AND C4 LIMITED LIABILITY COMPANY
FOR TEMPORARY IRRIGATION METER IN EAST RIDGE ESATES NO. 1
This MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF MERIDIAN AND C4 LLC, is
entered into this day of , 20 by and between the City of Meridian, a municipal
corporation organized under the laws of the state of Idaho ("City"), and the C4 LLC ("Developer").
WHEREAS, Developer has been granted a ground water well permit from the Idaho Department of
Water Resources, that will eventually be the source for the pressurized irrigation system being constructed in
the East Ridge development.
WHEREAS, Due to grading and preparation for development of East Ridge Estates No. 1, there are
bare cut slopes that are unprotected from erosion (see Exhibit A for locations).
WHEREAS, Said ground water well and pressurized irrigation system will take time to build and be
operational, and the need to revegetate the cut slopes needs to be done expediently to prevent erosion.
WHEREAS, Developer has requested a temporary connection to the City's domestic water system for
the sole purpose of providing irrigation water to the bare cut slope areas for revegetation efforts.
WHEREAS, The City hereby agrees to provide temporary domestic water service to the Developer's
pressurized irrigation system for the purpose of revegetating the cut slope areas as indicated on Exhibit A, for
the 2019 irrigation season.
NOW, THEREFORE, in consideration of the mutual covenants of the parties, the Parties agree as
follows:
I. REQUIREMENTS
A. Payment. Developer agrees to pay for the temporary meter prior to it being installed.
1. This payment shall not be refunded.
B. Abandonment. Developer agrees to abandon the temporary water service when it is no longer needed,
or when the 2019 irrigation season ends; whichever comes first.
The abandonment shall follow current City of Meridian standards and shall be reflected in the
projects As -Built Drawings.
2. The temporary meter will be returned to the City following abandonment.
