On March 15, 2002, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements,

Development patterns in the surrounding area are generally commercial in nature. To the north
of the site is a warehouse and office complex. To the south of the site is a single family home and
St. Lakes Hospital. To the west of the site is a large warehouse and office complex. To the east
of the site is a large undeveloped parcel currently being used for agricultural purposes. Based on
development patterns in this area and the resulting traffic generation, staff anticipates that the
transportation system will be adequate to accommodate additional traffic generated by this
proposed development at accepted levels of service with out modification to Eagle Road,
Franklin Road, Lanark Street or Gaudians Avenue.
When the R.C. Willey Home Furnishings development project was approved and built, utilities
and roadways were constructed through the subject property. The streets abutting th/s property,
and the streets within this subject site are all currently improved to meet District standards.
Therefore, no additional right-of-way should be required, nor are any improvements (sidewalks,
curb, gutter, etc.) ne~lled ~with.this application. . .
The applicant is proposing to utilize an existing driveway to Lanark Street, located
appwximately 140-feet east of the west property boundary. This driveway location meets District
policy and should be approved with this application. The applicant is also proposing to utilize an
existing curb cut to Lanark Street, located approximately 350-feet east of the west property
boundary. This driveway location meets District policy and should be approved with this
application. The applicant is proposing to utilize a driveway to Gaudians Avenue, located
approximately 500-feet north of the south property boundary. This driveway location meets
District policy and should be approved with this application. The applicant is proposing to utilize
an existing curb cut on Gaudians Avenue, located approximately 720-feet north of the south
property boundary. All of these driveways are currently paved.
The applicant is not proposing any access to Franklin Road or Eagle Road and none should be
approved with this application.
The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to ACHD approval of the final plat:
Site SPecific Requirements:
Comply with requirements of ITD for State Highway 55 frontage. Submit to the District a
letter from ITD regarding said requirements prior to District approval of the final plat or
issuance of a building permit (or other required permits), whichever occurs' first. Contact
District HI Traffic Engineer Michael Garz at 334-8340.
Utilize the existing driveway to Lanark Street, located approximately 140-feet east of the west
property boundary. This driveway location meets District policy, and is approved with this
application. The applicant is also proposing to utilize an existing driveway to Lanark Street,

application. The applicant is proposing to utilize an existing driveway on Gandians Avenue,
located approximately 720-feet north of the south property boundary. This location meets
District Policy and is approved with this application. Pave the driveways to their full-required
width of 24 to 30-feet and to a point 30-feet beyond the edge of pavement of Gandians Avenue.
Utility street cuts in pavement less than five years old are not allowed unless approved in
writing by the District. Contact ACI-ID's Utility Coordinator at 387-2516 or 378-6258 (with
file number) for details.
Meet District drainage 'requirements per section 8000 of the ACHD Development PoliCy
Manual. Contact District staffat 387-6170 for details.
If utility relocation is necessary to construct improvements required with this development,
then all utility relocation costs associated with improving street fi:ontages abutting the site
shOuld be borne by the developer.
7. Any existing irrigation facilities shall be relocated outside of the right-of-way.
There are no direct lot or parcel access points approved with this application to Franklin Road
and Eagle Road. Direct lot or parcel access to Franklin Road and Eagle Road is prohibited. Lot
access restrictions, as required with this application, shall be stated on the final plat.
Standard Requirements:
The Commission shall hear and decide appeals by an applicant of the final decision made by
the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this
section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law,
abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of
the ACHD Policy Manual.
a. Filing Fee: The Commission may, from time to time, set reasonable fees to be
charged the applicant for the processing of appeals, to cover administrative costs.
b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the
Secretary of Highway Systems, which must be filed within ten (10) working days
fi:om the date of the decision that is the subject of the appeal. The notice of appeal
shall refer to the decision being appealed, identify the appellant by name, address
and telephone number and state the grounds for the appeal. The grounds shall
include a written summary of the provisions of the policy relevant to the appeal
and/or the facts and 1aw relied upon and shall include a written argument in support

of the appeal. A notice of appeal that does not comply with the provisions of this
subsection shall not be considered by the Commission.
Time to Reply: The ROW-DS Manager shall have ten (10) working days fi:om the
date of the filing of the notice of appeal to reply to the notice of the appeal, and may
during such time meet with the appellant to discuss the matter, and may also
consider and/or modify the decision that is being appealed. A copy of the reply, and
any modifications to the decision being appealed will be provided to the appellant
prior to the Commission hearing on the appeal.
d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the
appeal will be noticed and scheduled on the Commission agenda at a regular
meeting to be held within thirty (30) days following the delivery to the appellant of
the ROWDS~~. reply to the n~ .o£~ ~al;~Peal. A copy of the decision being
appealed, the notice of appeal and the reply shall be delivered to the Commission at
least one (1) week prior to the hearing.

Action by Commission: Following the hearing, the Commission shall either affirm
or reverse, in whole .or part, or otherwise modify, amend or supplement the decision
being appealed, as such action is adequately supported by the law and evidence
presented at the hearing.
Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #195, also known as Ada County Highway District Road Impact
Fee Ordinance.

All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplementS, Construction Services
procedures and all applicable ACI-ID Ordinances unless specifically waived herein. An
engineer registered in the State of Idaho shall prepare and certify all improvement plans.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the lime the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

7. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change l~om the Ada County Highway District.
Conclusion of Law:
ACI-ID requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Per Ordinance 12-5-2.1~ the subdivider will b~ responsible to construct new, five (5) foot wide
~'dewelks adjacent to Eagle Road/SH 55 and Franklin Road. Sidewalks already exist along
Gaudiam and Lanark, internal to thc subdivision, but not eu'ound the perimeter. In lieu of'
