Dear Mr. Elg:
This letter is to confirm that the City of Meridian's City Council approved the
Final Plat application for the subject property at their June 5, 2007 meeting.
Approval of the Preliminary Plat shall be null and void if the applicant fails to
record the final plat within two
years of the approval of the preliminary plat per
UDC 11-68-7A. In the event that the development of the preliminary plat is
made in successive phases in an orderly and reasonable manner, and conforms
substantially to the approved preliminary plat, such segments, if submitted
within successive intervals of eighteen month$ may be considered for final
approval without resubmissionfor preliminary plat approval per UDC I1-68-78

Dear Sonya,
This letter shall serve as our request to extend CUP-08-021 for an additional eighteen
(18) months from the termination of the initial eighteen (18) month period. The conditional use
permit was approved on September 5,2008 and will expire on March 5,20L0. We would
request that the permit be extended to Septemb er 5,2011.
To date, and due to retail market conditions, the applicant has been unable to secure the
tenant leases required to move forward with the project.

WHEREAS, Grantors are the owners of a development on which portions of a City of
Meridian public sidewalk is located; and
WHEREAS, the Granto$ desire to grant an easement to the City of Meridian and provide
connectivity to present and future portions ofthe sidewalk; and
WHEREAS, Grantors have constructcd the sidev/alk improvernents upon lhe easement
described herein; and
NOW, THEREFORE, the Grantors do hereby grant unto the Grantee an easement on the
following property, described on Exhibit "A" and depicted on Exhibit

and incorporated herein.
The easement hereby granted is for the purpose ofproviding the general public easernent
for non-motorized pedestrian access to and upon the sidewalk.
TO HAVE AND TO HOLD, the said easement unto the said Grantee, its successors and
assigns forever.
THE GRANTORS hereby covenant and agree that they will not place or allow to be
placed any permanent structures, trees, brush, or perennial shrubs or flowers within the
area described for this easement, which would interfere with the use ofsaid pedestrian
sidewalk, for the purposes stated herein.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto,
that Grantors; their successors or assigns, shall repair and maintain the sidewalk
improvements that are located on or adjacent to Grantor,s property on Meridian Road.
