Variance for time extension on recording the final plat
Dear Shari:
On behalf of Overland Storage, LLC (Mike ~Bledsoe and John Grunenwald ~. I am submitting an
application to allow for a second time extension for recording the Pack It Up Subdivision Final
Plat.' The site is generally 900 ft. west of, Locust Grove Rd. on the north side of Overland. Per your
letter dated April 08; 2002, the final plat must be recorded by April 18, 2002. AS you are aware, the
fmal .plat is complete with all ,required signatures and certifications except the Ada County
Surveyor, Ada County Treasurer, and Ada County Recorder.
At this point the Ada County Surveyor has required the vacation of the "future streets" within the
existing Timothy Subdivision t a portion of which contains the Pack It Up Subdivision area) before
he will stgn and certify the Pack It Up Subdivision Final Plat. ACHD has previously signed and
certified the Pack It Up Subdivision Final Plat. In my discussions ~vith ACHD and the Ada County
Assessor, neither agency recognizes the "futUre streets" within Timothy Subdivision as dedicated
public right-of-way. However. due to the Ada County Surveyor requirement, we are processing a
right-of-way vacation of 'the "future streets" with ACHD. Further, Meridian has granted their
consent to ACHD for the vacation of "future streets." The applications for vacating the ",future
streets" have been submitted to ACHD. the street vacation issue is the only outstanding item
necessary before the Pack It Up Subdivision Final Plat is recorded. Unfortunately. the timeframe
£or vacating right-of-way is approximately three to four months.
Based on the aforementioned issuel I am requesting a variance from Section 12-3-8'of the Meridian
Subdivision Ordinance (Approval of Final Plat) to allow an additional extension of time for.
recording the Pack It Up Subdivision Final Plat. Clearly, the requested variance will not be
detrimental to the pi~blic welfare, will not violate Idaho Code. nor adversely affect the
COmprehensive Plan. However. strict compliance with the:requirements of Section 12-3-8 would
result in an extraordinary hardship to the subdivider in this instance ba~ed o'n aforementioned facts
and related issues. TO reiterate, all agency requirements related to the Pack It Up Subdivision Final
Plat have been met except for a street vacation issue raised by the Ada County Surveyor, which
issue is questionable. I believe that an additional six months should adequately cover the tim~
necessary for completing the street vacation process and recording the plat.
