Dear Madam Mayor and Honorable Council Members,
I am a homeowner and sit on 8+ acres on the south side of the proposed
Zebulon Heights subdivision. I built my house 11 years ago and have enjoyed the
quietness of country living. My property consists of one residence on a large open
parcel. I've provided an aerial view alongside a diagram of the proposed development.
My primary concern, as you can see from the attached photos and diagrams, is
that my backyard will be essentially ruined in terms of privacy if the developer elects
to build two-story residences close along the property line between the subdivision and
my property (Lots 25-28 in Blocl<. 10). Although the proposed CCR's requires 30 feet
of setbacl<. from the rear of these lots, without some additional measures, my bacl<.yard
will be turned into a "fishbowL" My open bacl<.yard and large lot size will create a
wide angle of view from the residences from their second story windows. We have a
hot tub located on the property on the side of the yard near the proposed subdivision.
We will not feel comfortable using our space when we will be on full display for the
houses next to us.

As I understand it, the Council is to consider, when approving a conditional use
permit, the following:
C. That the design, construction, operation and maintenance
will be compatible with other uses in the general neighborhood and with
the existing or intended character of the general vicinity and that such
use will not adversely change the essential character of the same area;
D. That the proposed use, if it complies with all conditions of
the approval imposed, will not adversely affect other property in the
vicinity;

I believe that if no additional restrictions are placed on lots bordering my property,
the proposed development will not be compatible with my current use and will adversely
affect my property (both in its usability and value).
I would request, at a minimum, that lots 25-28 in Blocl<. 10 have restrictions placed
on them prohibiting second story windows on the side of the structures facing my
property. To me, this would seem to be the most cost effective solution to the problem
as additional site barriers will be expensive and limiting the residences on lots 24-28 to
single story construction may be too harsh a restriction for the developer (though I would
consider either of those as solutions as well).
Because we are dealing with only four (4) lots out of a development of 160+ lots,
I don't believe my request is unreasonable nor do I believe it will have any significant
impact, either financial or otherwise, on the development.
