Description
City Council modification of the UDC (11-3A-6D) requirement for irrigation easements wider
than 10 feet to be included in a common lot that is a minimum of 20 feet wide and outside of a
fenced area, to allow the irrigation easement on Lots 4-12, Block 3, Bainbridge Hess Subdivision
No 2 to be located within adjacent building lots and not a common lot

The Idaho Transportation Department (ITD) reviewed the referenced application and has the following comments:
1. This project does not abut the State highway system.
2. This development will gain access to the State Highway system along the US-20/26 (West Chinden
Boulevard) corridor. The City is reminded that the US-20/26 (West Chinden Boulevard) corridor is
already congested. This project will increase the number of vehicle trips in this corridor. While this
individual development is not large, the accumulation of developments accessing the State Highway
system at the US-20/26 (West Chinden Boulevard) corridor is creating additional congestion. As the City
continues to add additional trips to these corridors through development, the congestion will worsen until
the roadway system is ultimately overloaded and fails.
3. The STAR project for the improvement of US-20/26 Ten Mile Road to SH-16 is projected to begin
construction next spring. The project includes the installation of a traffic signal at US-20/26 and North
Black Cat Road. ITD respectfully requests the City withhold all occupancy permits until a traffic signal
has been installed at US-20/26 and North Black Cat Road.
4. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.

5. The Idaho Administrative Procedures Act (IDAPA) 39.03.60 governs advertising along the State highway
system. The applicant may contact Justin Pond, Right-of-Way Section Program Manager, at (208) 334-
8832 for more information.
6. ITD does not object to the proposed modifications as presented in the application provided the US-20/26
(West Chinden Boulevard) and North Black Cat intersection is signalized prior to occupancy of the
subdivision.
