Subject Bainbridge Connection Subdivision No. 2 (Formerly known as Bainbridge
Hess Subdivision No. 2) Final Plat Modification
Brighton Development Inc. is requesting a modification to the approved final plat for Bainbridge
Connection Subdivision No. 2 (Formerly known as Bainbridge Hess Subdivision No. 2).
Site Specific Condition 4C in the staff report states, "Irrigation easements wider than 10 feet are
required to be included in a common lot that is a minimum of 20 -feet wide and outside of a
fenced area, unless otherwise modified by City Council at a public hearing with notice to
surrounding property owners, as set forth in UDC 11 -3A -6D. If Council grants a waiver, a letter
from the easement holder needs to be submitted consenting to the easement being located within
building lots, rather than a common lot."
Brighton Development has worked with the easement owner and attained written approval for
the easement to be located within the rear of buildable Lots 4 through 12, Block 3, and not in a
common lot. Typically, and throughout this project, there would be a 10' wide gravity irrigation
on both sides of the shared rear lot line to create the 20' wide overall easement. However, with
Bainbridge No. 2, an easement was not recorded, thus requiring that the entire 20' easement be
placed on Lots 4 through 12, Block 3 within the phase of development.
Brighton Development respectfully requests the council's approval of the waiver to allow the 20' wide
gravity irrigation easement to be within a buildable lot, and not a common lot.
