to AGREEMENT FOR JOINT USE OF SPORTS FACILITIES
This First Addendum to Agreement for Joint Use of Sports Facilities ("First Addendum") is made
this 1(p day of Af Yi \ , 2019 ("Effective Date"), by and between the City of Meridian, a municipal
corporation organized under the laws of the State of Idaho ( "City"), and Cole Community Church, doing
business as Cole Valley Christian School ("CVCS"), a nonprofit corporation organized under the laws of
the State of Idaho (collectively, "Parties").
WHEREAS, City and CVCS entered into an Agreement for Joint Use of Sports Facilities on
February 14, 2017 ("February 14, 2017 Agreement"), and are mutually interested in providing additional
recreational opportunities as described therein;
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which
is hereby acknowledged and agreed, City and Instructor agree as follows:
I. NEW SECTION. Section III of the February 14, 2017 Agreement shall be amended by the addition of a
new section, section E, to read as follows:
E. Batting cage at Mo Brooks Field. CVCS shall install, at its sole cost, a batting cage at Mo
Brooks Field, in the mutually agreed upon location on the east side of the field. CVCS shall, at its
sole cost, maintain the batting cage, including repairs and replacement of components, as necessary.
CVCS shall remove the batting cage netting in the fall, store it for the winter, and reinstall it in the
spring. The batting cage shall be considered an amenity of the field. The party reserving Mo Brooks
Field shall have use of the batting cage during the reservation. When Mo Brooks Field is not
reserved, it shall available for public use on a first-come first-served basis. Neither CVCS nor City
shall lock or otherwise restrict the uses of the batting cage described herein.
II. FEBRUARY 14, 2017 AGREEMENT FULLY IN EFFECT. The intent and effect of this First Addendum is
add a new section, Section III.E., to the February 14, 2017 Agreement. Except as expressly set forth
herein, this Addendum does not otherwise modify or alter any term or condition of the February 14,
2017 Agreement in any way. The February 14, 2017 Agreement remains in full effect, and all terms
and conditions thereof are incorporated in this First Addendum as though fully set forth herein.
IN WITNESS WHEREOF, the parties hereto have executed this First Addendum on the
Effective Date written above.
