I am sharing your email with the Planner evaluating DevCo’s application as well as the City Clerk’s Office so it can be considered and included as part of the record for this project. I appreciate you taking the time to not only express your concerns with the proposal, but also with City Code. There are ongoing conversations within the City about improving our grading and drainage standards so as to avoid potential future problems for residents. Again, thank you for the correspondence. In our opinion, City Council set a firm precedent when it required the slope of the latest Sky Mesa phases to be a common lot. This was because of testimony about chronic issues of weeds, erosion, etc, along the steep slope. The UDC does not have an adequate code for 2 drainage and slopes which has been noted by the staff in staff reports. Not only that, but the slopes in Reflection Ridge are common lot, too. Residents above and below the slope deserve better. If there are problems in the future, the only recourse for homeowners if there are drainage, flooding or slope issues is to file civil lawsuits.
