Honorable Council Members,
Over the past thirty-five years, members of the Heritage I, Heritage 2 and the Crestwood
Subdivision have cleaned and maintained the Parkins-Nourse Lateral. Other participants
over the years have been Mr. John Tolk, Cecil Thomas (and later Mr. Quinzer).
This lateral is a major supply of water flowing 250 inches more or less. All of these
entities have cooperated to clean the ditch from the center of Section 32, T. 4 N., RIE.,
B.M. east to Eagle Road and beyond to the point of diversion from Settlers Irrigation
District canal known as the North Slough. The ditch has required backhQes and burning
equipment as well as hand cleaning to maintain the water flow. For example, in 1996 the
said ditch water seeped onto the property to the south because of willows and trees along
the south bank that eroded the integrity of the ditch bank. The ditch has a low gradient
and the flow is relatively slow which promotes silting that must be removed periodically.
At the center of Section 32, the Parkins-Nourse Lateral has a diversion point where
Heritage I and 2 presently divert water, and the remaining flow continues west to N.
Locust Grove Road where it again distributes water to the Brockton Subdivision,
Heritage Commons Subdivision and Crestwood Subdivision. Heritage Commons
Subdivision, Meridian School District, Champion Park Subdivision, Havasu Creek
Subdivision and much of Crest wood Subdivision (where development bas occurred) have
piped the water in the Parkins-Nourse Lateral to limit the need of maintenance and the
added debris from the subdivisions
An annual meeting for the maintenance and cleaning of the ditch from the center of
Section 32, T. 4 N., RIE., B.M. east to Eagle was held Thursday evening March 31,
2005. Seventeen members of the various subdivisions were present and voiced the
following concerns:
1. Mr. Twayne Walker was infurmed April23, 2003 that the metal pipe he installed
on the North edge of his property was substandard to Settlers Irrigation District
standards and was unacceptable.
2. The Phase One (a commercial development) appears to have not provided an
adequate right-of-way as required in Sections 42-1204 and 42-1208 of the Idaho
Code.
3. Based on the observed construction of the commercial development, its wooden
fence is within ditch right-of -way and the lack of access creates a serious
problem. This makes it impossible to access the ditch with proper equipment to

bum and clean the ditch and ditch bank without harming the wooden fence or
creating a hazardous safety issue to workers.
4. Based on the experience of members in the meeting there is great potential for
conflicts with the future subdivision property owners and the right of the water
users to maintain the Parkins-Nourse Lateral as established at this time.
It was unanimously agreed that the following should be required if the development is to
proceed:
I. Mr. Walker complies with the directive sent him April 23, 2003 by Settlers
Irrigation District and complies with the schedule or schedules of other Parkins-
Nourse water users.
2. Proper right of way be provided by the developer or assume future adequate
maintenance of the Parkins-Nourse Lateral.
3. The said ditch be piped according to the standard of the Settlers Irrigation District
from the center of Section 32 east to Eagle Road and north along the common
boundary of Heritage One Subdivision and the proposed Zebulon Heights
Subdivision No.2 with a proper measuring diversion for the above subdivisious at
the existing dividing weir.
As a group of concerned citizens, we would appreciate your serious consideration of
the above points of concern for the enforcement of existing Parkins-Nourse user
rights and interference from adjacent developments.

Re: Parkins-Nourse Lateral
Dear Mr. Walker:
This is to inform you that the metal pipe you installed in the Parkins-Nourse lateral is
unacceptable. The metal will corrode over time as it is exposed to the chemicals (copper
sulfate) used in the canal for mossing. At the end of this water season, please replace the
metal pipe with reinforced concrete pipe to avoid any problems in the future.
